The Ada Caunty Highway District ~ACHD} staff has received the above referenced application requesting conditional use approval to const~.rct 72,000-square feet ofmini-storage units. The S.0-acre site is located an the south side of Fairview Avenue approximately %-mile west of Locust Grove Road. This development is estimated to generate 250 additional X500 existing} vehicle trips per day based on the institute of Transportation Engineers Trip Generation manual. B. The application and site plan stamped as received by the City of 1~~eridian on December 10, 1999, and submitted to the District on December 21, 1999, have been reviewed by the ACRD Planning and Development staff and conforms to applicable District standardslpolicy, or can be made to conform with the changes} to the plan described in the requirements stated below. This is a staff level approval and will not be heard by the ACHD Commission unless the site plan is chanced in such a manner as to not conform tivith District standardslpolicy or an appeal of the Planning and Development staff decision is submitted as described within the Standard Requirements outlined below. C. ~n December 22, 1999, the District Planning and Development staff inspected this site and eval~iated the transportation systejn in the vicinity. ~n Jan~~ary 7, 2000, the staff met as the District's Technical Review Committee and reviewed the impacts of this proposed development on the District's transportation system. The res~ilts of that analysis constit~ite the following Facts and Findings and recommended Site Specific Req~Eiremei~ts. The #~oilotivinb requirements are provided as conditions for approval: Site Specific Requirements: 1. Dedicate 60-feet ofright-of ~vay from the centerline of Fairview Avenue abutt!!~g the parcel by means ofrecordation ofa final subdivision plat or execiltion of a warrant deed riot to iss~lance y P of a building permit for other req~lired permits}, tivl~ichever occurs first. Or, verity that there is an ex~st~ng 60-feet ofright-ot-way abutting the entire site. Allow ~!p to ~0 b~lsiness days to process the right-of ~vay dedication after receipt of all req~iested material. The owner will be compensated for all right-off tivay dedicated as an addition to existing right-of=~vay from available impact fee revenues !n this benefit gone, if the owner s~lbmits a letter of application to the impact .fee administrator prior to breaking gro~lnd, in accordance with Section ~~ of ACRD Ordinance X193. ?. Construct a 5-foot wide concrete sidewalk on Fairview AvenE~e abutting the entire parcel located Z-feet within the right-of ~vay. Coordinate the location, elevation and grade of the sidewalk with District staff. 3. The existing driveways are approved with this application. 4. Acquire a recorded access easement to use the private road for access to the public street. 5. Utility street cuts in pavement less than f ve years old are not allowed unless approved in writing by the District. Contact Constrl~ction Services at 387-6280 with file number} for details. 6. Other than the existing access points, direct lot or parcel access to Fairview Avenue is prohibited. Standard ~tequxren~ents: I . ~ This decision of the Planning and Development Supervisor maybe appealed to the Ada County Highway District Commission by the applicant or by another party within IS calendar days from the date ofthis report. The re uest shall s ecifcally identify each re uirement to be reconsidered and incl~lde a written ex lanation of wh such a re uirement would result in a s~rbstantial, hardship or ine,~~lity. Tl~e request will be heard by the Distnct Commission at an evening meeting within ?0 calendar days of the District's receipt of the appeal letter. The appellant will be notified of the date and time of the Commission meeting. . After ACRD Commission action, any req~lest for reconsideration o Ethe Commission's action shall be made in writing to the Planning and Developme~~t Supervisor within t~vo days of the action and shall incl~~de a mini~~~~lm Fee of~110.00. The req~lest,.~or recot~siderati,on shall, s ecifically identify each re uirement to be reconsidered and include written doc~lmentation of data that tivas not available to the Commission at tl~e time of it's original decision. The request For reconsideration tivill be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. Payment of applicable road in~pact fees are required prior to building constriction in accordance with Ordinance # 19~, also known as Ada County Highway District Road Impact Fee Ordi~~ance. ~. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPwC Standards and approved suppletne~zts, Const~,iction Services rocedtires arld all p applicable ACRD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certil`y all improvement plans. 5. The applicant shall submit revised plans for staff approval, prior to issuance o~b~~ilding permit for other regt~ired permits, which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada Co~~nty Highway District prior to District approval For occ~~pancy. 7. Any change by the applicant in the planned Lase of the property which is the subject ol,this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other reg~llatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a tivaiverlvariance of said requirements or other legal relief is granted pursuant to the law ~n effect at the time the change in ~xse is sought. 8. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. Conclusion of Law: 1. ACRD requirements are intended to assure that the proposed ~~seldevelopment will not place an undue burden on the existing vehicular and pedestrian transportation system within the vicinity impacted by the proposed development.
