Attached, you will find the required submittal documents. Setter Cove Subdivision is unable to comply with ordinance 430, 4-2-1984, which states, "Blocks shall not be less than five hundred feet (500') nor more than one thousand feet (1000') in length." The block length of Setter Cove Subdivision exceeds one thousand feet (1000'). The size of the property is prohibitive, which prevents compliance with the ordinance. Due to an already existing subdivision to the south of the proposed subdivision, it is impossible to stub a street to the south of the property. This is a circumstance that was not a result of the applicant's action. The proposed subdivision is comprised of 15 new homesites, one lot for an existing home, and two common area landscape lots on 9.996 acres. In order to maximize the present land usage and accommodate the existing home, Setter Cove Subdivision is unable to comply with the ordinance. A Literal interpretation of the provisions of this ordinance shall deprive the applicant of rights commonly enjoyed by other properties in the same district under terms of this ordinance. If Setter Cove Subdivision complied with fhe literal interpretation of the ordinance, that configuration would not be the best usage of the land. The subdivision would not have as much open space, which would deprive the applicant of rights commonly enjoyed by other properties in the same district. This is also a circumstance that was not a result of the applicant's action. Granting of the variance shall not confer on the applicant any special privilege that is denied by this ordinance to other lands, structures or buildings in the same district. The Layout of Setter Cove Subdivision that was submitted with the preliminary plat application maximizes land use. Other lands, structures or buildings in the same district are also encouraged to maximize the use of the land they occupy in order to better serve the City of Meridian. p.2 Feb 21 ^3 08:47a TEflLEV'S LRND SURVEYING 2n8~0696 • Even though granting of the variance would also convenience the applicant, this is not the sole reason why the variance is being requested. The variance is requested in order to get the most possible from the land being subdivided. This will better serve Meridian in accordance to the Meridian Comprehensive Plan.
