C~94_- AN ORDINANCE OF THE CITY OF MERIDIAN RCEL OF LAND BEING A ORTtON REAL PROPERTY WHICH IS DESCRIBED AS A PA OF LOT 2 AND LOT 3, BLOCK 2, OF COMMERCE PARK SUBDIVISION, AS FILED FOR RECORD IN THE OFFICE OF THE ADA COUNTY RECO SECTION 9, ~ 3N5R.1 E, B.M , AT PAGE 3721 ANDHO?AND PROVIDING AN EFFECOTIVE DATE. ADA COUNTY, IDA , WHEREAS,, the City Council and the Mayor Of the City of Meridian, Idaho, have concluded that it is in the:best interest of said City to annex to the said City real property which is described in Section 1 below: NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of Meridian; Ada County,ldaho: Section 9 : -That :the. real property described as: A parcel of land being a portion of Lot 2 and Lot 3, Block 2, of Commerce Park Subdivision, as filed for record in the office of the Ada County Recorder in Book 45 of Plats at pages 3721 and 3722, located,in the SW 174 of Section 9, T.3N, R.1 E, B.M., and more particularly described as follows: Commencing at a brass cap monumentmarking the West.1l4 comer of said Section 9; thence South 0°00'00" West 871.85,feet along the West line of the SW 114 of said Section 9 to a brass cap monument marking the intersection with the centerline of Commercial Court; thence South 89°55:55".East 477.63 feet along the centerline of Commercial Court to the REAL POINT OF BEGINNING; thence North 0°00'43" East 448.70 feet to a found 5/8" iron pin marking the intersection with the North tine o#.said Lot 2, Block. 2; thence South 87°54'47" East 49.35 feet along said North line to a found 578"`iron pin marking an angle point therein; thence continuing along said North line North 42°58'54" East 12.25 feet (formerly described as being North 44°07'21" East 12.31 feet on said Commerce Park Subdivision plat) to a. 518".iron -pin .marking an angle .point therein.; thence continuing along said North line and the North line of Lot 3, Block 2, Commerce Park Subdivision North 88 23 29 East 163.18 feet to a 518" iron pin, said iron pin being distant 57.16 feet from an angle point in the North line of said Lot 3, Block 2; thence South 0°00'58" West 460.70 feet to a point on the centerline of said Commercial Court; thence North 89°55'55" West 220.75 feet along the centerline of said Commercial Court to the Point of Beginning. is hereby annexed to the City of Meridian, and shall be zoned 1-L Light Industrial; that the annexation and zoning is subject to the conditions referenced in the Findings of Fact and PAGE 1 ANNEXATION ORDINANCE -PACIFIC WATER V1-ORKSII-L 468 Conclusions of Law as adopted bythe-Meridian Council on the request for annexation and zoning. Section 2. That the property shall be subject to de-annexation if the owner shall not meet the following requirements: a. That the Applicant will be required to connect to Meridian water and sewer and resolve how the water and sewer mains will serve the land. b. That the development of the property shall be subjec to and contolled by the Subdivision and Development Ordinance and the Meridian Comprehensive Plan adopted January 4, 1994. c. That, as a condition of annexation, the Applicant-shall be required to enter into a development agreement as authorized by 11-2-416 L and 11-2-417 D; that the development agreement shall address inclusion into the subdivision of the requirements of 11-9-605 C, G, H 2, K, L of the Revised and Compiled Ordinances fo the City of Meridian and other matters; that the property may be de-annexed if the terms and conditions of the Development Agreement are not satisfied. d. That the development of annexed land must meet and comply: with .the Ordinances of the City of Meridian and in particular Section 11-9-616, .which pertains to development time schedules and requirements, 11-9-605 M which pertains to the tiling of ditches and waterways, and 11-9-606 B 14 which pertains to pressurized irrigations. e. That these conditions shall- run with the land and bind the Applicant, the titled owners, and their assigns. Meet the requriements and condtions of the Findings of Fact and Conclusions of Law and meet the Ordinances of the City of Meridian: Section 3. That the City Clerk shall cause one (1) copy of the legal description, and map, which shall plainly and clearly designate the boundaries of said property,. to be filed with the Ada County Recorder, Ada County Assessor, and the State Tax Commission within ten. (10) days following the effective date of this Ordinance. Section 4. EFFECTIVE DATE: There being an emergency, which emergency is hereby declared to exist, this Ordinance shall be in full force and effect from and after ifs passage and approval as required by law.
