Staff members present; Patricia Nilsson, Daren Fluke, Shawn Nickel and Jeff Patlovich, Development Services; and Ted Argyle, Prosecuting Attorney's Office. Minutes Recorder: Kelly W. May. . ~N THE MATTER 4F CALL TD ORDER: r ~~~ Commissioner Roger Simmons called the meeting of the Ada County Commissioners to order at 11.04 AM. IN THE MATTER 4F RILL CALL: In attendance were Cammissioners Roger Simmons and Frank Walker. Vernon L. Bisterfeldt was absent, Also Present.: Mayor Bob Carrie, Walt Morrow, Glenn Bentley, John Tensen, Wayne L. Peterson, Tucker Johnson, Wayne G. Crookston Jr., Shari Stiles, Gary Smith, Will Berg, Reverend Greg Reider, Don Burton, JoAnn Butler, Ted Coltrin, Glarra Coltrin, Marvin Peterson, Wayne H. Peterson, Frank Thurman, Ted Jal~nsan, and Jim Merkle. T. Nilsson provided a report and explained her proposed recommendation for the Meridian area of impact. She explained that the boundary recommended by the Ada County Development Services staff for the area, designated A an the map, would be west of the Johnson and Howell properties. J. Tensen said that Boise City could work with that boundary, but uestioned Baise City's ability to provide gravity sewer to the arcel above the J 9 P ohnson property, He said it was highly unlikely that Baise City could provide sewer all the way to Locust Grave Road, R. Simmons said he anticipates that this will go to a public hearing, and told the members of the audience that they would have an opportunity to speak at that time. T, Argyle asked if Meridian and Ada County are planning a joint public hearing. T. Nilsson explained that there will have to be several hearings. T. Argyle asked if there was any reason not to have a joint hearing. R. Simmons said na, and added that he would prefer that, He would like to hold at least one public bearing in Meridian at their regular time. T. Argyle received clarification of the exact boundaries on the map, T, Nilsson continued her explanation of the proposal, focusing on the area marked B. G. Smith asked why area B wauId not be included in the Meridian area of impact, J, Patlavich explained that it was because Meridian will not be able to provide sewer and services to area B in the next ten years. Sinunons asked if Meridian could pravide gravity sewer to the eastern boundary of area A in ten years, T. Nilsson replied that Meridian has said they could. B. Carrie asked if Meridian must provide sewer within ten years to section A. T. Nilsson said that they should if it is possible, and Ada Caunty staff has been told it is. B. Cowie asked if they are not able ta, will that area go back to the County? T. Nilsson said not unless the County inserts a revisitation clause into the area of impact agreement that would trigger that. F. Walker said that in aten-year period, the growth is expected in area A, and there will be a need for sewer there. B. Cowie questioned why sewer could be available to area A in ten years and oat area B J. Patlovich answered that the Meridian staff indicated to the County that they would not be able to service area B in ten years. G. Smith agreed, explaining that Meridian could pravide gravity sewer tp area A, but they would have to build a lift station to provide sewer to area B. T. Nilsson explained that this was the reasoning behind dealing with area B separately. W, Crookston asked if Meridian doesn't provide sewer to area B, who will? He thought they should include the area now, R. Simmons said he assumed that the area of impact expansion must be based ~n to is and the Ada County Comprehensive Plan. He would like a def nition and g directjon regarding what Meridian could supply in terms of sewer. If Meridian could provide sewer to both areas, then he would like the Ada County staff to modify their recommendation, T. Nilsson said that area B was oat slated for development in the Meridian Comprehensive Plan, and no parks, schools, ~or developments have been planned in the area, J. Patlovich added that the County understood that Meridian would prefer to provide gravity sewer and not have.#o install pump stations. Since area B must be pumped, the Ada County staff~dr-,w tie line between A and B to avoid pumping sewer, If that is an incorrect assumption, they will revise their recommendation, G. Smith replied that the assumption was correct. T, Nilsson moved onto explain area C, which extended south to Overland Road, She said that beyond that point the land is agricultural and would oat be included in the area of impact. Cowie noted that he would like to have an agreement that said the areas discussed would be included in Meridian's area of impact permanently, so the County could not take any land away in the future. T. Nilsson said that the recommendation of Ada County staff dealt with drawing the area of impact line. She thought that V. Bisterfeldt had expressed his desire to revisit the area in the future to make sure services were being provided. R. Simmons said that he anticipated difficulty in adjusting these lines, but negotiating is the only way to proceed. B. Cowie noted that once the area of impact is decided, it facilitates sewer planning, He would like continuity and security so there could be some long-range planning without the area having to be revisited every five years. R. Simmans said that he also thought that V, Bisterfeldt would want to revisit this area, T. Nilsson explained that the Ada County staff had been conservative with the lines at the starting paint. She went on to discuss the boundaries of area D. F. Walker asked if there was any projected future growth in area D T, Nilsson said there are preliminary projections, which are low, but because of the existing development, they wanted to include this in the area of impact, She went on to discuss the boundary of area E, Ada County staff made no recommended changes in this area, because the projections of growth were low and they saw no need to increase the boundary at this time. B. Carrie said he would like to see the area stay in the Meridian referral area, so that any planning and zoning applications would be referred to Meridian, G. Smith asked what kind of development would be allowed, T, Nilsson answered that the ~zaning was mostly RR and R1, ten-acre zoning, although it could go into the transitional R-5 zone. She said there may be other issues, dealt with in the conclusion of her staff proposal, including the need for clarification of the ordinances which would enact the area of impact. R. Simmans asked if Ada County staff was recommending one mare meeting, T. Nilsson replied yes, to address the ordinance and referral agreement, . B. Cowie said he was concerned, and wanted the' area of impact to be a permanent, reserved region, so Meridian would be able to plan. with no fear of losing this area later an. ~V. Crookston said he was concerned about the referral agreement because of the language. Meridian officials thought tl~e referral area would eventually go to them in the area of impact, but that has not been the case in the past and they don't want this to happen again, He would like to strengthen the language of the referral area agreements to say that they will eventually go into the area of impact. F. Walker said he understood Meridian's concerns, but he did not believe the County should preserve enough land in the azea of impact to allow fora 3o year plan. He felt that the area of impact should not only be the land that can be readily provided with services, but an area where growth is planned to occur and land that would be incorporated at some time in the future. F. Walker did not think it was appropriate to plan the area of impact that far in advance. T. Argyle noted that Meridian is treated with special consideration where referral agreements are concerned. V~ith Meridian, Ada County allows referral areas outside of the area of impact, providing additional opportunity for dialogue. T. Argyle said that the same courtesy is not provided far other incorporated cities. UV. Crookston admitted that was correct, but he'd Tike to see it enhanced. R. Simmons said he thought that the Commissioners had only promised to try to provide room far growth and longwrange planning. He said that he would not cast a vote to revisit the area and, although staff recommend differently, he would push for more land within area E. He did not think it was realistic to predict growth too far in advance, but he would like to expand this alittlefurther. - B. Corrie admitted that growth and demographics are hard to plan, and they just want to make sure they have enough room to grow. F. Walker understood V, Bisterfeldt's desire to revisit the area of impact stemmed from a desire to prevent what happened with Boise in the southwest, but he would like to find a balance. R. Simmons said he thought it was imporkant to hold joint public meetings on this issue, but he would like to recommend that they have a meeting in Meridian and one at the County building. G, Bentley suggested holding those meetings at a time when it did not conflict with any other public hearings in the area. R. Simmons said that aver one more meeting with the Meridian City Council, he hoped the Commissioners will be ready to move forward an this issue and hold a public hearing. ACTIUN: R. AREA A Location Northeast area of proposea _ Lagle Road between Chinden Boulevar~ Issues This area has been the subjec~ ..~ meetings with the City of Meridian. At the January 14 meeting, John ~ ~Y~son of Boise Public Warks stated that Boise could provide gravity service to the Hawell property and the JohnsonlSkyline property. Gary Smith of Meridian Public Works stated that Meridian could provide gravity service to the area one~half Hole west of Eagle Road to Ten Mile Road. A detailed map of landownership in this area is attached. ACTION NEEDED: The Board and Meridian need to decide if the area of city impact boundary should follow the quarter section line one-half mile west of Eagle Road between Chinden Boulevard and McMillan Road. AREA B Location Northwest area of proposed area of city impact, between McDermott Road east to one~quarter mile west of Ten Mile Road and between Chinden Boulevard south to Ustick Road. Issues This area is designated as agriculturallrural residential and single family residential, Staff has proposed a boundary line one-quarter mile west of Ten Mile Road after considering the following information: • Meridian will provide gravity sewer service along Ten Mile Road south to their sewage treatment plant. Since a boundary line should allow for coordinated development along both sides of roadway, the sine is proposed to be located one-quarter mile west of Ten Mile Road. No sewer service is planned for the remainder of this northwestern area. • The expansion of the area of city impact north to Chinden consists primarily of proposed single family residential use. • Policy ~.3 of the Meridian Comprehensive Plan states: "Although it is recognized that urbanized development does exist within the rural areas of the Area of City Impact, the rural lands should be kept in agricultural production as long as possible until urban services municipal sewer and water facilities and other essential services} can be provided." • The Meridian Comprehensive Plan does not propose any schools, parks, fire stations, or wells in this area. ACTION NEEDED: The Board and Meridian need to decide if the area of city impact boundary should follow the quarter section line ane-quarter mile west of Ten Mile Road between Chinden Boulevard and McMillan Road. AREA C Location Overland Road between McDermott Road and one~quarter mile west of Ten Mile Road. Issues Staff is proposing an expansion of the impact area in this vicinity to include land along the I~84 corridor .after considering the following information: • There is significant land zoned R-1 in this area. • Anew interchange at Ten Mile Road is proposed in the 2015 Regional Transportation Plan. • The Meridian Comprehensive Plan designates this area for mixedlplanned use development. • The area south of Overland Road is designated as agriculturallrural residential in the Meridian Comprehensive Plan. As noted above, the Page 2 Meridian Comprehensive Plan states that rural lands should be kept in agricultural production as long as possible. ACTION NEEDED: The Board and Meridian need to decide if the area of city impact boundary should follow Overland Road between McDermott Road and one-quarter mile west of Ten Mile Road, AREA D Location Meridian Road one-half mile south of Victory Road. Issues Staff is proposing the expansion of the area of city impact to take in the southern portion of the Meridian Heights subdivision after considering the following issues: • The subdivision should be treated in its entirety for planning purposes by the City. • The Meridian Comprehensive Plan proposes a commercial, planned use development at Victory Road and S. Meridian Road. ACTION NEEDED: The Board and Meridian need to decide if the area of city impact boundary should include the southern half of the Meridian Heights subdivision. AREA E Location Dne-quarter mile south of Victory Road between Meridian Road and Cloverdale Road current boundary line} . Issues Staff has not proposed a shift in this boundary at this time. According to preliminary demographic data, the area bounded by Amity, S. Eagle, Columbia, and S. Meridian Roads is forecast to increase by only i4o households between the years 200o and 2020. Increasing the impact area would allow for the rezoning of these lands from Rural Residential CIO acre minimum} to Rural Transition ~5 acres minimum lot size). ACTION NEEDED: The Board and Meridian need to agree on the location of the impact area boundary in this area. Page 3 C~NCLUSI~N Dnce the Caunty and the City of Meridian have agreed on a proposed baundary, staff recommends that the County and City review the area of city impact ordinance Ada County Code, Title 9, Chapter 4} and the referral agreement for any desired amendments. once a consensus has been reached on the area of city impact boundary, ordinance, and referral agreement, the City and County need to schedule a public hearing before their respective Planning and Zoning Commissions. Idaho Code, Section 67-6526~e} requires the governing boards to submit the questions to the planning and zoning commissions for a recommendation. Each commission shall have a reasonable time fixed by the governing board to make its recommendations to the governing board. Once the recommendations have been received, the Meridian City Council would adopt the map and ordinance followed by action by Ada County.
