Simmons ~ ~ /~~ Frank Walker ~ 650 Main Street Boise, ID 83702 Re; Renegotiation of Area of City Impact Additional Information Dear Ada County Commissioners: Following is our response to the memorandum dated January ZS,1997, from Patricia Nilsson in regard to Meridian's Area of Impact: AREA A (Northeast) The City of Meridian can agree that the Howell and Johnson properties be served by Boise City. We also agree that the property of the First Baptist Church be included in Boise's Area of Impact. However, we do not concur with the suggestion that the entire 4~ acres, of which the First Baptist Church property is a part, be in Boise's Area of Impact. The City's Sewer Facilities Plan indicates a trunk line sewer is necessary through the Cobbs ~ Brown parcel to serve properties within our Area of Impact which are south and east of the Cobbs & Brown parcel. As a side note on this area, it appears from Ada County Assessor's records that the Cobbs & Brown parcel has been split into four pieces, with the lower ~~ acres being gland-locked parcel awned by Fadco, Inc. The letter faxed to us yesterday by Tricia Nilsson shows this split, but the line is crossed out. How have these splits taken place without a subdivision plat being prepared and recorded, and without referral to the City of Meridian? Ada County Commissioners February 6, 1997 Page 2 AREA B (Northwest) Ada County Development Services has stated no sewer service is planned for the area ro osed . ... 1? P to be excluded from our impact area. As shown ~ our Facilities Plan which has been submitted to you, this area will be served by a sewer line in Black Cat Road, as well as a sewer line near McDermott Road. No advantage will be gained by exclusion of this area. Includin it in g Meridian's Area of Impact will more fully ensure that rural lands will be kept in agricultural production until essential services can be provided. AREA C (Overland Road 1/4 Mile West of Ten Mile) This area is programmed far interchange construction and mixedlplanned use develaprnent. To properly plan the area and allow for compatible uses, the area proposed by the City of Meridian needs to be included in the Area of Impact as shown. The line proposed by your staff also cuts property in two. AREA D (Meridian Road) Your staff has indicated our Area of Impact should only include the Meridian Heights Subdivision. However, Kentucky Ridge Estates, to the west of Meridian Heights, is served by the same community sewer system; future development south of Kentucky Ridge Estates is planned which would logically be included in the Meridian Area of Impact. All of the land within the drainage area shown in the Comprehensive Plan needs to be included in Meridian's Area of Impact. AREA E (Southeast) Your staff proposes that the Area of Impact bound~y remain the same in this area. Desp~e this recommendation, the City of Meridian will have no choice but to include these areas in their planning process. Serving this area requires detailed planning of the sewerage facilities and includes a major trunk diversion line to tie into the Black Cat Trunk. If the City does not plan for this area now, parallel lines would be required for future development. The area the City has proposed is within our trade area, includes geographic factors for provision of services, and can reasonably be expected to be annexed to the City in the future. Leaving the boundary line as it is now allows less than one-half ale from our current annexed boundary to be included in our Area of Impact. The line proposed by your staff also cuts several properties in two. The Area of Impact is our olitical p boundary and ~s necessary to assure sound punning and retain the City of Meridian's identit . y If the areas proposed by your staff are excluded from Meridian's irripact area, haw does Ada County propose to serve these areas with: a, Central water. b. wastewater Collection and Treatment System. c. Public Safety Services. 1. Fire protection. 2. Law enforcement. 3. Emergency medical services. d. Schools. e. Urban Standard Streets and Roads. f. Parks and Recreation Facilities. g. Public Transportation. h. Libraries, i. Storm Drainage Facilities. ~ . Utility Facilities. k. Irrigation Systems. The City has experienced di~culty with the dissemination of information that is accun~in at Ada g County Development Services. Depending upon whom they talk to, property owners receive a different answer about the goals and requirements, according to various interpretations, of development proposals. what can the City of Meridian expect in the areas excluded from our Urban Services Planning Area? Citizens are told that, if included in Meridian's impact area, development may be allowed at a density of 1 dwelling unit ~du} per ~ acres instead of the normally allowed ten acres er du. This . P ~s not helpful to the City of Mend~an ~n its planning efforts. why does thrs policy exist? If property is within our Area of Impact, the City discourages development at less than urban densities. If Ada County keeps the density at 1 du per 10 acres, there is at least the ossibili ... p tY that resubdiv~s~an may take place when sewer and water facilities are extended. Does Ada County fallow their Comprehensive Plan in requiring that a resubdivision 1 into ratin p~ ~ g urban densities, be included, slang with a provision for dry-line sewer? we have not seen evidence of this. There are many instances in the County of development simply talon lace gP } without enforcement of development gu~del~nes of any kind. Examples of this are commercial Ada County Commissioners January 14,1997 Page 4 businesses operating in RR and RT pones, lots being split that do not meet the requirements of the zone they are within, construction without permits, etc.. Citizens seeking information regarding development within Meridian's r d impact area are simply referred to the City of Meridian, with no explanation of what the County may or may not allow. This has created a tremendous added workload far the City of Meridian. Just because a property a,~n be developed t.~, does not mean that it should be. Development should not be driving planning, planning should be guiding development. Ada County has included within its Comprehensive Flan aprovision that the cities within the county provide services to ,~ of their respective Areas of Impact within ten years. This is not a logical time frame. The City of Meridian needs a fixed target to plan to aver a 20-year period, not the arbitrary ten-year period that has been established. when the Ada County Comprehensive Plan was drafted, it first showed that services were to be provided within seven years. This time frame is woefully inadequate. It has taken us over three years'ust to get to the table to talk about our Area of Impact. when an expansion of the Meridian Area of Impact is needed to fulfill planning objectives, can the City of Meridian ex ect p the same rapid response that Boise City received to accommodate a change? we understand how pressures from developers could possibly be driving your staff s recommendations. The people that live in Meridian's Area of Impact and want to stay there are the ones that suffer. We would like a decision to be made which is in the best interests Qf the City of Meridian n~ Ada County. we urge you to accept our Area of Impact as we have proposed. Board of Ada County Commissioners FROM: Patricia Nilsson, AICP, Planner III RE: Meridian Area of City Impact ordinance In preparation for the February 7 meeting with Meridian, I have proposed revisions to the Meridian Area of City Impact Ordinance and the Referral Agreement, as shown on the attachments . Most of the proposed changes result from updating terms to describe the current Meridian Comprehensive Plan and to clarify notice procedures. Two mare substantive changes include: • Increasing the time for County review of proposed changes to Meridian plans and ordinances from 15 days to 34 days. This is the same amount of time that Meridian has to review changes to County plans and ordinances. • Clarifying that the County will send to Meridian only those land use applications within the impact area and the referral area to be considered by the County Planning and Zoning Commission or the Board. This would exclude land use application that are processed administratively. I have not received any proposed changes from Meridian at this time. Meridian Area of City Impact Boundary Map: 1. The Meridian Area of City Impact is the area designated on the Meridian Area of City Impact Boundary Map, hereby fully incorporated by reference, copies of which are available for inspection at the Ada County Development Services Department. 2. Annexation by the City of Meridian shall be limited to those lands lying within the area of impact and being contiguous to the boundaries of the City of Meridian. B. Upon annexation, the provisions of this agreement shall no longer apply to the annexed area. Ord. 13 7,10-17-84; amd. Ord. l b 1,12-1 D-86; amd. Ord. 229,12-2D-90} 9-4-3: APPLICABLE PLAN POLICIES AND ORDIl~ANCES: A. The Meridian Comprehensive Plan, as ~ado~ted by the City of Meridian on ~1~; December 2 ~ z ~ 993, shall apply to the Meridian Area of City rmpact. B. All subdivision plats, situated within the area of impact, shall be submitted to the City of Meridian for approval, in addition to Ada County approval, as provided in Xdaho Code section SD-1306. C. All subdivision plat applications in the urban service planning area for land zoned RT Rural Transition} shall require a street and utility easement plan, Said plan shall provide for future resubdivision to urban densities and shall be included on the f nal plat. This requirement may be waived if a letter is submitted to the Director from the Meridian City Council prior to preliminary plat approved by the Board. D. A condition of approval for all subdivision plats in the urban service planning area for land zoned RT Rural Transition} shall require that, prior to occupancy of the subdivision's first dwelling unit, dry line sewer and water lines shall be installed to accommodate the future resubdivision to urban densities. This requirement may be waived if a letter is submitted to the Director from the Meridian City Council prior to preliminary plat approval by the Board. E. The Ada County Code, Title 8, the Zoning Ordinance, shall be used to implement this Chapter. All land use applications shall also comply with the provisions of this Chapter. Ord. 137,1D-17-84; amd. All applications for County and City amendments to their respective comprehensive plans and implementing ordinances which apply within the Meridian Area of City Impact shall be sent to the entity considering such amendment to the other entity. A separate referral process shall be adopted by resolution by each entity regarding procedures and time periods for, and the effect af, sending such amendments, and such resolution may be amended from time to time upon mutual agreement in writing by Ada County and the City of Meridian. B. All County applications considered b the Ada Coun Plannin and Zanin Commission or the Board of Ada Coun Commissioners ' ' ' , ' ' within the Meridian Area of City Impact shall be sent to Meridian, in accordance with the referral process arrived at pursuant to subsection A above. =Ord. 137,10-17-54; amd. In accordance with Idaho code section 67-6526~d), the Meridian City Council or the Board may request, in writing, renegotiation of any provision of this Chapter at any time, within thirty X30} days of receipt of such written request by either party, a meeting between the two ~2) jurisdictions shall occur. B, while negotiation is occurring, all provisions of this Chapter shall remain In effect until this Chapter is amended or a substitute ordinance is adopted by Meridian and Ada County, in accordance with the notice and hearing procedures provided in Ada County and Idaho Codes, or until a declaratory judgment from the District Court is final. Provided, however, that this Chapter or stipulated portions thereof shall be of no further force and effect if both jurisdictions so agree by mutually adopted resolution. ~Ord.137,10-17-84; amd. Ada County Development Services X50 Main Street Boise, Idaho 83702 Re: Meridian Area of City Impact Modification Dear Patricia: FEB 0 71997 r ~ ~;~ rnt_~~`~ This letter is written as a follow up to our discussion following the January 2S, 1997 Ada CountylMeridian City meeting regarding proposed area of impact modifications. As a part of this process, we would .formally request that the area of impact boundary between Boise City and Meridian be modified in the area between Overland Road and 1-84 adjacent to the Ridenbaugh Canal where the Meridian area of impact bisects an existing subdivision. This leaves four lots on the Boise City side of the Ridenbaugh Canal in the Meridian area of impact. I've attached a drawing depicting the proposed boundary modification that would eliminate this problem. It's my understanding that the Meridian City Engineer and the Meridian City Attorney are in agreement with the proposed boundary, Boise City is currently in the process of designing sewer to serve the remainder of the lots within the Cloverdale Acres subdivision and this boundary modification will allow for us to plan for and provide service to the remaining four lots.
