AN ORDINANCE OF THE CITY OF MERIDIAN AMENDING AND CHANGING THE ZONING OF CERTAIN REAL PROPERTY IN THE CITY OF MERIDIAN WHICH IS DESCRIBED AS A TRACT OF LAND SITUATED IN A PORTION OF THE SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 1, TOWNSHIP 3 NORTH, RANGE 1 WEST, BOISE MERIDIAN, ADA COUNTY, IDAHO; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Courtcif and the Mayor of the City of Meridian, Idaho have concluded that it is in the best interes# of said City to amend and change the zoning from R-8 Residential to L-0 Limited Office; for the described parcel in Section 1 below. NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council, of the City of Meridian, Ada County, Idaho: - Section 1. That the real property which is described as: A tract of land situate in a portion of the Southeast Quarter of the Southeast Quarter of Section 1, Township 3 North, Range 1 West, Boise Meridian, Ada County, Idaho, and more particularly described as follows: BEGINING at the Northwest corner of the Southeast Quarter of the Southeast Quarter of Section 1, a 1/2" long iron bar; thence South 89°52' East 328.84 feet to a 1/2" diameter x 24" long iron bar, thence South 0°34' East 1,074.55 feet to a 1/2" diameterx 24" long iron bar, the true point of beginning; thence South 89°58' East 75.14 feet to a point; thence South 0°33' West 135:OOfeet to a point of the North right-of-way line of Cherry Lane; thence South 89°58' East along said right-of-way line, 254 feet, more or less to a 1/2" diameter x 24".iron bar; thence. North 0°27' West 225.00 feet to a 1/2" diamteter x 24" iron bar; thence North 89°58' West 326.64 feet, more or less, to the true point of beginning. EXCEPT the following: A tract of land situate in a portion of the Southeast Quarter of the:Southeast Quarter of Section 1, Township 3 North, Range 1 West, Boise Meridian, Ada County, Idaho, and more particularly described as follows: BEGINNING at the Northeast corner of the Southeast Quarter of the Southeast Quarter of Section 1, a 112" diameter iron bar; thence South 89°52' East 328.84 feet to a 1/2" diameter x 24" long iron bar; thence South 0°34' East 1,074.55 feet tp a 1/2" diameter x 24" long iron bar, the TRUE POINT OF BEGINNING; thence South 0°34' East 90.00 feet to a 1/2" diameter iron bar; thence WEST ONE ORDINANCE PAGE 1 340 South 89°58' East 75.14 feet to a point; thence North 0°33' East 90.00 feet to a point;. thence North 89°58' West 76.90 feet to the POINT OF BEGINNING; And also EXCEPTING the parcel deeded #o Ada County. Highway District recorded March 29, 1977, as Instrument No. 7713159. be and the same is hereby rezoned from R-8 Residential to L-O, Limited Office, and Section 11-2-425, Official Zoning Maps is hereby amended to reflect the same. This. rezoning is subject to the conditions referenced in the Findings of .Fact and Conclusions. of Law as adopted by the Meridian City Council on the request for rezone. Section 2. The Applicant shall the all ditches, canals and waterways and install pressurized irrigation. Section 3. That if the Applicant shall fail. to meet the above conditions the property shall be subject to rezone back to R-8. Section 4. EFFECTIVE DATE:. There being an emergency, which emergency is hereby declared to exist, this Ordinance shall be in full force and effect from and after its passage and approval as required by law.
