Final Plat: Portico Place Staff Recommendation: Approval; the final plat substantially complies with approved PP. Outstanding Issues before Council: Applicant Provided Written Agreement with Conditions: Yes; applicant suggests a minor change to one of the conditions. Staff is in agreement with that change. Project: Anytime Fitness Location: Northeast corner of Meridian Road and Ustick Road; currently zoned L-O. Application: City Council Review (appeal) of a conditional use permit Highlights of Proposed Development: Conditional Use Permit (CUP) approval to allow a 24- hour fitness center within a 4,750 square foot single story building. The .91-acre site is zoned L-O and located on Lot 10 of the Sundance Subdivision No. 5. Other: At the August 2, 2007 Planning and Zoning Commission meeting, the Commission approved the findings for Anytime Fitness conditional use permit. At that hearing, the Commission required a condition limiting business operation on this site between the hours of 5:00 a.m. and 11:00 p.m. Due to the limitations of this condition, the applicant, Dave Evans Construction, has filed a Council Review (appeal) to remove this condition of approval.
