' AN ORDINANCE OF THE CITY OF MERIDIAN ANNEXING AND ZONING CERTAIN
REAL PROPERTY- WHICH IS DESCRIBED~AS A PORTION OF SECTION 1,
TOWNSHIP 3 NORTH, RANGE 1 EAST, BOISE-MERIDIAN; ADA COUNTY, IDAHO;

NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council
of the City of Meridian; Ada County-; Idahoe °-~ ~ '
Section 1: That the above and referenced real property
described as:
Commencing at- a point on the East 1 ine of Section 1, T. 3N, R.
iW., B.M., Ada County, Idaho, said point being S. 00°16'23" W.
1310.89 feet from the Northeast Corner of said section and
being the POINT OF BEGINNING;
- thence N. 89°28`05" W. 1,732.50 feet to a point,
thence S. 00°16'23" W. 650.10 feet to a point,
thence S. 89°28'05" E. 1,732.50 feet to a point,
thence N. 00°16'23" E. 650.10 to the POINT OF BEGINNING.
is hereby annexed to the City of Meridian, and shall be zoned R-4
Residential; that the reason for the R-4 zoning is to allow 41
single family dwelling units to be constructed on the parcel which
would be a density of 2.98 dwelling units per acre, which would be
allowed in the R-4 Residential zone; that only single family
dwellings shall be built containing at least 1,700.00 square feet;
that the annexation and zoning is subject to the conditions
referenced in the Findings of Fact and Conclusions of Law as
adopted by the Meridian Council on the request for annexation and
zoning.

section 2. That the property shall be subject to de-
annexation if the owner shall not plat the property as submitted by
Applicant, designate on the plat that only single-family dwellings
shall be allowed with at least 1,700.00 square feet. The property
shall also be subject to de-annexation if the owner allows to be
constructed any duplexes, does not construct water and sewer line
extensions to serve the property with fire hydrants as designated
by the city water department, does not construct streets to and
within the property, does not meet the requirements and conditions `
of the Findings of Fact and Conclusions of Law and of this
Ordi nance.; i f Appl i cant fai 1 s to meet these conditions the property '
shall be subject to de-annexation, which conditions shall run with
land and also be personal to the owner.
Section 3. That the City Clerk shall cause one (1) copy of
the legal description, and map, which shall plainly and clearly
designate the boundaries of said property, to be filed with the Ada
County Recorder, Ada County Assessor, and the State Tax Commission
within ten (10) days following the effective date of this
Ordinance.
Section 4. EFFECTIVE DATE: There being an emergency, which

force and effect from and after its passage and approval as
required by law.
PASSED by the City Council and approved by the Mayor of the
City of Meridian, Ada County, Idaho, this 17th day of August, 1993.

REAL PROPERTY WHICH IS DESCRIBED AS A PORTION OF SECTION 1,

WHEREAS, the City Council and the Mayor of the City of
