HomeMy WebLinkAbout606 Conifer Subdivision AZ19' 3 ORDINANCE NO. 6~6 AN ORDINANCE OF THE CITY OF MERIDIAN ANNEXING AND ZONING CERTAIN REAL PROPERTY WHICH IS DESCRIBED AS A PORTION OF THE NE 1/4, SE 1 / 4, SECTION 1 1', T. 3 N. , R.. 1 W. , MERIDIAN, ADA COUNTY, I DAHO; AND PROVIDING AN EFFECT I'VE DATE.. - WHEREAS, 'the City Council and the Mayor of the City of Meridian, Idaho have concluded that it is in the best interest of said City to annex to the said City real property which is hereinbelow descr^i bed: Part of the NE 1 /4 SE 1 /4, -Section 1 1, T. 3N. , R. 1 W. , B.M. , more particularly described as follows: Peginning at a point-on the 1/2 section line of Section 11, T. 3N., R. 1W., B.M., 686.12 feet wester^ly from the 1/4 section corner of the east line of Section it od said township and range; Thence westerly on the half section line 222.25 feet; ' -Thence south 978.46 feet to a point on the north right of way line of the Oregon Short Line Railroad; Thence easterly along said north right of way line 222.25 feet; - Thence northerly 981.21 feet, more or less, to the point of beginning. NOW, THEREFORE, BE IT ORDAINED by the Mayor- and City Council of the City of Meridian., Ada County, Idaho: Section 1. That the above and referenced real property described as: - Part of the NE 1 /4 SE 1 /4 , Section 1 1, T. 3N. , R 1 W. , B. M. , - more particularly described as follow: Peginning at a point on the 1/2 section line of Section 11, T. 3N., R. iW., B.M., 686.12 feet westerly from the 1/4 section corner of the east line of Section 11 of said township and range; Thence westerly on the half section line 222.25 feet; Thence south 978.46 feet to a point on the north right of way line of the Oregon Short Line Railroad; 194 Thence easterly•along said north right of way line 222.25 feet; Thence northerly 981.21 feet, m-ore or less, to the point of beginning. _ _ is hereby annexed to the City. of Meridian, and, is zoned R-8 Residential; that the reason foi^ the R-,B zoning is to allow 23 single family dwelling units for manufactured homes on the parcell which would be an approximate density•of 4.87 dwelling units per acre, which would be allowed in -the R-8 Residential zone; that the property shall be subject to resign review; that the. annexation and zoning is subject to the conditions ref et°enced in the Findings of Fact and Conclusions of Law as adopted by the Meridian ,Council on the request for annexation and zoning; that the manufactures houses shall be at least 135® square feet in size as agreed to; that all ditches, canals and waterways shall be tiled including those that--ar-e property boundaries or only partially located on the proper^t y. Section 2. That the property shall. be subject to de- annexation if the owner shall not plat the property as submitted by Applicant and designate on the plat that. only single-family dwellings shall be allowed, construct water and sewer line extensions to serve' the property, and construct streets to and within the property,- meet the •requirements and conditions of the Findings of Fact and Conclusions of Law and of this Ordinance; allow only houses of at least 1351 squat^e feet; if Applicant fails to meet these conditions the property shall be subject to' de-annexation, which conditions subsequent shall run with land and also be personal to the owner. , Section 3. That the City Clerk shall cause one (1) copy of the legal description, and map, which shall•plainly and clearly designate the boundaries of said property, to be filed with the Ada County Recorder, Ada County Assessor, and the State Tax - Commission within ten (10) days following the effective date of this Or^dinance. . Section 4. EFFECTIVE DATE. There being an emergency, which emergency is hereby declared to exist, this Ordinance shall be in full force and effect from and after its passage and approval as required by law.
