19.x_ ORDINANCE NO. 605 3 AN ORDINANCE OF THE CITY OF MERIDIAN ANNEXING AND ZONING CERTAIN REAL PROPERTY WHICH IS DESCRIBED AS A PORTION OF THE N 1/2 SE 1 /4, SECTION 3, T. 3N. , R 1 W. , B. M. , ADA COUNTY, I DAHO; AND F~ROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council and the Mayor of the City of Meridian,. Idaho, have concluded that it is in the best interest of said City to annex to the said City real property which is hereinbelow described: A parcel of land lying in the SE.1/4 of Section 3, T. 3N., R. 1W., B.M., Ada County, Idaho, being more particularly described as follows: Beginning at the Southeast corner of said SE 1/4 of Section 3: thence North 0°19'11" East 1,568.01 feet along the Easterly boundary of said SE 1/4 of Section 3, which is also the centerline of Ten Mile Road, to the REAL POINT OF BEGINNING; thence North 89°40'49" West 487.61 feet to a point on the centerline of the Rutledge Lateral; _ thence South 71°15'16" East 63.15 feet along said centerline of the Rutledge Lateral to a point; thence South 70°35'59". East 357.24 feet along said centerline of the .Rutledge Lateral to a point of curve; thence Southeaster^ly along said centerline of the Rutledge Lateral along a curve to the left 18.41 feet, also said .:.curve having. a central angle of 08°18'20", a radius of 127.0 feet, tangents of 9.22 feet and a long_ chord of 18.39 feet bearing South 74°45'01" East to a point of tangent; thence South 78.°54'11" East 73.61 feet along said centerline of the Rutledge Lateral to a~~point on the East line of said SE 1/4 of Section 3; thence North 0°19' 11" East 155.26 feet along the Easter^ly boundary of the said SE 1/4 of Section 3, which is also the centerline of Ten Mile Road, to the REAL POINT OF BEGINNING, ,comprising 0.,92 acres, more or less. NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of Meridian, Ada County, Idaho: 191 Section 1: That the above and referenced real property described as: A parcel of land lying in the SE 1/4 of Section 3, T..3N., R iW., B.M., Ada County, Idaho, being more particularly described as follows: Peginning at the Southeast corner of said SE i/4 of Section 3; thence North 0°19'11" East 1,568.01 feet along the Easterly boundary of said SE 1/4 of Section 3, .which is also the centerline of Ten Mile Road, to the REAL POINT OF BEGINNING; thence North B9°40'49" West 487.61 feet to a point on the centerline of the Rutledge Lateral; thence South 71°15'16" East 63.15 feet along said centerline of the Rutledge Lateral to a point; thence South 70°35'51" East 357.24 feet along said centerline of the Rutledge Lateral to a point of curve; thence Southeasterly along said centerline of the Rutledge Lateral along a curve to the left 18.41 feet, also said curve having a central angle of 08°18'20", a radius of 127.00 feet, tangents of 9.22 feet and a long chord of 18.39 feet bearing South 74°45'01" East to a point of tangent; thence South 78°54'11" East 73.61 feet along said centerline - of the Rutledge Lateral to a point on the East line of said SE 1/4 of~Section 3; thence North 0°19'11" East 155.26 feet along the Easterly boundary of the said SE 1/4 of Section 3, which is also the centerline of Ten Mile Road, to the REAL POINT. OF BEGINNING, comprising 0.92 acres, more or less. is hereby annexed to the City of Meridian, and is zoned R-4 Residential; that the reason for the R-4 zoning is to allow single family dwelling units to be constructed on the parcel which shall be constructed at a density of 3.3 dwelling units per acre, which would be allowed in the R-4 Residential zone; that the annexation and zoning is subject to the conditions referenced in the Findings of Fact and Conclusions of Law as adopted by the Meridian Council; that all ditches, canals and waterways shall be tiled including those that are property boundaries or only partially located on the property. 192 Section 2. That the property shall be subject to de- annexation if the owner shall not plat the Pt^operty as submitted by Applicant and designate on the plat that only single-family dwellings shall be allowed, not to exceed the 3.3 dwelling units per acre, construct water and sewer line extensions to serve the property, and construct streets to and within the property, meet the requirements and conditions of the Findings of Fact and Conclusions of Law and of this Ordinance; if Applicant fails to meet these conditions the property shall be subject to de- annexation, which conditions subsequent shall run with land and also be personal to the owner. Section 3. That the City Clerk shall cause one tl) copy of the legal description, and map, which shall ;plainly and clearly designate the boundaries of said property, to be filed with the Ada County Recorder,. Ada County Assessor, and the State Tax Commission within ten t10) days following the effective date of this Ordinance. Section 4. EFFECTIVE DATE. There being an emergency, which emergency is hereby declared to exist, this Ordinance shall be in full force and effect fi^om and after its passage and approval as t^equired by law.
