187, ORDINANCE NO. 603 AN ORDINANCE OF THE CITY OF MERIDIAN ANNEXING AND ZONING CERTAIN REAL PROPERTY WHICH IS DESCRIBED AS A PORTION OF THE SOUTH 1/2 OF THE NORTHEAST 1/4 OF THE SOUTHWEST 1/4, SECTION 5, TOWNSHIP 3 NORTH, RANGE LEAST, BOISE-MERIDIAN, ADA COUNTY, IDAHO; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City. Council and the Mayor of the City of Meridian, Idaho, have concluded that it is in the best interest of the City to annex to the said City real property which is herein-below described: A parcel of land being situated in a portion of the S 1/2 of the NE 1 /4 of the SW 1 /4 of Section 5, T. 3N. , R. lE. , B. Section 2. That the property shall be subject to de- annexation if the owner shall not plat the pr^operty as submitted by Applicant, designate on the plat that only single-family dwellings shall be allowed with at least 1,30 square feet. The property shall also be subject to de-annexation if the owner allows to be constructed any duplexes, does not construct water and sewer line extensions to serve the property, does not construct streets to and within the property, does not meet the requirements and conditions of the Findings of Fact and Conclusions of Law and of this Or^dinance; if Applicant fails to aeet these conditions the pr^operty shall be subject to de- annexation, which conditions subsequent shall run with land and also be personal to the owner. Section 3. That the Ada County Highway District (ACRD) has suggested that Dixie Lane be improved to ACRD standards and the City Council suggested that the phase of subdivision development in which Dixie Lane is situated shall not be approved until the Dixie Lane issue is resolved; that the portion of land and development in which.Dixie Lane is located shall be subject to subdivision denial and to de-annexation unless the Dixie Lane issue is resolved prior to final plat to the satisfaction of the City and ACRD and this resolution shall be a condition of annexation. Section 4. That the City Clerk shall cause-one (1) copy of the legal description, and map, which shall plainly and clearly designate the boundaries of said property, to be filed with the Ada County Recor^der, Ada County Assessor, and the State Tax Commission within ten (1~) days following the effective date of this Or^dinance. Section 5.
