88 ORDINANCE N0. 585 AN ORDINANCE REAL PROPERTY THE NE 1 /4, MERIDIAN, ADA WHEREAS, Meridian, I dal OF THE CITY OF MERIDIAN WHICH IS DESCRIBED AS SECTION 7, TOWNSHIP 3 COUNTY, IDAHO; AND PROV the City Council and io, have concluded that ANNEXING AND ZONING CERTAIN A PORTION OF THE NW 1/4 OF NORTH., RANGE 1 EAST, BOISE IDING AN EFFECTIVE DATE. the Mayor of the City of it is in the best interest of said City to annex to the said City real property which is hereinbelow described: Commencing at a point 33® feet East of the NW corner of the NW 1/4 of the NE 1/4 of Section 7, in Township 3 North, Range 1 East of the Boise Meridian, in Ada County, Idaho, the real place of beginning; thence East 588 feet along the North line of said section to a point; thence South 660 feet, more or less, to the South line of the N 1/2 of the NW i/4 of the NE 1/4 of said section; thence West along said line, 588 feet to a point; thence North 660 feet, more or less, to the real place of beginning; excepting therefrom the following described tract of land, to-wit: Commencing at a point on the North line of the NW 1/4 of the NE 1/4 of said Section 7, Township 3 North, Range 1 East of the Boise Meridian, in Ada County, Idaho, 918 feet East of the NW corner thereof, the real point of beginning; thence South at right angles 170 feet, and parallel with the East line of said NW 1/4 of the NE 1/4 of said Section 7; thence at right angles, and parallel with the North line of Section 7, West a distance of 85 feet; thence North and parallel with the East line of the NW 1/4 of the NE 1/4 of said Section 7, 170 feet to the North line of said Section 7; thence in an Easterly direction on said North line to the real point of beginning. AND all that rectangular parcel of land lying adjacent to the above parcel and which is south of the center line of the _ ' road right of way of Fairview Avenue. NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of Meridian, Ada County, Idaho: Section 1. That the above referenced real property described as: 8 9- Commencing at a point 330 feet East of the NW corner of the NW 1/4 of the NE 1/4 of Section 7, in Township 3 North, Range 1 East of the Boise Meridian, in Ada County, Idaho, the real place of beginning; thence East 588 feet along the North line of said section to a point; thence South 660 feet, more or less, to the South line of the N 1/2 of the NW 1/4 of the NE 1/4 of said section; thence West along said line, 588 feet to a point; thence North 660 feet, more or less, to the real place of beginning; excepting therefrom the following described tract of land, to wit: Commencing at a point on the North line of the NW 1/4 of the NE 1/4 of said Section 7, Township 3 North, Range 1 East of the Boise Meridian, in Ada County, Idaho, 918 feet East of the NW corner thereof, the real point of beginning; thence South at right angles 170 feet, and parallel with the East line of said NW 1/4 of the NE 1/4 of said Section 7; thence at right angles, and parallel with the North line of Section 7, West a distance of 85 feet; thence North and parallel with the East line of the NW 1/4 of the NE 1/4 of said Section 7, 170 feet to the North line of said Section 7; thence in an easterly direction on said North line to the real point of beginning. AND all that rectangular parcel of land lying adjacent to the above parcel and which is south of the center line of the road right of way of Fairview Avenue. is hereby annexed to the City of Meridian, and shall be zoned (C- G) General Retail and Service Commercial; that the reason for the (C-G) zoning is to allow the property to be used commercially, which would-be allowed in the (C-G) Commercial zone; that the property shall be subject to site planning review and an appropriate buffer shall be made from adjacent residential property; that the annexation and zoning is subject to the conditions referenced in the Findings of Fact and Conclusions of Law as adopted by the Meridian Council on the request for annexation and zoning. Section 2. That the property shall be subject to de- 9~0 de-annexation if the owner or his assigns, heirs, or successors shall not meet the conditions contained in the Findings of Fact and Conclusions of Law, those stated herein, and the Ordinances of the City of Meridian. Section 3. That the City Clerk shall cause one ti) copy of the legal description, anal map, which shall plainly and clearly designate the boundaries of said property, to be filed with the Ada County Recorder, Ada County Assessor, and the State Tax Commission within ten ti0) days following the effective date of this Ordinance. Section 4. EFFECTIVE DATE: There being an emergency, which emergency is hereby declared to exist, this Ordinance shall be in full force and effect from and after its passage and approval as required by law.
