ORDINANCE N0. 579
AN ORDINANCE OF THE CITY OF MERIDIAN, IDAHO, CONFIRMING THE
ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO. 90-1 EAST FIRST
STREET RECONSTRUCTION PROJECT, LEVYING ASSESSMENTS AGAINST THE
SEVERAL LDTS AND PARCELS OF LAND AS SHOWN ON THE ASSESSMENT ROLL,
PROVIDING FOR THE PAYMENT OF ASSESSMENTS IN INSTALLMENTS, FIXING
INTEREST AND PENALTIES, AND PROVIDING FOR THE PAYMENT OF SUCH
ASSESSMENTS, INTEREST AND PENALTIES INTO LOCAL IMPROVEMENT
DISTRICT NO. 90-1; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS., in accordance with the provisions of Idaho Code 50-
1712., th°e appointed Engineer for Local Improvement. District No.
90-1 prepared a report showing in detail the total cost and
expenses of the improvements therein and the amounts payable from
assessments and from other sources, and containing a form of
assessment roll; and
WHEREAS, the assessment roll as prepared by the Engineer was
filed with the City Clerk and a date for a hearing on the
assessment roll was fixed; and
WHEREAS, notice of such hearing was published and mailed to
the owners of property in Local Improvement District No. 90-1 at
the times and in the manner required by law; and
WHEREAS, at said hearing the City Council considered all
objections to the assessment roll and all evidence presented;
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of
the City of Meridian, Ada County, Idaho, as follows:
Section 1. The Engineer's report of the total cost and
expense of the improvements in Local Improvement District No. 90-
1 is hereby approved and the aggregate amount of such cost and
expenses is hereby confirmed as X191, 932.31. ~S, 600.00 of such
amount shall be paid by the Meridian City Tree Grant Contribution
and the balance of such amount, $186,332.31, shall be paid by the
levy of assessments on benefited property. Each lot and parcel
of land appearing on the final assessment roll for Local
Improvement District No. 90-1 as approved by the ordinance is
hereby. found to be specially benefited by the improvements
constructed in Local Improvement District No. 90-1 in at least
the amount of the assessment charged against such property. The
assessments against each lot or parcel are further found to be in
proper proportion to the total assessment appearing upon the
assessment roll.

Section 2. Except to the extent reflected in the final
assessment roll confirmed by this ordinance, all protests against
the assessment roll in Local Improvement District No. 90-1 are
overruled and disallowed. The final assessment roll for Local
Improvement District No. 90-1 are overruled and disallowed. The
final assessment roll for Local Improvement District No. 90-1 is
hereby approved and the certificate attached thereto evidencing
such approval shall be executed by the Meridian City Clerk. The
total amount of the final assessment roll for Local Improvement
District No. 90-1 as hereby confirmed is $186,332.31. There is
hereby levied and assessed against each such lot and parcel of
land the amount appearing on the final assessment roll.
Section 3. Each assessment or any portion thereof may be
paid at any time within 30-days from the date of adoption and
publication of this ordinance without penalty, interest or costs.
Any property owner whose assessment has not been paid in full
within 30-days of the adoption and publication of this ordinance
shall be conclusively presumed to have chosen to pay such
assessment in installments. Assessments paid in installments
shall be payable in ten (10) annual installments. On June 1,
1993, and annually thereafter, one of the installments shall
become due and shall be collected as provided by law. Annual
installments may be prepaid in the manner provided by law.
Section 4. Assessments paid in installments shall bear
interest on the whole unpaid sum from the date of adoption and
publication of this ordinance. The rate of interest such
installments shall bear ~is hereby fixed as the rate of 6.4
percent (6.4X) interest for Local Improvement District No. 90-1.
Section 5. Immediately upon the publication of this
ordinance, the Treasurer of the City of Meridian shall file with
the County Recorder a notice which shall contain the adoption and
publication of this ordinance and a description of the boundaries
of the District, and the assessment herein. confirmed shall
thereafter be a lien upon the property assessed.
Section 6. Immediately upon publication of this ordinance,
the Treasurer of the City of Meridian shall further mail a
postcard or letter to each property owner assessed at his post
office address, if known; or if unknown, to the County post
office, in substantially the following form:

RECONSTRUCTION
MERIDIAN, IDAHO
Notice is hereby given that the assessment roll for the
improvement of property located within Local Improvement District
No. 90-1, for the construction and installation of street
improvements has been confirmed. The property and the assessment
with reference to which this notice is given is as follows:

without penalty, interest or costs. If the assessment is not

payable in annual installments with the first

assessments which are paid in installments will be the rate of

2X shall be added thereto. In the event assessments are paid in
full after , 19 , such payment in full
shall include the full principal amount of the unpaid assessment
plus penalties and all interest payable on the same, plus
additional interest thereon, at the rate provided for LID No. 90-
1, from the date of the last installment due to one year after
the next interest date.

An affidavit of mailing the foregoing notice shall be filed
in the office of the Treasurer in the file of LID No. 90-1.

Section 7. Assessment payments. received not more than 30
days after the adoption and publication of this ordinance shall
be utilized to pay the costs and expenses of the improvements in
Local Improvement District No. 90-1. Assessment payments,
including interest, and penalties thereon, received more than 30-
days after the adoption and publication of this ordinance as
installment payments shall be deposited in a bank account by the
City of Meridian with separate accounting to identify the
payments made as part of the "Local Improvement District No. 90-
1", hereby created.
Section 8. The confirmation of the final assessment roll
for Local Improvement District No. 90-1 as provided in this
ordinance is a final determination of the regularity, validity
and correctness of the assessment roll and of each appeal as
provided in Section 50-1718, Idaho Code. Appeal may be made by
filing within 30-days from the date of adoption and publication
of this ordinance written notice of appeal with the Meridian City
Clerk and with the Clerk of the District Court of Ada County,
describing the property and objections of the appellant and
otherwise complying with the provisions of Section 50-1718, Idaho
Code. After said 30-day appeal period has run, no one shall have
any cause or right of action to contest the legality, formality
or regularity of any assessment.
Section 9. If any provision of this ordinance or any
assessment shall be held to be invalid or unenforceable for any
reason, the invalidity or unenforceability of such provision or
assessment shall not affect any remaining portion of this
ordinance or other assessment. The partial invalidity of any
assessment shall not prevent such assessment from being valid and
enforceable to the extent permitted by law..
Section 10. EFFECTIVE DATE. Whereas there is an emergency,
therefor, which emergency is hereby declared to exist, this
ordinance shall be in full force and effect from and after it's
passage, approval and publication according to law.

STREET RECONSTRUCTION PROJECT, LEVYING ASSESSMENTS AGAINST THE
SEVERAL LOTS AND PARCELS OF LAND AS SHOWN ON THE ASSESSMENT
ROLL, PROVIDING FOR THE PAYMENT OF ASSESSMENTS IN INSTALLMENTS,
FIXING INTEREST AND PENALTIES, AND PROVIDING FOR THE PAYMENT
OF SUCH ASSESSMENTS, INTEREST AND PENALTIES INTO LOCAL
IMPROVEMENT DISTRICT NO. 90-1; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, in accordance with the provisions of Idaho Code 50-1712, the
appointed Engineer for Local Improvement District No. 90-1 prepared a report showing
in detail the total cost and expenses of the improvements therein and the amounts
Payable from assessments and from other sources, and containing a form of assessment
roll; and
WHEREAS, the assessment roll as prepared by the Engineer was filed with the
City Clerk and a date for a hearing on the assessment roll was fixed, and
WHEREAS, notice of such hearing was published and mailed to the owners of
property in Local Improvement District No. 90-1 at the times and in the manner
required by law, and
WHEREAS, at said hearing the City Council considered all objections to the
assessment roll and all evidence presented;
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the City
of Meridian, Ada County, Idaho, as follows:
Secti= The Engineer's report of the total cost and expense of the
improvements in Local Improvement District No. 90-1 is hereby approved and the
aggregate amount of such cost and expenses is hereby confirmed as $191,932.31
$5,600.00 of such amount shall be paid by the Meridian City Tree Grant Contribution
and the balance of such amount, $186,332.31 , shall be paid by the levy of assessments
on benefited property. Each lot and parcel of land appearing on the final assessment
roll for Local Improvement District No. 90-1 as approved by the ordinance is hereby
found to be specially benefited by the improvements constructed in Local Improvement
District No. 90-1 in at least the amount of the assessment charged against such property.
The assessments against each lot or parcel are further found to be in proper proportion
to the total assessment appearing upon the assessment roll.
Sect— ion 2. Except to the extent reflected in the final assessment roll confirmed
by this ordinance, all protests against the assessment roll in Local Improvement District
No. 90-1 are overruled and disallowed. The final assessment roll for Local Improvement
District No. 90-1 is hereby approved and the certificate attached thereto evidencing such
approval shall be executed by the Meridian City Clerk. The total amount of the final
assessment roll for Local Improvement District No. 90-1 as hereby confirmed is
$186,332.31. There is hereby levied and assessed against each such lot and parcel
land the amount appearing on the final assessment roll.

the City of Meridian shall file with the County Recorder a notice which shall contain
the adoption and publication of this ordinance and a description of the boundaries of
the District, and the assessment herein confirmed shall thereafter be a lien upon the
property assessed.
Section 6 Immediately P upon publication of this ordinance, P the Treasurer of the
City of Meridian shall further mail a postcard or letter to each property owner assessed
at his post office address, if known; or if unknown, to the County post office, in
substantially the following form:

Notice is hereby given that the assessment roll for the improvement of property
located within Local Improvement District No. 90-1, for the construction and installation
of street improvements has been confirmed. The property and the assessment with
reference to which this notice is given is as follows:

Treasurer in the file of LID No. 90-1.
Section 7. Assessment payments received not more tha-�30-days after the adoption
and publication of this ordinance shall be utilized to pay the costs and expenses of the
improvements in Local Improvement District No. 90-1. Assessment payments, including
interest, and penalties thereon, received more than 30-days after the adoption and
publication of this ordinance as installment payments shall be deposited in a bank
account by the City of Meridian with separate accounting to identify the payments made
as part of the "Local Improvement District No. 90-1" , hereby created.
Section 8. The confirmation of the final assessment roll for Local Improvement
District No. 90-1 as provided in this ordinance is a final determination of the regularity,
validity and correctness of the assessment roll and of each appeal as provided in Section
50-1718 , Idaho Code. Appeal may be made by filing within 30-days from the date of
adoption and publication of this ordinance written notice of appeal with the Meridian
City Clerk and with the Clerk of the District Court of Ada County, describing the
property and objections of the appellant and otherwise complying with the provisions of
Section 50-1718, Idaho Code. After said 30-day appeal period has run, no one shall
have any cause or riglit of action to contest the legality, formality or regularity of any
assessment.
Section 9. If any provision of this ordinance or any assessment shall be held to
be invalid or unenforceable for any reason, the invalidity or unenforceability of such
provision or assessment shall not affect any remaining portion of this ordinance or other
assessment. The partial invalidity of any assessment shall not prevent such assessment
from being valid and enforceable to the extent permitted by law.
Section 10. EFFECTIVE DATE. Whereas there is an emergency, therefor, which
emergency is hereby declared to exist, this ordinance shall be in full force and effect
from and after it's passage, approval and publication according to law.
