CITY OF MERIDIAN NOTICE OF HEARING NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian and the Laws of the State of Idaho, that the Meridian City Council of the City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho Avenue, Meridian, Idaho, at the hour of 7:00 p.m. on Tuesday, July 24, 2007, for the purpose of reviewing and considering the application RZ 07-006 of J.E. Development, LLC for a Rezone of 4.38 acres from an R-8 to an R-15 zone for Bellabrook: Furthermore, the applicant requests the application CUP 07-005 for a Conditional Use Permit approval for multi-family residential use in a proposed R-15 zone for Bellabrook located 300 S. Locust Grove Road. A more particular description of the above property is on file in the Planning Department, 660 E. Watertower Lane Suite 202, and is available for inspection during regular business hours, Monday through Friday, from 8:00 a.m. to 5:00 p.m. You may contact the Planning Department at (20~) 884-5533 during regular business hours. A copy of the application is available to review upon request. Any and all interested persons shall be heard at said public hearing, and the public is welcome and invited to submit testimony. Oral testimony may be limited to three (3) minutes per person. Written materials should be submitted to the City Clerk's Office at 33 E. Idaho Avenue, Meridian, Idaho 83642, (208) 888-4433 or fax (208) 888-4218 no later than seven (7) days prior to the above hearing date so that all interested parties may examine them prior to the hearing. Watertower Lane, Suite 202 Meridian, ill 83642 RE: Bellabrook Multi-family/CUP07-005 RECEIVED JUl 2 3 2007 City Of Meridian City Clerk Office Dear Anna, It has come to my attention that the proposed Bellabrook staff report was not updated from the original subdivision configuration to reflect the current conditional use application. The information below is pertinent to the 2007 application. . The trip generation for the current proposal is 238 vehicle trips per day. The original single family subdivision was estimated to generate 200 vehicle trips per day. . Locust Grove Road was widened in 2005 to a 5-lane roadway. On 9-14-2005 there was a traffic count of 1,796 daily vehicle trips, indicating a Level of Service better than "C". A Level of Service "D" for a 5 lane minor arterial is 33,000 daily vehicle trips, and 35,000 daily vehicle trips for a Level of Service "E". . The offset between the proposed private street entrance for the project and the 50-foot wide flag lot to the south is 290-feet. This offset meets District policy. (As noted in public testimony, several of the access points on this segment of Locust Grove Road were established based on right-of-way negotiations and put in place to avoid lengthy and costly condemnation proceedings.) . Conditions of approval as listed in the 2006 Bellabrook Subdivision staff report remain the same with respect to Locust Grove Road. Because the applicant is now proposing private streets, and this is not a subdivision application, conditions related to street widths and locations are not applicable. With a gross density of nearly 8 units per acre, the project would meet "transit ready development" criteria. It lies just 114 mile distance to Franklin, a corridor identified by Valley Regional Transit as a high service level transit corridor in its Regional Operations Capital Improvement Plan. It is also less than l/2 mile from the rail corridor now being evaluated for future commuter rail service. Access onto locust Grove presents an issue, especially when the pending completion of the overpass will certainly add traffic to this street. I understand the developer agreed to a joint access that would provide for the adjacent parcels to develop without creating yet another intersection. This is an excellent strategy to preserve arterial capaci~y~ The extensive and usable open space and connection to a possible pathway along Five Mile creek are desirable features. The building designs appear to be compatible with surrounding residential uses, with pitched roofs and massing that emulates typ.ical single family homes in the area. The Communities in Motion plan approved by the COMPASS Board in August 2006 emphasized more compact development, a diversity of housing types, and increasing the amount of development near services and transit routes. Bellabrook Villas appears to support these objectives, allowing for growth without consuming farmland. At one point in time Meridian was. somewhat of a rural. area~ I understand the City is-growing at a very fast pace and that the land around be.will probably develop in the near future. My 'neigh-bars to the south have the_ir property for sale and it wHllikely develop as a commerci'al devetopment. My land is about 1 acre in size and will probably deve-lop the same. way .some day. Bollman 81., which is the "Woodgate" section of the neighborhood and is closest to the Bellabrook Villas Condominiwn project. We wanted to take an opportunity to comment on the development which is planned adjacent to us. Weare pleased to see the amount of effort that the developer has put into planning mid design for this project. The buildings look great and should be used as an example for other multi-family/condominium projects in the City. Ross Erickson met with us while they were designing the project to explain their plans and get feedback. We really like the end product and appreciated the opportunity to be able to provide input that was actually incorporated into the design. When we first heard that the property was going to be developed we were concerned that it may be offices or commercial buildings, or even a gas station. Usable open space in the form of pedestrian walks and a gathering courtyard will create a centralized community amenity with a connection linking the project to the fuill;re Five Mile Creek regional pathway conidor~ The gathering area will include seating, shade trees, and community artwork. Additional common area includes a buffer along Locust Grove Road and landscaping of the eastern. strip leading to the Five Mile Creek area. Staff supports the revisions made to the proposed site plan as they are consistent with the provisions of the UDC and the Comprehensive Plan. Staff spoke with Joe Silva, Meridian Fire Department, regarding the new stub street shown on the site plan and he is supportive of the extension of E. Kalispell Drive to the east as shown. If the Council decides to move fOI"\Vard with a decision of approval on this application, a condition should be included for the Applicant to record a cross-access easement agreement with the property owner to the east prior to application submittal for Certificate of Zoning Compliance for any structures within this development 111.
