This matter coming before the City Council for Final Plat approval
pursuant to Meridian City Code § 12-3-7 on July 3, 2001, and the Council finding
that the Administrative Review is complete which has included certain comments and
conditions as stated in a letter to the Mayor and Council from Bruce Frecldeton,
Engineering Technician III, and David McKinnon, City Planner, listing 18 Site
Specific Comments, listing 7 General Comments and 7 Site Specific Comments-
Planning & Zoning, which are herein found fair and reasonable, and at the July 3,
2001 meeting, Shad Stiles, Planning and Zoning Administrator, commented at the
hearing, and no one appeared in opposition, and the Council having considered the
requirements of the preliminary plat the Council talces the following action:

IT IS HEREBY ORDERED THAT:

of Staff comments as set forth in the Memorandum to the Mayor and City Council

Comments and 7 Site Specific Comments-Planning & Zoning, a true and correct
copy is attached hereto marked Exhibit "A", and consisting of four pages, and by this
reference incorporated herein, with the additional requirements from the City
Council meeting held Tuesday, July 3,2001; as follows, to-wit:
1.1 The Council requires that the Final Plat include a note so that
the future buyer of Lot 5, Block 2 be warned that this lot is
located next to City well #14, and which well is equipped with a
large outdoor generator; and that the generator is used during
power outages and is operated at least weekly for one-half hour
periods of time.

1.2 Fire Chief, Kenny Bowers, requires no parking of vehides, trailers
or equipment in the cul-de-sac.
2. The final plat upon which there is contained the Certification and
signature of the City Clerk and the City Engineer verifying that the plat meets the
City's requirements shall be signed only at such time as:
1. The Plat dimensions are approved by the City Engineer; and
2. The City Engineer has verified that all off-site improvements are
completed and/or the appropriate letter of credit or cash has been
issued guaranteeing the completion of off-site and required on-
site improvements.

We have reviewed this submittal and offer the following comments, as conditions of the
application. These conditions shall be considered in full, unless expressly modified or deleted
by motion of the Meridian City Council:
APPLICATION SUMbiARY
This application proposes to create 13 single-family residential lots and 3 landscape/common lots
at a gross density of 2.03 dwelling units per acre. This plat would be the fuml phase of the
Meridian Or.ns Subdivision (them ar~ three existing, built-out phases of Meridian Orecns). Tbe
7.88-acre porcel is an infill parcel, surrounded on all four sides by existing development. There is
a new public collector roaa (sE s Way) and a new cul-de-sac proposed within the plat.
LOCATION
The property is generally located on the south side of Overland Road directly across from Western
Equipment, between Meridian Road and Locust Grove Road. It is desisted as Existing Urban in
the 1993 comprehensive plan,

SITE SPECIFIC COMMENTS
Applicant is to meet all terms of the approved preliminary plat.
The engineering plum submitted with the application indicate that this development's
pressurized irrigation system is going to connect tO tho existing systom in Meridian Greens
Unit No. 1, a system owned by the Meridian Greens Homeowners Association. Written

approval of pressurized irrigation agreement between this developer and the Meridian
Greens Homeowners Association is required prior to Gity signatures on the final plat.
Compaction test results must be submiued to the Meridian Building Department for all
building lots receiving engineer~ backfill.
The design of drainage areas .~hall ensure that water is retained only during 25-year storm
events for a period of time not to exceed 24 hours.
Street signs are to be in place, water system shall be approved and activated, pressurized
irrigation system approved and activated, dralnag~ lots constructed, perimeter fencing
installed, and road base approved by the Ada County Highway District prior to applying
for building permits. All development improvements shall be installed and approved prior
tO obvaining certificates of occllpailcy. A let'~r of credit or cash surety in the amount of
110% will be required for all fencing, pathways, landscaping, pressurized irrigation,
sanitary sewer, water, etc., prior to sj~o~mture on the final pla.
Sanitary sewer service to this site shall be via extensions from the existing main line in
S.E. Fifth Way. Subdivision designer to coordinate main sizing and rovting with the
Public Works Department. Sewer manholes are to be provided to keep the sewer lines on
the south and west sides of centerfine.

GENERAL COMMENTS
Any existing irdgafion/dr~insge ditches crossing the property to be included in this proj~,
shall be filed per City Ordinance 11-9-605.M. Pian,~ will need to be approved by the
appropriate irrigafion/draixmge district, or lateral usexs association, with writlen
confirm:~fion of said approval submitted to the Public Works Depaximent.
Ally existing domostic wells and/or septic systems within thin project will have to be
removed from their domestic service per City Ordinance Section 5-7-517. Wells may be
used for non-domestic purposes such as landscape inigation.
Determine tbe seasonal high groundwater elevation, and submit a profile of the subsurface
soil conditions as prepared by a soil scienti~ with street development plans.
5. Provide five-foot-wide sidewalks in accordance with City Ordinance Section 11-9-606.B.
Submit a l~tter from the Ada County Street Name Committee, approving the subdivision
and sueet names. Make any corrections necessary to conform.

SITE SPECI~C COMMENTS - PLANNING & ZONING
The landscaping shall be insUdled as submitted. The 20' landscaping easements located on
Lots 1-5 Block 2 and the 20 landscapi~ easements on Lots 1, 7, and 8 of Block 1 shall be
complet~l prior to the is.~nee of a final occupancy permit for any home within the
subdivision. The landscaped areas ,shall be connected to a common pressurized irrigation
system prior to construction of indivi~hml homes in order to be continuoUSly sprinlded and
mnintnined. U~til such llme that there is a homeowner responm'ble for maintalnln~ each
lot, the common irrigation connection shall be used for spllnkiing the landscaping
easemems.
A detailed fencing plan including the location and types of consU-uction shall be submitted
for review and approval prior to receiving a signature on the final plat. A letter of credit
or cash surety will be required for the improvements prior to si~sture on the final plat.
Fencing shall be in place prior to applying for building permits.
Twenty-four-foot-wide private drives are proposed to access alliots adjacent to the eastern
side of SE 5~ Way. No parking will be allowed at any time along this slreet. The
homeowners association will be responsible for enforcement of this no parking area.
Coordinate with the M~ridien Fire Department and comply with their requirementz for
posting or otherwise marking the area es ~no parking".
Add the following to Note 4: Building setbacks from the right-of-way of SE $~' Way shall
be a minimum of 25 feet for Lots 1, 7, and 8, Block 1.
No permanent perimeter fencing shall be required along the eastern side of Lots 1-5, Block
2. However, temporary fencing to contain constn~on debris shall be installed prior to
applying for building permits.
Any development of the 40-foot-wide piece of pwpen~ to tho east of Lots 1-5 of Block 2,
rnnning adjacent to the Eight Mile Lateral, ~hail require a license agreement with the
Nampa-Meridian Irrigation Depa~haent prior to developmem or landscaping. Additionally,
the homeowner, prior W landscaping or otherwise improving the land, shall obtain all
approval letter from the property owner of the 40-foot-wide strip of land.
The aforementioned 40-foot wide strip of land adjacent to the rear of Lots 1-5, Block 2,
and ~e Eight Mile Lateral shall not be split or otherwim sold unless the property has b~n
properly subdivided and a license agreement with the NMID has been granted for
developing said property.
