Cherry Lane City of Meridian City Clerk Office Applications: Appeal of Director's decision to deny a sign permit for Primerica Highlight of Proposed Development: Applicant requested permit for an existing Primerica sign (erected without a permit). That permit was denied for the following reasons: 1. The proposed sign meets the defInition of an off-premise sign: A sign that is not related to the property upon which it is located or to the activitv being conducted thereon. The sign is located above two separate entrances to two separate tenant spaces that does not encompass the Primerica business. 2. Per UDC-11-3D-8D: "Wall Area" shall mean the wall surface of a single-tenant structure or the storefront of a multitenant structure. This is a multitenant structure with separate tenant entrances. 3. Furthermore, under UDC-11-3D-9D3, the Planned Sign Program standards for wall signs reads: Wall signs are permitted in any number, location, or orientation, except toward an acijoining residential property, provided that the total square footage does not exceed eighteen percent (18%) of the wall face upon which the sign is placed, or nine percent (9%) of the wall if combined with a freestanding sign on the same lot. The proposed sign is over nine percent (9%) of the wall face for the storefront elevation for Primerica. Mr. Mendel's letter, received 7/3/07, has 4 points: 1. The Primerica sign meets the 9% rule for the elevation. The current sign was computed for the actual tenant storefront. It was an approximation of the elevation. The applicant did not submit a sign permit for this elevation. The permit was for the current sign over the off-premise elevation. If the applicant wishes to move the current sign over their storefront, it will be approved at 9%. They could also apply for a monument on Linder. The Cherry Crossing Subdivision Planned sign program has approved center signs and free standing monuments. Wall signs have subsequently been approved: When a combination of signs exists for a planned sign program, the wall signs are reduced 50% from 18% of the wall elevation to 9% if the center or freestanding signs are on the same lot as the proposed wall SIgn. 2. Signs in violation of 9% standard. The Evergreen Chiropractic and Preferred Physical Therapy signs do meet the 9% rule for the wall elevations. The south side Evergreen sign is at 5% and the combined signs on the east are under 9%. All other signs in the Cherry Crossing subdivision shown are on lots that do not have a center or monument sign on the same lot. They are subject to the 18% rule. 3. Tenant/landlord agreement of exclusive rights. This agreement between Mr. Mendel and Mr. Story does not exempt either of them from meeting the UDC standards. 4. Mr. Mendel feels singled out for noncompliance when other signs in the city appear to be in noncompliance. Many of the signs pictured are old enough that they were not subject to the current sign standards. Others checked that are more recent are in compliance. Notes:
