We have reviewed this submittal and offir the following comments, as conditions of the applicant.
These conditions shall be considered infull, unless expressly modified or deleted by motion of the
Meridian City Council:
APPLICATION SUMMARY
The applicant(s), Lystrup / Jensen Architects, has requested approval of a conditional use permit for
the construction of a four room seminary building located on the property of an existing LDS church.
The seminary building will be 5,476 square feet in size and will contain four classrooms and five
offices to be used by teachers and staff. The existing parking lot will also be increased by 65 spaces.
The addition of a second building on the subject property is permitted as a Planned Development in
the R-8 zoning district. The section of the MCC regulating Planned Developments requires a
Conditional Use Permit and a Planned Development for the addition of the second building on the
subj ect property.
LOCATION & SURROUNDING USES
The subject property is located just to the southeast of the Eagle Road and Overland Road
intersection. The following uses surround the subject property:
North - Property is vacant and zoned CoN.
South - Rim View subdivision, zoned R-I.
East - Mountain View High School, zoned R-4.
West - Locust Grove Road, the Sportsman Pointe subdivision is located west of Locust
Grove Road.

OWNER OF RECORD
The owner of record is the Church of Jesus Christ of Latter Day Saints, and they have given their
consent for the applicant to submit their conditional use permit request.
STANDARDS FOR CONDITIONAL USES
The Commission and Council shall review the particular facts and circumstances of each
proposed conditional use in terms ofthe following and may approve a conditional use permit if
they shall find evidence presented at the hearing(s) is adequate to establish (11-17-3):
A. That the site is large enough to accommodate the proposed use and all yards, open
spaces, parking, landscaping and other features as may be required by this ordinance;
Although some minor modifications will need to be made to the landscape plan and the
parking plan, stafffinds that the subject property is large enough to accommodate the
required parking, landscaping, and other features required by the addition of the seminary
building.
B. That the proposed use and development plan will be harmonious with the Meridian
Comprehensive Plan and in accordance with the requirements of this Ordinance;
The current Comprehensive Plan Land Use Map designates the property as "Residential" and
is currently zoned "R-8". Staff finds that the requested seminary building use and planned
use development is a "Conditional Use" according to MCCll-8-1. Staff finds that if the
planned development and seminary building use is approved with conditions by the
Commission and the Council, the use will be compatible with the Meridian Zoning
Ordinance and the Comprehensive Plan.
C. That the design, construction, operation, and maintenance will be compatible with
other uses in the general neighborhood and with the existing or intended character of
the general vicinity and that such use will not adversely change the essential character
of the same area;
Staff finds that the proposed development will not adversely change the existing or intended
character ofthe general vicinity (currently a mix of residential and institutional uses).
D. That the proposed use, if it complies with all conditions of the approval imposed, will
not adversely affect other property in the vicinity;
The Commission and Council should rely upon public testimony to determine if the
development will adversely affect the other property in the vicinity.

E. That the proposed use will be served adequately by essential public facilities and
services such as highways, street, police, and fire protection, drainage structures, refuse
disposal, water, sewer or that the person responsible for the establishment of proposed
conditional use shall be able to provide adequately any such services;
Stafffmds that the proposed development will be adequately served by the essential public
facilities and services listed above.
F. That the proposed use will not create excessive additional requirements at public cost
for public facilities and services and will not be detrimental to the economic welfare of
the community;
Staff finds that the proposed use would not be detrimental to the economic welfare of the
community, nor would it create the need for any new facilities or services to be paid for by
the public.
G. That the proposed use will not involve activities or processes, materials, equipment, and
conditions of operation that will be detrimental to any persons, property, or general
welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or
odors;
Stafffinds that no excessive traffic, smoke, fumes, glare or odors will result from the
proposed use.
H. That the proposed use will have vehicular approaches to the property which shall be so
designed as not to create an interference with traffic on surrounding public streets;
Staff finds that the proposed use will not create significant interference with any traffic on
the surrounding public streets.
I. That the proposed use will not result in the destruction, loss or damage of a natural,
scenic or historic feature considered to be of major importance.
Staff fmds that no natural or scenic feature will be lost, damaged or destroyed by issuance of
this conditional use.
SITE SPECIFIC REOUIREMENTS
1. The submitted landscape plan shall be revised as follows:
a. Two landscaping islands s hall be added to the eastern row of parking spaces in the
proposed parking lot expansion.

b. One landscaping island shall be added to the western row of parking spaces in proposed
parking lot expansion.
c. One tree must be added for every 8,000 square feet of proposed open area.
d. One tree must be added for every 35' oflinear parking along the eastern boundary of the
proposed parking lot expansion.
e. A revised copy of the landscape plan shall be submitted to the city at least least ten (10)
days prior to the next public hearing. All landscaping shall be installed and continuously
maintained. All dead or dying vegetation shall be replaced upon request from the City.
2. Graphically depict the proposed pedestrian pathway that will connect the seminary building
with Mountain View High School.
3. Add handicapped parking spaces near the front entrance of the seminary building.
4. Graphically depict the existing trash enclosure and outbuilding on the site plan.
5. All exterior lighting, whether attached to the building or located within the parking lot, shall
be down-shielded or otherwise altered so that the light does not spill over onto adjacent
properties or right-of-way. All parking lot lighting shall be in accordance with Ordinance 11-
13-4C.
6. All signage shall be in accordance with the standards set forth in Section 11-14 of the City
Zoning and Development Ordinance. All signage is subject to design review and shall require
separate permits. Temporary or portable signs shall be prohibited, and shall be removed upon
3 days notice to the applicant.
7. All construction and site improvements shall conform to the requirements of the Americans
with Disabilities Act.
8. All parking shall be striped and improved in accordance with the Meridian City Code.
9. A drainage plan designed by a State ofIdallO licensed architect or engineer is required and
shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas.
Storm water treatment and disposal must be designed in accordance with Department of
Environmental Quality 1997 publication Catalog of Storm Water Best Management Practices
for Idallo Cities and Counties and City of Meridian standards and policies. Off-site disposal
into a surface water is prohibited unless the jurisdiction which has authority over the
receiving stream provides written authorization prior to development plan approval. The
applicant is responsible for filing all necessary applications with the Idallo Department of

Water Resources regarding Shallow Injection Wells.
10. Trash: The trash enclosure shall be enclosed on at least 3 sides by a solid wall or sight
obscuring fence at least four feet in height in accordance with Ordinance 11-12-1 C.
Coordinate location and construction requirements with Sanitary Services, Inc.
11. Certificate of Occupancy: All required improvements must be complete prior to obtaining a
Certificate of Occupancy for the proposed development. A temporary Certificate of
Occupancy may be obtained by providing surety to the City in the form of a letter of credit or
cash in the amount of 110% of the cost of the required improvements (including paving,
striping, landscaping, and irrigation). A bid must accompany any request for temporary
occupancy. Any temporary occupancy will not exceed 60 days to complete the required
improvements.
12. As part of a conditional use permit, the City of Meridian may Impose additional
restrictions/conditions.
RECOMMENDATION
Staff recommends approval of this application with the aforementioned conditions.

The following will be the requirements to provide minimum levels of fire protection for the
proposed project:
1. The project shall have a fire-flow as required by the Uniform Fire Code for four 4-
plex buildings. This is estimated to be a fire-flow of 1,750 gallons per minute
available for a duration of 2 hours to service the entire project. Fire hydrants shall
be placed an average of350' apart. 1997 UFC Appendix. m-A
2. Operational fire hydrants and temporary or permanent street signs are required
before combustible construction begins. UFC 901.4.2 & 901.3
3. Acceptance of the water supply for fire protection will be by the Meridian Water
Department.
4. Final Approval of the fire hydrant locations shall be by the Meridian Fire
Department.
5. The addresses shall be posted in 6" numbers on the street side of the building. A
monument sign with the address may be required on Locust Grove Rd.
6. The project will have to meet the requirements of the Fire Code in effect at the time
of the project submittal
7. Provide a 20' wide fire lane around the project.
8. Turning radii to be maintained at 28' inside radius and 48' outside radius.
9. Provide an on site fire hydrant on the SE corner of the new parking lot. The location
to be approved by the Meridian Fire Department.

The Ada County Highway District (ACHD) staff has received and reviewed the application and site plan for the item
referenced above and Is submitting this no review letter in response to the lead agency's request for comment.
Based on. the submitted information, it has been determined that the proposed development improvements exist
adiacent to the site and ACHD has no site iml!rov~mentreguirements attributalllElto this application.
If the site plan or use changes in such a manner that more than 10 additional vehicle trips per day are generated, then
ACHD will review the site plan and may Issue requirements based on the ACHD Policy Manual.
ACHD policy requires that before any improvements of any kind are constructed or installed within the public right-of-
--way;-a-permit or license agreement permitting-the improvements-must-beobtained.
All future design plans and construction shall be. in accordance with the Ada County Highway District Policy Manual,
ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances
unless specifically waived in writing by the District. Meet District drainage requirements per section 8000 of the ACHD
Development Policy Manual. Contact District staff at 387-6170 for details.
Please contact the office for determination of possible road impact fees, prior to obtaining a building permit. These fees
are collected in accordance with Ordinance #195, the Ada County Highway District Road Impact Fee Ordinance.

boundary of the above-mentioned proposed project. Any encroachments within the
easement of the Hunter Lateral without approved plans and a signed license agreement
are unacceptable.
