CONTENTS OF VARIANCE APPLICATION
(Incomplete applications will not be processed)
The Council shall not grant a variance from the terms of this Ordinance unless and until a
written application for a variance is submitted to the Administrator and the Council. The
application shall contain the following information:
1. Completed and signed application form. Attached
2. Proof of title of said owner (warranty deed). Warranty Deed on file in City Clerk's
Office.
3. Notarized consent from titled owner of property. (If owner is a corporation, provide a
copy of the Articles of Incorporafion or other evidence to show that the person signing is
an authorized representative.
4. Legal description of subject property. Attached
5. Provide a written statement -what ordinance can you not comply with? The Applicant
cannot comply with Meridian Zoning Regulation Chapter 9, Zoning Schedule of Bulk and
Coverage Controls, Section 11-9-1, which requires a 30 foot front yard and 20 rear yard
setback in an L-O zone. In addition, the Applicant cannot comply with the landscape
ordinance, Section 9, Bu, f)`ers Between D~erent Land Uses, which requires a 20 foot rear
yard landscape buffer between Class I and Class Hlland uses.
6. Provide a written statement -what prevents compliance with the ordinance? The Applicant
requests an 8 foot reduction in the front yard setback (from 30 feet to 22 feet) and a I S foot
reduction in the rear yard setback (from 20 feet to 5 feet) to allow for an 8 foot entry
canopy at the front of the building and equipmentfvehicle circulation space at the rear of
the property. The parcel does not have suj~cient depth to construct a fire substation of
adequate size and provide adequate clearances required for ej~cient/safe site circulation.
7. Provide a written statement -what are the minimum requirements of this ordinance that
need to be reduced to permit the proposed use? The Ada County Highway District has
designated Locust Grove as a minor arterial Section 11-9-1 of the Meridian Zoning
Regulation requires a 30' setback on arterial and collector streets and a 20' rear yard
setback within an L-0 zone. Section 9.4 of the Meridian Zoning Regulation also
requires a 20' rear landscape buffer between Class I (le. single family residential, etc.)
land use ad a Class II (~~ Quasi-Public, etc.) land use. To accommodate the
Applicant's proposed fire substation and its related site improvements, the Applicant
requests a reduction in the front yard setback from 30' to 22' and in the rear yard
setback from 20' to 5'.
Provide a written statement -what is the difficulty or hardship that would result if
requirements of this ordinance were applied to the subject property? If the Applicant's
variance request is not approved, the proposed fire substation will be significantly
compromised functionally and aesthetically. The aesthetics of the proposed building
have been carefully considered to compliment the emerging residential developments in
the immediate area. The only encroachment into the front yard setback will be a small,
8 ` x 13' approximately, entry canopy at the main entrance of the building. The
encroachment into the rear yard setback will be driving pavement for emergency
equipment and vehicles.
9. Provide a written statement -any unusual or peculiar circumstances that indicate
regulations of this ordinance that should not be strictly complied with? The Applicant
has attempted to standardize the design of their fire substation facilities. A
misunderstanding as to the amount of property purchased was discovered after the sale
had closed. When the impact of future Ada County Highway District right-of--way,
front and rear yard setback requirements were fully understood, the Applicant realized
that there was insufficient property depth to locate their facility and related site
improvements within the remaining buildable area. Discussions were held with the
original property owner to determine if additional adjacent property could be acquired
No agreement could be reached. Further investigation by the Applicant revealed that
there was not other available or affordable properties in the vicinity to provide a larger
building sites Fire substation sites are identifaed to minimize the response time for
emergency services within designated areas of the City. The size of the proposed
building, the amount of maneuvering area required for equipment, vehicles and
pedestrians, service and landscape areas have been carefully designed for the proposed
use and to fat properly into the residential character of the area. As the surrounding
community continues to grow, the importance of this facility to provide essential fire
and emergency services will become more critical
10. Provide a written statement that special conditions and circumstances exist which are
peculiar to the land, structure or buildings involved which are not applicable to other
lands, structures or buildings in the same district. Due to the physical limitations of the
site, the physical and functional realities inherent in the design of a modern fire
substation, and the need to provide fire%mergency services in the shortest time possible
there are special conditions and circumstances which exist that are peculiar to this site.
The significant amount of residential development in this area will demand a
convenient fire substation designed to be compatible wtth the aesthetic appeal of the
neighborhood.
11. Provide a written statement that a literal interpretation of the provisions of this Ordnance
shall deprive the applicant of rights commonly enjoyed by other properties in the same
district under terms of this Ordinance. The proposed fare substation building and site
development cannot be accommodated on this site within the prevailing setback
provisions of the current ordinance. The use proposed is not typical of other uses in
the L-D zone and a literal interpretation of the provisions of the zoning ordinance
setback regulations will deprive the Applicant of rights commonly enjoyed by other
properties in the same district
12. Provide a written statement that special conditions or circumstances exist that was not a
result of the applicant's action. This site is surrounded by properties that are currently
underdevelopment and/or unavailable for purchase. The Applicant does not have any
options to increase the sdze of the property to meet the needs of the project and
ordinance.
13. Provide a written statement that granting the variance requested shall not confer on the
applicant any special privilege that is denied by this ordinance to other lands, structures
or buildings in the same district. The Applicant does not believe that the granting of this
variance will confer any special privilege that is denied to other lands, structures or
buildings in the same district given the constraints of the subject site.
14. Provide a written statement of how the granting of the variance would convenience the
applicant and how the applicant would profit therefrom, which statement shall also
represent whether profit and convenience is the sole reason why the variance is requested.
The granting of the variance will allow the Applicant to construct a muck needed
emergency/public safety facility within an emerging residential area. It will also
improve the response time and cost of providing essential services to the public. The
Applicant will not profU from the reduction of the setbacks. The reduction will allow
the Applicant to provide adequate equipment/vehiclemaneuverinq space at the rear of
the ftre substation and to construct a facility that is adequate in size to service the
surrounding community.
15. Provide a written statement regarding the relationship of the proposed variance to the
Meridian Comprehensive Plan. The Comprehensive Pdan includes these goal statements
with regard to Public Safety:
6.1 To ensure adequate protection for new developments, provisions shall be
made for satellite fire stations which have a staff of fire fighters equipped with
the appropriate fire-fighting facilities.
6.9U Maintain afive-minute or less response time goal to all fire, police and
medical emergencies withha the City.
6.1 SU The recommended service standard for Meridian/Rural Fire Department
shall be based on 24-hour service at the downtown main fare station, with
satellite fire stations comprising a 10,000 to 15,000 square foot lot with a 3,000
square foot building of residential type construction and character, containing
a squad truck and tanker truck, operating personnel and support staff.
