DEFINITION: Every device propelled by human power upon which any person may ride, having two tandem-wheels, either of which is over twenty (2011) incheli! in diameter, i6 hereby defined as a bicyc~e. 2. EFl!'ECT Oli' RillULJ~TIONS: . (A) It shall be unlawful for any person to do any act forbidden or fail to perform any act required herein. (B) The parents: of any child and the guardian of any child or ward shall not authorize or knowingly permit any child or ward to violate any of the p:T_ovisions of this chapter. (c) Tkese regulations ap_plicable to bicycles sball apply whenever a bicycle I is_ operated upon any public thoroughfare or publio path set aside for the exolu- sive use of bicycles". 3-. LIC!!;NSE REQUIRED: It shall be unlawful for any person, to ride or propel ~bicycle on any public thoroughfare, street, alley or highway, unless such bicycle has been licensed and a license plate is attached thereto. 4-. APPLICATION: Alppilication for &. bicycle license and license plate shall be made to the Police Depa.rtment on the first day of January each year. Providing ap- plication cards, metal or sticker license plate and registration cards. 5. ISSUANCE: (A) The Police Department, upon receiving proper application therefore is authorized to issue a bicycle license which shall be effective until the end of the fiscal yeu. (B) The Police Department ahall not issue a license for any bicycle when he knows the applicant is not t~w.ne,r~~'?f or entitled to the posseSSion of su~ bicycle. (C) The Police Department shall 'keep a record of the number of each license, the da,te issued, the mire and a.ddress of the person to whom issued, the serial number on the frame of the bicycle and a record of all bicycle fees collected. 6. LICENSE FEE: A. fee of fifty cents (50t) shall be charged for all license plates or stickers. A fee of twenty five cents (.25;) shaJ.l be charged for all trans- far cards. 1 ~ ATTACHMENT Q]!' RENTAL AGENGIES: A, rentml agency shall not rent, or offer any bicycle for rent, unless such bicycle has a license attached thereto and has been properly licensed. 11. REPORT CF SALES:; It shall be the duty of every person who sells or trana- fera ownership of any bicycle to :report to the Police Department such sale or trans- fer within twenty four (24) hours after purchase or transfer of any such bicycle. 12. SERIAL NUMBER, MUTILATION: It shall be unlawful for. any person to remove, destroy, mutilate, dismantle, or alterihe serial number of any bicycle, or of any part thereof. 13. LICENSE PLATE OH STICKER, MUTILATION: It sha,ll be unlawful for any per- $on to remove, destroy, mutilate or alter any license plate or sticker or registra- tion card during the time the pIa. te, sticker or card is in force, and shall be un- lawful for any person to transfer a license from one (1) bicycle to another. HIDING ON BICYCL8S: (A) k person propelling a bicycle shall not ride other than astride a perm.. anent and regular seat attached thereto.. (B) . Persons riding bicycles upon a roadway shall not ride more than two (2) abreast except on paths or parts of roadways set aside for excluSive use of such.. (C) Whenever a usable path for bicycles has been provided adjacent to a roadway, bicycle riders shall use such path. 11. il'lERCING .F'ROH ALLEY OIl. DmVEWAY: The opera tor of a bicycle emerging from an alley, drivew%, or building shall, upon approaching a sidewalk or the ~idwalk area, extending across any alleyway, yield the right-of~way to all pedes- trians approaching on said sidewalk and upon entering the roadway Shall yield the right-of-way to all vehicles approaching on said roadway. 18. CLINGING TO VEHICLES: No person riding in or upon any bicycle shall attach such bicycle to a moving vehicle. 19. RIDING ON SIDBVJALKS:. I (A) It shall be unlawful for any person to ride a bicycle upon a sidewalk wi thin a business district. (B) The Chief of Police is authori~ed to erect signs on any sidewalk or roadway prohi bi ting the riding of bicycles thereon and when such signs are ~aced it shall be unlawful for any person to disobey the same. 20. LAMPS" REFlECTORS .AND m'HER EQUIPl"lENT: (A) Every bicycl@ when in use at night-time shall be equipped with a: lamp on the front, which shall emit a white light visible from a distance of at least five hundred (500) feet to the front. (B) Red Reflector Requiredt All bicycles shall be equipped wi tha red glass reflector of at least one inch (I") in diameter, which shall be so attached to the re&r of such bicycle as t 0 be visable from the .rE!ar. I I .:l81 (c) BRAKE REQUIRED: Every bicycle shall be equipped with a brake which will enable the operator to make the braked wheel skid on a dry, level cll9an pavement. 21. HANDS ON HAlWLEBARS: No person shall operate a bicycle or motor- cycle without keeping at least one (1) hand upon the handle bar. 22. PENALTY: Ezcept as otherwise herein provided, it shall be unlaw- ful and punishable as a misdemeanor to violate any of the provisions of this ordinanoe. Any person violating an;y provision 01' seotions, shall be guilty of a misdemeanor and upon the conviction thereof. shall be punished by a fille not to exceed one hundred ($100.00) dollars and cost 01" by imprfson- ment in the City Jail not to exceed ten (10) days or by both such fine and imprisonment.
