BE IT ORDAINED BY THB MAYOR AND CITY COUNCIL OF THE 01'1'Y OP MERIDIAN.

uection 1. For the Purl)ose of this Ordinance the fOllovrlng'words and
phrases shall have the meaning respectively asoribed to them as follows:
(a) ! "Coin operated Amusement Device" is a maohine or devlce into
whIch may be inserted any piece of money or other object and from which a.
a result of such insertion and the applica.tion of pbyaical or mechanical
foroe may issue wholly upon any chanoe or unoertainor oontingent event,
any piece or peioes of money, or any oheck, memoramdum, or other tangible
evidano~ oalli~ for money or property,' or whicb cneck, memorandum, or
other tangible evidenoe Is, after issuance, aotually redeemed in money or
exohanged for money or property by any person wh1'lteoe..,er; whioh devioe is.
- defined as and is hereby declared to be gamin8 but not lottery.
('b) The word"person n inoludes ,an individual perSOn, partnership,
oorporation or association.

Section 2. It'shall He unlawful for any perso~, inclUding an individual
person, partn~rstUp,' corporation, Or aasociBtion, toown and opera.te,or
to posess or permit the operation of R1:ly coin operated amusement device
a.s defined by this ordinanoe, within the oorporate Umi ts of the City of
Meridian, Ada County, Id~ho.
Sect1on3. Any person or persons violl'1ting the prov1s1ons OI~ this
Ordinanoe, upon conviotion thereof, shall be punishable by a fine not
exoeeJlng One Hundred Dolle.rs($lOO.OO), together with oosts, and in
defaul t of such pa.yment sball be oommi ttec1 to tbe C1 ty JeH of the City
of Meridian, and at hard labor upon the streets or elsewherefor the
benefit of the City of Meridian, until the fine and costs have been
satisfied, not exoeeding one day for every $2.00 of the fine and oosts.
Seotion 4. Any peaoe officer of the City of Meridinn who probable
cause to believe th~t 8 ooin operated amusement devioe is operated and
posessed b,y auy perlon, partnershIp, corporation or assooiation, in
..,1o';'stion of this Ordinance, 1s hereby authorized and empowered to
setse suoh dev1ce, and upon oonviotion of any person, part.nership,
oorporation or assoohtion :for such illegal operation and possession,
such device shell be deolared confisoated by the Cbeif pesoe offioer
of the City of Merid1~n ma.king seizure. Upon final determlnst~on of
suoh case, saId device sh~ll -be sold at publio sale to the highest
bidder atter posting noti.e for at least ten days of the time and plaoe
of said Bale at a public place at or near the Oourthouse door in the
of Ada, State of I48ho, where suoh sale shall be beld. The proceeds of
such aiae shall thereupon be deposited in and belong to the general
o~ said City of Meridlpn.
Section 5. An emergenoy existing therefor, which emergenoy is hereqy
declared to ezist, this Ordinance _ball be in full foroe and effect from
the date of Its passage and approval and p1J.bl1caUon.

Passed 'by the City COUAcil and approved by the Mayor of the City
of Meridian, Ada County, Idaho, this 3rd day of September, 1947.
