Dear Craig:
Nampa & Meridian Irrigation District has received and reviewed plans for the above-
mentioned project. The easement for the KelU1edy is fifty-five (55)-feet, twenty (20)-feet
left and thirty-five (35)-feet right. This easement must stay intact. It can be re-described
offset but the total easement must stay with the Kennedy Lateral.
You are proposing to pipe the KelU1edy Lateral and relocate it along Overland Road and
down your west boundary using forty-eight (48)-inch, Class III pipe, which is acceptable
outside of the traveled area. The traveled area should have Class V pipe for the load
limits under the entrance to your facility. If these are private driveways, Nampa &
Meridian Irrigation District will ask the owner to be responsible for everything that is
under pavement. Regarding the relocation; anything close to the entrance or paved
driveways that could be disturbed, destroyed or injured due to normal operation and
maintenance the License Agreement will cover us to indemnify the District not to be held---- -
responsible for any replacement of pavement or concrete work within our easement. If
each entrance is going to be under Ada County then Ada County will require boxes on
each side of the entrance.
The relocation of the pipe along the south boundary only allows ten (10) or twelve (12)
feet of fill to protect it. This is questionable whether this will be enough to actually
protect the pipe over the long period of time in which it will remain in place. We feel
that fifteen (15) or twenty (20) feet would be more acceptable.

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the Meridian Planning and Zoning Commission
of the City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho
Avenue, Meridian, Idaho, at the hour of 7:00 p.m. on April 5, 2001, for the purpose of
reviewing and considering the application of Meridian Freeway Associates and DBSI
Industrial Limited Partnership for a Conditional Use Permit for Planned Development to
include office, retail and industrial for proposed Treasure Valley Technical Center
generally located % mile east of Linder Road, north side of Overland Road.
A more particular description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Avenue, and is available for inspection during
regular business hours, Monday through Friday, from 8:00 a.m. to 5:00 p.m.
A copy of the application is available upon request. Any and all interested
persons shall be heard at said public hearing, and the public is welcome and invited to
submit testimony. Oral testimony may be limited to three (3) minutes per person.
Written materials may be submitted seven (7) days prior to the above hearing date so
that all interested parties may examine them prior to the hearing. All materials
presented at public meetings shall become property of the City of Meridian. Anyone
desiring accommodation for disabilities related to documents and/or hearings, please

Dear Mayor Corrie:
On April 5,2001, the Meridian Planning and Zoning Commission voted to recommend
"conceptual" approval of the above-referenced application. We have applied for a
Conditional Use Permit to approve a conceptual Planned Unit Development for the
Treasure Valley Technical Center. In making this application, our intention is to work
with the city openly in developing a first class technical center that we all can be proud of
and that will effectively serve the employment needs of the area. Consequently, we
applied for numerous additional uses to allow us to be able to more effectively market the
space.
Though the Planning and Zoning Commission voted to recommend approval of our
conceptual plans, they did not approve any of the additional uses requested. Frankly, we
did not engage in any meaningful discussion ofthe listed uses before the public hearing
was closed. There was no opposition of any kind to our application either in writing or at
the Planning and Zoning public hearing.
Since the list of additional conditional ust::s (in audition to already allowed uses under the
current L-l zone) for which we originally applied is admittedly lengthy, we wish to
clarify our intent by modifying the list to only include:
1. Daycare center
2. Professional and sales offices
3. Community and neighborhood shopping center
Only with approval of these additional uses along with our conceptual plans for the
Planned Unit Development do we feel we can effectively develop the Treasure Valley
Technical Center. Obviously, specific plans will still need approval through the
Conditional Use Permit process once tenants or participants commit to the project.

1. The property is located adjacent to 1-84, northwest of the intersection of
Stoddard and Overland Road, Meridian, Idaho.
2. The owner of record of the subject property is Meridian Freeway

3. Applicant is owner of record.
4. The subject property is currently zoned I-L. The zoning district of I-L is
defined within the City of Meridian Zoning and Development Ordinance, Section
11-7-2.
5. The proposed application requests a conditional use permit for Planned

Technical Center. The I-L zoning designation within the City of Meridian Zoning
and Development Ordinance requires a conditional use permit be obtained for most
uses including those requested by the Applicant. (Meridian City Zoning and
Development Ordinance, Section 1I-8~ 1 ).
6. The Meridian Planning and Zoning Commission recognizes that the
proposed application is in compliance with the Meridian Comprehensive Plan.
7. The use proposed within the subject application will in fact, constitute a
conditional use as determined by City Policy.
RECOMMENDATION
1. The Meridian Planning and Zoning Commission hereby recommends to
the City Council of the City of Meridian that they approve the conditional use
permit as requested by the applicant, subject to the following:
Adopt the Recommendations of the Planning and Zoning and Engineering
Staff as follows:
I. Off-street parking shall be provided in accordance with Section 11 ~ 13 of
the City of Meridian Zoning and Development Ordinance and/or as
detailed in site-specific requirements.
2. Paving and striping shall be in accordance with the standards set forth in
Sections II~I3-4.D. and 1l.I3~4.E. of the City of Meridian Zoning and
Development Ordinance and in accordance with Americans with
Disabilities Act (ADA) requirements.
3. A drainage plan designed by a State of Idaho licensed architect or

engineer is required and shall be submitted to the City Engineer per
City Ordinance 11-13-4.B.4 for all off-street parking areas. All site
drainage shall be contained and disposed of on-site.
4. Outside lighting shall be designed and placed so as to not direct
illumination on any nearby residential areas and in accordance with City
Ordinance Section 11-13A.C.
5. Any existing domestic wells and/or septic systems within this project will
have to be removed from their domestic service per City Ordinance
Section 9-1-4 and 9-4-8. Wells may be used for non-domestic purposes
such as landscape irrigation.
6. All irrigation ditches, laterals or canals, exclusive of natural waterways,
intersecting, crossing or lying adjacent and contiguous to the parcel shall
be tiled per City Ordinance 12-4-13. Plans will need to be approved by
the appropriate irrigation/drainage district, or lateral users association,
with written confirmation of said approval submitted to the Public
Works Department.
7. Provide landscaping in accordance with the Landscaping Ordinance,
Title 12, Chapter 13.
8. All trash and/or garbage collection areas shall be enclosed on at least
three (3) sides in accordance with City Ordinance Section 11-12-l.C.
The applicant must coordinate trash enclosure locations and
construction requirements with Sanitary Service Company (SSC) and
provide a letter of approval or plans stamped by SSC to the Plannirtg &
Zoning Department when applying for a Certificate of Zoning
Compliance.
9. Provide five-foot-wide sidewalks in accordance with City Ordinance
Section 12-5-2.K.
10. All signage shall be in accordance with the standards set forth in Title
11, Chapter 14 of the City Zoning and Development Ordinance.

11. All construction shall conform to the requirements of the Americans
with Disabilities Act.
12. The entire site is located within the I-L Zone; however, a large number
of the requested uses are prohibited within the I-L District. The
following uses have been requested for approval by the applicant as part
of the Planned Development, but are prohibited within an I-L Zone:
Accounting seIVices, administrative services, automobile service stations,
bakery stores, banks and other financial institutions, broadcasting (radio
and TV), childcare centers, clinics (medical, dental, and optical),
department stores, entertainment centers (indoor and outdoor),
hospitals, hotels, laboratories (medical, dental and optical), motels,
nursing homes, sanitariums, daycare centers, professional and sales
offices, regional and neighborhood shopping centers, retirement homes,
and technical schools.
*The Meridian City Code allows for modifications of district
regulations, including such exceptions pertaining to the district
regulations governing use (12-6-5), when the modification is desirable to
achieve the objectives of the Planned Development.
13. Prior to construction of the Western Electronics building, an agreement
was made with ACHD concerning the acquisition of the right-of-way on
Overland Road. No right-of -way was acquired for the installation of
curb, gutter or sidewalk along Overland Road and, as depicted on the
submitted site plan, there is currently no curb or gutter. A five-foot-wide
detached sidewalk has been installed along Overland in front of the
Western Electronics development as agreed to by the Developer and
ACHD. The right-of-way acquisition on Overland for the Western
Electronics development has been deferred until an improvement project
is in design. There is no current improvement project in design at this
time to improve Overland Road west of Stoddard Road. The Applicant
shall install a five-foot-wide detached sidewalk along the full length of
the planned development, adjacent to Overland Road in line with the
existing sidewalk, and the Applicant shall provide documentation from
ACHD addressing the resolution of the right-of-way issues prior to

issuance of a building permit.
14. The existing Western Electronics facility is served by a privately owned
and maintained sewage lift station that discharges to a City of Meridian
sewer main in Overland Road. The recently approved Bear Creek Estates
Subdivision discharges to the same manhole. Because Bear Creek Estates
was approved prior to the Western Electronics facility, only the
projected excess capacity in the receiving sewer is available for the
Western Electronics(T.V. Technical Center project. Computer model
calculations show that the Western Electronics lift station is limited to a
peak flow of 80 gallons per minute. The project must continue to be
served by the existing private lift station and pressure main until such
time as the Black Cat Trunk is available to serve this area. The lift
station may not discharge a flow greater than 80 gallons per minute at
any time. Provision must be made in the sanitary sewer system such that
the lift station can be abandoned and the site sewer system connected to
the Black Cat Trunk Sewer, or a lateral thereof, when it is available.
"Available" shall be defined as the time when the sewer is extended
through adjacent property to the western boundary of this project. This
project must include relocation of the lift station to the northwest corner
or installation of dry-line sewer to the northwest corner with this
project. The applicant must be responsible for the eventual connection
to the Black Cat Trunk Sewer. The Planning and Zoning Commission
recommends that the applicant pay "Blacl,- Cat Trunk Sewer" fees at the
time of building permit issuance. These fees are estimated at $1500 per
equivalent residential unit (ERU) and will contribute to the eventual
construction of the Black Cat Trunk Sewer into which this project is
designated to sewer.
15. The City of Meridian is in the process of drilling a new domestic well
within the Bear Creek Estates Subdivision to provide service to this area.
Preliminary fire flow demand estimates by the Meridian Fire
Department for this application indicate that up to 2,300 gpm flow
could be required. Even when the new City well is put online, it is very
doubtful that the required rates can be achieved and, unfortunately,
until the well is drilled and developed, its output rate is unknown. The
Planning and Zoning Commission recommend that the applicant

explore their options to providing alternative fire suppression systems.
16. A site report establishing the highest seasonal groundwater elevation
shall be submitted to the Public Works Department as part of the
construction plan approval process within the Planned Development.
17. Conceptual engineering plans, including profiles, shall be submitted to
the Public Works Department Prior to the City Council hearing of this
application.
18. Conditions run with the land: Any conditions attached to a final
development plan shall run with the land and shall not lapse or be
waived as the result of any subsequent change in the tenancy or
ownership of any or all said lands. Such conditions shall be deemed as
requirements for the issuance of the certificate of occupancy for any use
or structure.
19. Design Review: All planned developments are subject to design review
by the City staff and Council (l2-6-7H). All buildings, other than those
buildings constructed of like material and design as submitted, shall be
subject to further design review by the Council and Staff prior to
construction.
20. The Applicant must submit plans to the City Planning and Zoning
Director for approval of a comprehensive planned sign program in
accordance with Section 11-14-9(E) of the Sign Ordinance. The design
of the signs included within the sign program shall incorporate materials,
colors, and shall be reflective of a common theme that incorporates
similar design elements in terms of materials, letter styles, sign type and
sign shape.
21. All utilities, including water, sanitary and storm sewers, electricity, gas
and telephone lines shall be installed underground in either the public
right of way or utility easements. The design for adequate storm sewer
facilities shall be provided to the City Engineer and ACHD for review
prior to construction.

22. A copy of the bylaws or other deed restrictions which provide for the
maintenance and control of all the open space and common area shall be
provided to the Council for review prior to approval.
23. All required perimeter landscaping buffers (along Overland Road and 1-
84) shall be installed prior to the issuance of an occupancy permit for
any newly constructed building within the planned development. All
interior landscaping shall be installed pursuant to the Landscaping
Ordinance as additional buildings are constructed within the planned
development.
24. Only minor changes may be made in the location, siting, and height of
the proposed buildings, as authorized by the Building Official or as
required by engineering or other unforeseen circumstances. Additionally,
no such minor changes shall increase the volume of the of any building
or structure by more than 10 percent (12-6-6F). *The Applicant has
requested that the submitted site plan be considered conceptual in
nature, meaning applicant does not want to be limited to the
number, size, design or location of buildings, parking lots or
landscaping. The Applicant has stated that the development will
be driven by market demand. Staff feels that approving a
Conditional Use Permit for a planned development with nothing
more than a conceptual site plan to be driven by market demand
allows the developer to do essentially whatever they would like to
do in the future without further approvals from the Councilor
Commission. Conditions may be placed upon the applicant to
obtain a Conditional Use Permit for each building within the
Planned development.
25. If any land is planned to be sold or otherwise transferred to other
parties, preliminary and final plats must be submitted for approval and
the final plat must be recorded in the Ada County Recorder's Office. A
recorded subdivision will also be required for any dedication of public
right-of-way (with the exception of dedication on Overland Road, the
widening of which is in accordance with the Meridian Comprehensive
Plan. )

26. The applicant will be required to bring the present building site into
conformance with the plan which was approved to obtain a building
permit prior to submitting for additional building permits.
27. The Planning and Zoning Commission make it clear that this is
actually, as presented, a conceptual plan for a Conditional Use
Permit. The developer will be required to return to the
Commission and City Council for approval of all non-conforming
uses in the I-L zone for new conditional use permits.
Adopt the Central District Health Department's Recommendations as follows:
28. The Applicant's central sewage and central water plans must be
submitted to and approved by the Idaho Department of Health &
W dfare, Division of Environmental Quality.
29. Run-off is not to create a mosquito breeding problem.
30. Stormwater shall be pretreated through a grassy swale prior to discharge
to the subsurface to prevent impact to groundwater and surface water
quality.
31. The Engineers and architects involved with the design of the subject
project shall obtain current best management practices for stormwater
disposal and design a stormwater management system that prevents
groundwater and surface water degradation.
Adopt the Recommendations of the Meridian Fire Department as follows:
32. Applicants shall satisfy all fire code requirements including those
pertaining to water flow and fire sprinlder systems and hydrants.

Dear Mr. Callaham:
ACHD has not completed a thorough review of this site, pending revisions to the required Traffic Impact
Study. A study was submitted, and the ACHD Transportation Engineer has not yet approved the study.
ACHD staff will not complete a formal review until acceptance of the traffic study. However, I can offer the
following comments in regards to site related improvements.
Driveways:
· The proposed driveway locations appear to conform to District policy.
· District policy allows up to three access points for frontages over BOO-feet. The existing Western
Electronics site has a private road at the west property line and a driveway at the east property line
(two access points), ACHD staff will recommend that the entire site have three access points, in
accordance with Policy. Therefore, one of the western driveways should not be approved.
Right-of-Way:
The following language was taken from the ACHD staff report for the Western Electronics site
(October 4, 2000):
"The applicant and District staff have not been able to come to an agreement on the purchase price

This segment of Overland Road west of Stoddard Road abutting the site is not funded in the FIve
Year Work Program. The segment of Overland Road from Locust Grove to Stoddard Road is in the
FIve Year Work Program for widenll7g In 2004. 'j
Unless an agreement can be reached on the purchase price of 1he right-of-way, ACHD will not
acquire the necessary 48-feet from centerline on Overland Road with this application either. If right-
of-way is not dedicated, all parking, and permanent site related improvements should not be
constructed within the necessary 48-feet from cenlerline that will be acquired in the future for
widening.
Sidewalks:
District policy requires the construction of a 5-foot wide detached sidewalk on Overland Road
abutting the site. If the right-of-way acquisition IS deferred, there will be no place to construct a
sidewalk that can be salvaged when Overland Road is widened. With the Western Electronics site
the Commission provided two options: provide an $11,520 deposit to the Public Rights-of-Way Trust
Fund in lieu of constructing the 5-foot wide sidewalk, or, construct the sidewalk on the developer's
property and provide a suitable easement to allow the public to use the sidewalk. If a sidewalk is
constructed. the developer should be required to coordinate the location and grade of the sidewalk
with District staff. Due to the number of buildings being proposed, ACHD staff recommends
construction of sidewalk at this time to accommodate pedestrians.
Traffic:
.. According to the submitted traffic study, the proposed development will generate 3.455 vehicle
trips per day, based on trip generation rates for an industrial park.
· Overland Road from Stoddard Road to Locust Grove Road is listed in the District's Five Year
Work Program for widening to 3-lanes in 2004.
· Overland Road from Stoddard Road to Linder Road is listed in the District's Five Year Work
Program, but is not funded and IS listed as "planned development",
· Overland Road traffic count of 8,669 on 8-24-99 wlo SH-69.
· Overland Road traffic count of 6,067 on 5-9-00 w/o Stoddard Road,

During the review of the Traffic Impact Study, I noticed a few areas that need to be revised or included. The
first pertains to the intersections that were included in the analysis. Section 7106.1.1, article 1 states that
"The study shall cover streets from the development boundaries, to an intersection with existing or proposed
local, collector or arterial streets. In addition to the LOS analysis at the intersection of Meridian
Road/Overland Road, the intersection of Linder Road/Locust Grove Road also needs to be analyzed. This
intersection has been designated as a minor arterial/minor arterial intersection and should be analyzed in this
traffic study.
The second item of concern is the existing traffic counts supplied on table 2; page 3 of the study and also
with the AM and PM peak hour counts on figures 2 and 3. On table 2 the total vehicles per day for the
Meridian Road South of Overland Road has more recent data than you provided in your table. The table
below shows the updated totals. The data on figures 2 and 3 both show conditions that are over one-year
out of date. With the increase in the total vehicles per day, on Meridian Road, similar increases should be
expected at the intersection. I would like the representative peak hour totals updated for this traffic study. I

The third item concerns the Baseline Conditions on page 5 of the traffic impact study. In table 3 the
Vol./Cap. ratio appears to be higher that what you have recorded. It also appears to me that you are using
the planning thresholds from COMPASS to determine the capacity for this roadway. For this section of
roadway I would like for you to determine the calculated Vol./Cap., and then to show your work involved
proving these calculations.

The last item I will address concerns the warrant for the right-turn lane into the site. In your analysis the
warrant for a right-turn lane has been met. The location of this project does not appear to me to be within the
limits of the proposed Overland, Stoddard to Locust Grove project (RD168). It would appear to me that the
right-turn lane would be required by ACHD and would not be an inefficient use of resources at this time. The
Overland, Linder/Meridian project (RD290), which appears to cover the portion of the roadway that this
development covers, is not scheduled for design until 2005 and probably not built until 2007.
Please make the requested changes and reflect those in the traffic study. You may submit only those pages
that are affected by these changes.

We have reviewed this submittal and offer the following comments, as conditions of the
applicant. These conditions shall be considered in full, unless expressly modified or deleted by
motion of the Meridian City Council:
APPLICATION SUMMARY
DBSI is requesting a Conditional Use Permit for a Planned Development (General) pursuant to
Meridian City Code 12-6-(1-8), in order to locate approximately 7 buildings, containing 261,630
square feet, on 4 parcels of land totaling 32.79 acres. All developments that have more than one
principal detached building on one lot are required to obtain approval as a Planned Development (11-
4-7). Presently, the only building located on the property is the Western Electronics building.
DBSI has requested that the following 46 different uses be considered within the Planned
Development:
A. Commercial Uses- Accounting services, administrative services, automobile service
stations, bakery stores, banks and other financial institutions, broadcasting, radio and TV,
childcare center, clinics (medical, dental, and optical), department stores, dry cleaning,
entertainment centers (indoor and outdoor), greenhouses, nurseries, hospitals, hotels,
laboratories, motels, nursing homes, sanitariums, daycare centers, professional and sales
offices, public parking lots, restaurants, retail stores, retirement homes, research facilities,
shopping centers (community and neighborhood), tech schools, veterinary clinics and
hospitals, and wholesale facilities.
B. Industrial Uses~ Apparel manufacturing, bakery products, bottling and packaging,
electronic supplies and appliances, electronic equipment and products, industrial research,
instruments, machine shop, mobile home manufacturing, molded plastic products, office
machines, photographic equipment, printing and publishing, processing plants,
warehousing and wholesaling.
A number of the requested uses are prohibited within the 1- L Zone, while many of the uses would

require a Conditional Use Permit in order to be located within a 1- L zone. Nevertheless, according to
12-6-5 of the Planned Development Ordinance, exceptions to district regulations governing use can
be made when a they are deemed to be desirable to achieving the objectives of the Planned
Development. This issue will be addressed in further detail under the site specific requirements.
The site plan that has been submitted is only, as DBSI explains in its letter dated February 15th 2001,
"a reasonable expectation" of the final development. DBSI does not want to be limited to the
conceptual number and type ofbuildings, parking configurations, square footage or uses as submitted
with this application. DBSI states in the same letter that they intend to stay totally compliant with the
ordinances and procedures now governing developments within the City of Meridian
LOCATION & SURROUNDING USES
The subject property is adjacent to 1-84, located northwest of the intersection of Stoddard and
Overland Road, extending approximately 1,325 feet along Overland and 1,065 feet north to 1.84. The
lot is currently zoned I-L.
The property is located in an area designated as Existing Urban in the Comprehensive Plan.
The surrounding uses are as follows:
North: Interstate 84.
East: Undeveloped land, zoned I-L.
South: Agricultural land. The Queensland Acres Subdivision is located Southeast of the
subject property.
West: Undeveloped County property zoned C-2 currently used for large equipment
storage, and a veterinary clinic located in a C-G Zone.
GENERAL REQUIREMENTS
1. Off-street parking shall be provided in accordance with Section 11-13 of the City of Meridian
Zoning and Development Ordinance and/or as detailed in site-specific requirements.
2. Paving and striping shall be in accordance with the standards set forth in Sections 11-13-4.D.
and 11-13-4.E. of the City of Meridian Zoning and Development Ordinance and in
accordance with Americans with Disabilities Act (ADA) requirements.
3. A drainage plan designed by a State of Idaho licensed architect Of engineer is required and
shall be submitted to the City Engineer per City Ordinance 11-13-4.BA for all off-street
parking areas. All site drainage shall be contained and disposed of on-site.
4. Outside lighting shall be designed and placed so as to not direct illumination on any nearby
residential areas and in accordance with City Ordinance Section 11-13-4.C.

5. Any existing domestic wells and/or septic systems within this project will have to be removed
from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells may be used
for non-domestic purposes such as landscape irrigation.
6. All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing
or lying adjacent and contiguous to the parcel shall be tiled per City Ordinance 12-4-13.
Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users
association, with written confirmation of said approval submitted to the Public Works
Department.
7. Provide landscaping in accordance with the Landscaping Ordinance, Title 12, Chapter 13.
8. All trash and/or garbage collection areas shall be enclosed on at least three (3) sides in
accordance with City Ordinance Section 11-12-1.C. The applicant must coordinate trash
enclosure locations and construction requirements with Sanitary Service Company (SSC) and
provide a letter of approval or plans stamped by SSC to the Planning & Zoning Department
when applying for a Certificate of Zoning Compliance.
9. Provide five-foot-wide sidewalks in accordance with City Ordinance Section 12-S-2.K.
10. All signage shall be in accordance with the standards set forth in Title 11, Chapter 14 of the
City Zoning and Development Ordinance.
11. All construction shall conform to the requirements of the Americans with Disabilities Act.
SITE SPECIFIC REQUIREMENTS
1. The entire site is located within the 1- L Zone; however, a large number ofthe requested uses
are prohibited within the I-L District. The following uses have been requested for approval by
the applicant as part of the Planned Development, but are prohibited within an I-L Zone:
Accounting services, administrative services, automobile service stations, bakery stores, banks
and other financial institutions, broadcasting (radio and TV), childcare centers, clinics
(medical, dental, and optical), department stores, entertainment centers (indoor and outdoor),
hospitals, hotels, laboratories (medical, dental and optical), motels, nursing homes,
sanitariums, daycare centers, professional and sales offices, regional and neighborhood
shopping centers, retirement homes, and technical schools.
*The Meridian City Code allows for modifications of district regulations, including
such exceptions pertaining to the district regulations governing use (12-6~5), when the
modification is desirable to achieve the objectives of the Planned Development.

above uses, if any, should be allowed to be included in this Planned Development
project, based on desirability and compatibility. For example, included among the
requested uses are nursing homes and automobile service stations, notwithstanding the
fact that they are not compatible as neighboring uses.
A variety of alternative solutions other than permitting and denying any of the above
listed uses exists. For example, the Council or Commission could require a Conditional
Use Permit for any or all of the aforementioned prohibited uses in the underlying I-L
Zone. A second alternative would be to allow 20% of the land area within the
development to contain non-conforming uses.
2. Prior to construction of the Western Electronics building, an agreement was made with
ACHD concerning the acquisition of the right-of-way on Overland Road. No right-of -way
was acquired for the installation of curb, gutter or sidewalk along Overland Road and, as
depicted on the submitted site plan, there is currently no curb or gutter. A five-foot-wide
detached sidewalk has been installed along Overland in front of the Western Electronics
development as agreed to by the Developer and ACHD. The right-of-way acquisition on
Overland for the Western Electronics development has been deferred until an improvement
project is in design. There is no current improvement project in design at this time to improve
Overland Road west of Stoddard Road. The Applicant shall install a five-foot-wide detached
sidewalk along the full length of the planned development, adjacent to Overland Road in line
with the existing sidewalk, and the Applicant shall provide documentation from ACHD
addressing the resolution of the right-of-way issues prior to issuance ofa building permit.
3. The existing Western Electronics facility is served by a privately owned and maintained
sewage lift station that discharges to a City of Meridian sewer main in Overland Road. The
recently approved Bear Creek Estates Subdivision discharges to the same manhole. Because
Bear Creek Estates was approved prior to the Western Electronics facility, only the projected
excess capacity in the receiving sewer is available for the Western Electronics/T.V. Technical
Center project. Computer model calculations show that the Western Electronics lift station is
limited to a peak flow of80 gallons per minute. The project must continue to be served by the
existing private lift station and pressure main until such time as the Black Cat Trunk is
available to serve this area. The lift station may not discharge a flow greater than 80 gallons
per minute at any time. Provision must be made in the sanitary sewer system such that the lift
station can be abandoned and the site sewer system connected to the Black Cat Trunk Sewer,
or a lateral thereof, when it is available. ""Available" shall be defined as the time when the
sewer is extended through adjacent property to the western boundary of this project. This
project must include relocation of the lift station to the northwest comer Of installation of dry-
line sewer to the northwest comer with this project. The applicant must be responsible for the
eventual connection to the Black Cat Trunk Sewer. Staffreconunends that the applicant pay
"Black Cat Trunk Sewer" fees at the time of building permit issuance. These fees are
estimated at $1500 per equivalent residential unit (ERU) and will contribute to the eventual
construction ofthe Black Cat Trunk Sewer into which this project is designated to sewer.

4. The City of Meridian is in the process of drilling a new domestic well within the Bear Creek
Estates Subdivision to provide service to this area. Preliminary fire flow demand estimates by
the Meridian Fire Department for this application indicate that up to 2,300 gpm flow could be
required. Even when the new City well is put online, it is very doubtful that the required rates
can be achieved and, unfortunately, until the well is drilled and developed, its output rate is
unknown. We recommend that the applicant explore their options to providing alternative fire
suppression systems.
5. A site report establishing the highest seasonal groundwater elevation shall be submitted to the
Public Works Department as part of the construction plan approval process within the
Planned Development.
6. Conceptual engineering plans, including profiles, shall be submitted to the Public Works
Department Prior to the City Council hearing of this application.
7. Conditions run with the land: Any conditions attached to a final development plan shall run
with the land and shall not lapse or be waived as the result of any subsequent change in the
tenancy or ownership of any of all said lands. Such conditions shall be deemed as
requirements for the issuance of the certificate of occupancy for any use or structure.
8. Design Review: All planned developments are subject to design review by the City staff and
Council (12-6-7H). All buildings, other than those buildings constructed oflike material and
design as submitted, shall be subject to further design review by the Council and Staffprior to
construction.
9. The Applicant must submit plans the City Planning and Zoning Director for approval of a
comprehensive planned sign program in accordance with Section 11-14-9(E) of the Sign
Ordinance. The design of the signs included within the sign program shall incorporate
materials, colors, and shall be reflective of a common theme that incorporates similar design
elements in terms of materials, letter styles, sign type and sign shape.
*Staff feels that the applicant should be required to submit some sort of plan, before
requesting sign program approval, to the Council and Commission. The Applicant
requested approval of a sign program in their cover letter for this CUP; however, they
have not submitted any detailed or sealable plans, elevations or proposed locations as
part of their request. Additionally, they have requested "at least" two monument signs
for each building, whereas only one additional sign per building is permitted by
ordinance.
10. All utilities, including water, sanitary and stonn sewers, electricity, gas and telephone lines
shall be installed underground in either the public right of way or utility easements. The design

11. A copy of the bylaws or other deed restrictions which provide for the maintenance and
control of all the open space and common area shall be provided to the Council for review
prior to approval.
12. All required perimeter landscaping buffers (along Overland Road and I~84) shall be installed
prior to the issuance of an occupancy permit for any newly constructed building within the
planned development. All interior landscaping shall be installed pursuant to the Landscaping
Ordinance as additional buildings are constructed within the planned development.
13. Only minor changes may be made in the location, siting, and height ofthe proposed buildings,
as authorized by the Building Official or as required by engineering or other unforeseen
circumstances. Additionally, no such minor changes shall increase the volume of the of any
building or structure by more than 10 percent (12-6-6F).
*The Applicant has requested that the submitted site plan be considered conceptual in
nature, meaning applicant does not want to be limited to the number, size, design or
location of buildings, parking lots or landscaping. The Applicant has stated that the
development will be driven by market demand. Staff feels that approving a Conditional
Use Permit for a planned development with nothing more than a conceptual site plan to
be driven by market demand allows the developer to do essentially whatever they would
like to do in the future without further approvals from the Council or Commission.
Conditions may be placed upon the applicant to obtain a Conditional Use Permit for
each building within the Planned development.
14. If any land is planned to be sold or otherwise transferred to other parties, preliminary and final
plats must be submitted for approval and the final plat must be recorded in the Ada County
Recorder's Office. A recorded subdivision will also be required for any dedication of public
right~of-way (with the exception of dedication on Overland Road, the widening of which is in
accordance with the Meridian Comprehensive Plan.)
15. The applicant will be required to bring the present building site into conformance with the
plan which was approved to obtain a building permit prior to submitting for additional
building permits.

RECOMMENDATION
A key element in PJanned Development is the word "plan", and unfortunately this application for a
planned development consists of little more than a conceptual plan and an applicant's pledge to have
this project meet minimum city requirements as it develops according to market conditions. Staff
would recommend approval of this application if the Conunission limits the type of uses to be
permitted within the Planned Development and lists those uses that will require additional approval
through the conditional use permit process. Unless the applicant can be more specific, it may be
preferable for all future uses to be approved under the conditional use pennit process unless they are
permitted outright in the 1- L zone, are in significant confonnance with the approved site plan, and can
meet fire and sewer flow requirements.

During the review of the Traffic Impact Study, I noticed a few areas that need to be revised or included, The
first pertains to the intersections that were included in the analysis. Section 7106.1.1, article 1 states that
"The study shall cover streets from the development boundaries, to an intersection with existing or proposed
local, collector or arterial streets. In addition to the LOS analysis at the intersection of Meridian
Road/Overland Road, the intersection of Linder Road/Locust Grove Road also needs to be analyzed. This
intersection has been designated as a minor arterial/minor arterial intersection and should be analyzed in this
traffic study.
The second item of concern is the existing traffic counts supplied on table 2; page 3 of the study and also
with the AM and PM peak hour counts on figures 2 and 3. On table 2 the total vehicles per day for the
Meridian Road South of Overland Road has more recent data than you provided in your table. The table
below shows the updated totals. The data on figures 2 and 3 both show conditions that are over one-year
out of date. With the increase in the total vehicles per day, on Meridian Road, similar increases should be
expected at the intersection, I would like the representative peak hour totals updated for this traffic study. I
believe that the existing traffic volume totals for the other legs of this intersection, and all intersections
analyzed. need to be included in a traffic impact study. Would you provide those totals in your update.

The third item concerns the Baseline Conditions on page 5 of the traffic impact study. In table 3 the
Vol./Cap, ratio appears to be higher that what you have recorded. It also appears to me that you are Llsing
the planning thresholds from COMPASS to determine the capacity for this roadway. For this section of
roadway I would like. for you to determine the calculated Vol./Cap., and then to show your work involved
proving these calculations.

The last item I will address concerns the warrant for the right-turn lane into the site. In your analysis the
warrant for a right-turn lane has been met. The location of this project does not appear to me to be within the
limits of the proposed Overland, Stoddard to Locust Grove project (RD168). It would appear to me that the
right-turn lane would be required by ACHD and would not be an inefficient use of resources at this time. The
Overland, Linder/Meridian project (RD290), which appears to cover the portion of the roadway that this
development covers, is not scheduled for design until 2005 and probably not built until 2007.
Please make the requested changes and reflect those in the traffic study. You may submit only those pages
that are affected by these changes.

STORM WATER MANAGEMENT RECOMMENDATIONS
It is recommended that storm water be pre-treated through a grassy swale
prior to discharge to the subsurface to prevent impact to ground water and
surface water quality. The engineers and architects involved with the design
of this project should obtain current best management practices for storm
water disposal and design a storm water management system that is
preventing groundwater and surface water degradation. Manuals that could

Bruce Freckleton and I met with Dan Bradshaw, representative ofDBSI, today regarding the position
statement Mr. Bradshaw submitted regarding the Findings of Fact/Conclusions of Law and Decision
and Order on the above-referenced matter. The following changes were mutually agreed upon:
Findings of Fact/Conclusions of Law:

I have reviewed the Findings and Recommendations of the Planning and Zoning Commission with
which I disagree as follows: [fill out only those sections that apply to your position if your position is
to reject completely the Findings and Recommendations or there is inadequate space available

The following Findings and/or Recommendations should be deleted: [refer to section number in
order]
Section 12.15 Findings of Fact (which is also Section 1.15 under Decision and Order, and
Section 2.15 under Order). Reason: this section is redundant and not based on current
information. Please refer to Section 12.36 Findings of Fact as modified below.
AND
Section 12.26 Findings of Fact (which is also Section 1.26 under Decision and Order, and
Section 2.26 under Order). Reason: this section is not current, in that, the present building
site (we assume the reference is to the DBSIIW estern Electronics or Swenson Building) has
been brought into conformance with the plan which was approved.
The following Findings and/or Recommendations should be modified: [refer to section number in
order and set out how you request it should read]
Section 12.24: [should read] (last sentence) Conditions are placed upon the applicant to review only
the site specific design through the conditional use permit process for each non-
conforming use. {this is Section 1.24 in Decision and Order and 2.24 in Order}.
(see also section 12.27).
Section 12.25: [should read] The land may be sold in its current deeded configuration of parcels. If
sold in any other configuration, then a preliminary and final plat shall be submitted
for approval and the final plat shall be recorded in the Ada County Recorder's Office.
A recorded subdivision shall also be required for any dedication of public right-of-
way, (with the exception of dedication on Overland Road, the widening of which is
in accordance with the Meridian Comprehensive Plan). {this is Section 1.25 in
Decision and Order and 2.25 in Order} .
Section 12.27: [should read] The City Council makes it clear that this is actually, as presented, a
Conceptual plan for a Conditional Use Permit. The developer shall be required to

site specific design, for that particular non-conforming use, which has arisen
from the preliminary conditional use permit process. {Section 1.27 in Decision
and Order, and Section 2.27 in Order}. (See Section 12.24)
Section 12.36: [should read] Additional development within this project shall only proceed
to the extent that the particular building, or phase, has an adequate supply of
water, as may be determined by the City of Meridian Public Works Department,
and the Meridian Fire Department. {Section 1.36 in Decision and Order, and Section
2.36 in Order}
Note: Originally this section was probably intended
to indicate that upon completion of Well #22 (which was not specifically
identified as the Bear Creek Estates Subdivision well) adequate water supplies
would be available to the subject development. But the future development of
the subject Treasure Valley Technical Center should not be dependent upon any
particular project or well. What if, for example, Well #22 came in a dry hole?
Item #1: Decision and Order pg.16. [should read] That the above named applicant is granted a
Conditional use permit for a planned development to include office, daycare, retail
and industrial for proposed Treasure Valley Technical Center in an I-L zone located
adjacent to 1-84, northwest of the intersection of Stoddard and Overland Road,
Meridian, Idaho, subject to the following conditions of use and development:
