Development Agreement Modification
On behalf of the applicant, this narrative is being submitted in support of a Development
Agreement Modification request for the Solara Estates Subdivision.
The original project name is Solara Estates Subdivision. The City of Meridian land use
application was processed under Case No. H-2025-0013 for Alternative Compliance,
Annexation, and Preliminary Plat. The project was approved by the Meridian City Council,
with Findings of Fact, Conclusions of Law, and Decision & Order signed on October 28,
2025.
The Solara Estates Subdivision approval included annexation of approximately 15 acres
of land from Ada County into the City of Meridian and preliminary plat approval for 19 total
lots on approximately 9.72 acres, consisting of 14 single-family residential lots and 5
common lots. The project includes one existing home site to remain.
As part of the approved conditions of the annexation, a Development Agreement was
required to be entered into between the City of Meridian, the property owner(s), and the
developer prior to approval of the annexation ordinance. The conditions of approval further
stated that the applicable Development Agreement fee was required to be paid prior to
commencement of the Development Agreement and that the Development Agreement
was required to be signed by the property owner and returned to the Planning Division
within six months of City Council granting the annexation.
The Development Agreement fee was not paid within the original six-month period
following City Council approval. As a result, the City Attorney did not begin preparation of
the Development Agreement, and the Development Agreement was not prepared,
approved, signed, returned to the City, or recorded within the required timeframe.
Because no Development Agreement was executed or recorded, there is no Development
Agreement approval date, recordation date, or instrument number associated with this
request.

Reason for Request
The reason for this Development Agreement Modification request is to address the
expiration of the original timeframe for execution of the required Development Agreement.
Due to an administrative oversight, the Development Agreement fee was not paid within
the original six-month period following City Council approval. As a result, the Development
Agreement process was not initiated, and the agreement was not prepared, signed,
returned to the City, or recorded within the required timeframe.
The applicant is not requesting any substantive change to the approved project,
preliminary plat, land use, density, site layout, or conditions of approval. The request is
limited to allowing the required Development Agreement process to proceed so that the
Development Agreement may be prepared, executed, and recorded in accordance with
City requirements.
This request is not to remove property from an existing Development Agreement.
Additionally, because no Development Agreement has been executed or recorded for the
project, this request is not a modification to the text of an existing recorded Development
Agreement. Rather, the applicant is requesting approval of a Development Agreement
Modification to allow the Development Agreement process to proceed after expiration of
the original six-month timeframe, so that the required Development Agreement may be
prepared, reviewed, approved, signed, and recorded in accordance with City
requirements.
No changes are proposed to the previously approved preliminary plat, alternative
compliance approval, project layout, density, use, or conditions of approval, except as
necessary to allow the Development Agreement to be processed after expiration of the
original execution timeframe. The applicant intends to comply with the applicable
conditions of approval for Solara Estates Subdivision and to complete the Development
Agreement process as required by the City.
Because there is no existing recorded Development Agreement, there are no existing
Development Agreement sections to show in strike-out/underline format. The proposed
modification is limited to extending or re-establishing the time allowed for execution and
recordation of the required Development Agreement.
The applicant respectfully requests that the City Council approve this Development
Agreement Modification request and allow the required Development Agreement for
Solara Estates Subdivision to be prepared, executed, and recorded so the project may
continue through the remaining City review and approval process.
