Kingsford at 7:30 P.M. was called to Members Present: Yerrington: Ron Tolsma, Bob Giesler, Bob Corri e, Max Others Present: Arlene M. Bodine, Marvin Bodine, Wendy Kennedy, Norman Fuller, Dorothy Hel1hake, Chuck Fuller, Eric Zeller, Lynn Thomas, Fred Shoemaker, Gary & Charlotte James, Jim Tisdale, Frank Thomason, James Baker, Darlene Travis, Linda Gebhart, Les Schild, Larry Bertetto, Dave Leader, Vicki White, Gary Smith, Wayne Crookston, Bill Gordon, Bruce Stuart, Jim Johnson, Don Hubble, Jack Pinkston: MINUTES OF THE PREVIOUS MEETING HELD JUNE 16, 1992: The Motion was made by Tolsma and seconded by Giesler to approve the minutes of the previous meeting held June 16, 1992 as written: Motion Carried: All Yea: ITEM #1: JOINT SCHOOL DISTRICT: PLACED ON CONDITION USE PERMIT. APPEAL CONDITION FOR ROAD Kingsford: At this time I will turn the meeting over to Mr. Tolsma and step down due to a conflict of interest. Tolsma: Are there any questions from the Council? Giesler: If the road is requested will the project still go? Chuck Leihe: We budgeted $188,800.00 for this Academy move from the present location to the Lanark site. The low bid came in at $209,000.00~ We anticipate that the road would cost $15,000.00. To answer your question, yes the school will move anyway and we agreed to abide by your final decision. Gave description of the materials required to put in the road. Briggs engineering stated to plan on $15,000 to $20,000 for the roadway to be built. Time is a factor here also. We feel that Lanark is a public street and it seems out of line for somebody to be saying that our kids shouldn't use that street. It's a public street. We would like you to reconsider your condition put on our request. It is our request that you remove the condition. Tolsma: One of the basic reasons they wanted that road is because your putting a school at the end of a dead end street and for fire and emergency personnel to reach that it could be difficult. This road would give them a secondary access to get in there. MERIDIAN CITY COUNCIL JULY 7, 1992 PAGE 2 Liehe: Lanark is a wide street and especially down at the end, it would take quite a few vehicles in there in an unusual position to block that road. We think that to have a road in there would be more of a detriment than a help. Giesler: I think we'd require a breakaway barrier up there to where that isn't a through street. I do feel that we need the additional road. I would want a break-away barrier so that wouldn1t be a through street, it would be just for that school. Those kids go in and out of that school off of Franklin Road so it wouldn't be a detriment to other businesses. It will have to be done to where the kids do not get down Lanark. Liehe: We have a drawing of the school on poster board. you like to see that? Would Giesler: That would be fine with me. I still feel it's very important. I know spending the extra dollars is a tough issue because it's something we don't have a lot of but I think if nothing else maybe a little bit better planning should have been done before it had gone this far. I feel that this condition we have put on is a very important one. How many kids are at the Academy? Liehe: 130. Corrie: How many of them drive? P. Gorman: About 80. than the kids do. But the buses leave at different times Giesler: situation. You still aren't thinking about the emergency Tolsma: This is not a public hearing. The Motion was made by Giesler and seconded by Corrie to table this and reschedule for another public hearing. Motion Carried: All Yea: ITEM #2: PUBLIC HEARING: PRELIMINARY PLAT ON MERIDIAN GREENS #3: Kingsford: Returned Public Hearing and speak first. to seat. At this time invite the representative I will of the open the owner to MERIDIAN CITY COUNCIL JULY 7, 1992 PAGE 3 Don Hubble, 3952 Daisy Way, was sworn by the attorney. Hubble: I am the project engineer for this Meridian Greens #3 project. Presented a map for the Council to see of the project. This is an additional phase of the existing Meridian Greens subdivision. It will be south of Overland and east of Kuna- Meridian Highway. The area is 77 1/2 acres and we are proposing to develop 168 lots, we have a density of 2.17 lots to the acre. The existing zoning is R-4. We are proposing several culdesacs within the project. One of these culdesacs exceeds the maximum length allowed by the City. We request your permission for a variance on that one culdesac. This project will be served by City services and the sewer is already at the edge of this project. We will extend the main line sewer up Ten Mile Creek to connect to this. Water is also stubbed into this property in three different locations. We are not sure if the developer will pay the proposed fee for the irrigation or to e~tend the e~isting irrigation system to serve this future phase. Ten Mile Creek has recently had a flood study done on it. There is an area out through here that is within the area of the 100 year flood plain. We are proposing to fill that somewhat and raise it to a level above that 100 year flood plain elevation. We have submitted this preliminary plat to ACHD and their comments were that they wanted to relocate this stub out street to the south to a different location. When the original concept of Meridian Greens was presented, ACHD was contemplating a collector street to connect near the middle of the section. They have now changed their course. Explained ACHD changes. We have reviewed the conditions that are proposed by the City Engineer. Kingsford: realignment? Is there anything that lines up with that Hubble: No, there is another forty acres south of this that is undeveloped. Passed out copies of the changes Hubble would recommend about Gary Smith's recommendations. Just for the record, condition #1 said that street names will be in accord with the review of the Ada County Street Name Committee. We would just like to state that the developer is not in full agreement with the process of the street name committee. We are unsure how we are going to proceed with that. Condition #4 states that storm water discharge plan shall be approved by the Nampa and Meridian Irrigation District prior to any construction. We would like to change that to strike Nampa and Meridian Irrigation and insert appropriate drainage district. Condition MERIDIAN CITY COUNCIL JULY 7, 1992 PAGE 4 #5, states that sanitary sewer interceptor line construction across and along Ten Mile Drain will need to be done under a license agreement with Nampa Meridian Irrigation District. We are just proposing to strike that last part of the sentence. The part that reads under a license agreement with Nampa Meridian Irrigation District. Here again this may not be their jurisdiction. Condition #7, states that Ten Mile Creek should be shown as Ten Mile Drain. We would like your approval to delete that condition. Ten Mile Creek shows on numerous maps that it's the preference of the developer to name that on the Plat as Ten Mile Creek rather than Ten Mile Drain. Condition #9, states that street light locations need to be shown generally at the street intersections/fire hydrant locations or a maximum four hundred foot spacing. We'd like to strike the portion of that sentence that reads "fire hydrant locations or a ma~imum four hundred foot spacing" and insert another line that says Ucovenants shall require front yard lights with photocells. In keeping with the theme of Meridian Greens Unit #1 & #2, the developer has installed street lights at the intersections and put in yard lights out in the front yards with the photocells that come on at dark and we'd like to do the same thing here. I'd be happy to answer any questions. Kingsford: Any questions? No response. Anyone else to testify? Jack Pinkston, 2190 S. Meridian Rd., was sworn by the attorney. Pinkston: On Ten Mile Creek, which is built as a creek right now, they are going to make their property lines right down the center of the creek. Has this creek got a thirty foot easement? Or can they just close the creek off and put the border line right down the center of the creek? Kingsford: I think that's a dispute that's between the developer and the appropriate drainage district, that they are going to have to resolve. We don't deal with that. Pinkston: Now on the same Meridian District, on Faucett's property and former Evan's property they will landlock the back of that property if they put that in with no access to the back of those properties there is no way to get to those properties unless you build a bridge across the creek. Showed the Council on the map the properties to which he is speaking about. (See tape for further explanation) MERIDIAN CITY COUNCIL JULY 7, 1992 PAGE 5 Hubble: First of all in regards to the property line going down the centerline of Ten Mile Creek, the developer owns that entire property regardless of where easements may be located so the property lines for the lots will go to the centerline of that creek. It won't affect whatever easements may be there. In regards to landlocking properties to the west it was my understanding from looking at the assessor's map that the two properties extended clear out to Kuna Meridian Road. If that ownership isn't contiguous to abut to that public road then we need to taKe a look at that. I'm sure ACHD will also be concerned about landlocking that property. As far as crossing the neighbors property with the sewer line, the developer doesn't have any rights to cross that property line without permission from that adjacent property owner. That will have to be worked out. The other comment about the irrigation water that enters the property, we will provide irrigation pipelines to transfer any irrigation water through this property to the neighbors property. That will be part of the final design* As far as access to Overland Road, we do have two accesses to Overland Road, SE 3RD is the westerly roadway and then SE 5TH is in the center of that proposed layout and it accesses to Overland Road too. ACHD has said that before any additional development can occur out here that that remaining portion of SE 5TH that's not curb and guttered has to be fully improved. The developer has plans and will be in the process of constructing those last improvements here soon~ Kingsford: Thank you. Giesler: I think there was a question about having a fence going along the side, is there any plans to that affect or is that up to the homeowner to do that? Kingsford: There are no covenants requiring fencing. else to testify? Anyone Larry Bertetto, 665 Antigua, was sworn by the attorneYM Bertetto: Voiced concerns about traffic on 5TH Way. We have spent sometime on the phone seeing how we can get that controlledM We need some relief to get people to try to slow down out there6 MERIDIAN CITY COUNCIL JULY 7, 1992 PAGE 6 Kingsford: We have that same problem everywhere in town and I suspect most every town in the United States. That's a problem everywhere and the issue is you can't have a police officer on every street. Anyone else to testify? No response. I will close the Public Hearing. Giesler: I recall a comment study was being looked into. in the P & Z minutes that a traffic Is anything being done? Hubble: We did prepare a traffic study during the development process of Meridian Greens #2 and submitted that to the Highway District. In that study we've estimated the anticipated traffic Dut of all accesses to the project. Based on that we estimated that the traffic volume at the intersection of SE 3RD and Overland Road would be about 1600 vehicle trips per day. At the intersection of BE 5th and Overland would also be between 1500 and 1600 vehicle trips per day. The traffic that would exit and enter out through Mesa Way would be about 100 vehicle trips per day. Based on what ACHD has generally accepted as traffic capacity for a residential street these are within the limits. Giesler: that? Was that the entire project with #3 also included In Hubble: Yes. Kingsford: Jack a question for you, I heard mention property owners along there had opposed any street through~ that the going out Pinkston: Yes~ Kingsford: Any other questions? Larry Bertetto: Is Mesa Way being developed or not developed? Kingsford: I don't think that was discussed as an issue, they are talking about it being a hundred trips. When the connection is made he's saying the estimate is a hundred trip days. Corrie: I have a couple for the Engineer. Do you have any problems with these suggested revisions that they proposed? MERIDIAN CITY COUNCIL JULY 7, 1992 PAGE 7 Eng. Smith: I don't have any problem with the appropriate drainage agency variation from Nampa-Meridian. Nampa-Meridian, as I understand it is the maintaining agency for the Bureau of Reclamation and on other ditches that we've dealt with in the past they have been the agency that we have written license agreements with for use within their easement* However that shapes out either Bureau of Reclamation or Nampa-Meridian I don't have a problem with that. The Ten Mile Creek designation instead of Ten Mile Drain, I quess that's between the developer and the appropriate agency. I was asked my Nampa Meridian to refer to that as a drain and that's the reason for my comment. I believe they had a variance on #1 and #2 for street lights but the Ordinance states the street light requirement and that's the reason for that statement. Typically the street lights are located at approximately the same locations as fire hydrants. Giesler: I have a question for Don, the street will hook into Mesa Way then? Hubble: That street will be constructed. The Motion was made by Tolsma and seconded by Yerrington to approve the Meridian Greens #3 preliminary plat with the conditioned upon application for culdesac variance, street light variance and an agreement between the land owner and the developer with regard to the property to the west that is being landlocked. Motion Carried: All Yea: ITEM #3: PUBLIC HEARING: PRELIMINARY PLAT PARKSIDE SUBDIVISION W/VARIANCE: Kingsford: I will open the Public Hearing. present to testify? Is there anyone Don Hubble, 7025 Emerald, was sworn by the attorney. Hubble: This proposed project is located south of Cherry Lane and west of Ten Mile Road. The existing Fuller Park is on the southerly boundary. The proposed project consists of 290 lots on about 90 acres. The topography is basically flat. All roads within the project will be public roads, owned and maintained by Ada County Highway District. We will have two access points onto Cherry Lane and one onto Ten Mile Road. One main street running MERIDIAN CITY COUNCIL JULY 7, 1992 PAGE 8 through the middle of the project is a Collector Street according to ACHD classifications. We have numerous culdesacs within the subdivision, two of which are longer than the ordinance allows. The variance has been filed and we are requesting your consideration for that an the culdesac lengths. The developer will install fire hydrants as necessary in these long culdesacs so there will be adequate fire facilities. Sanitary sewer will be provided by the City. Explained where existing sewer runs - see tapeA There is approximately ten acres on the west end that the developer is proposing to install a temporary lift station to pump back to the gravity line. Then someday if a pump line or interceptor is installed down along Ten Mile Creek, it can be connected to that and gravitated out. Domestic water will be provided by the City. It too is located up in the street north of Cherry Lane and over here in Ten Mile Road. Water lines will be looped through and connected with the existing water line. The developer has not decided whether to contribute the money to the City's irrigation fund or to provide irrigation water to each of the lots. That decision will be made during the final platting. No a~eas of this project are within the 100 year flood plain. Fuller park is at the southerly end of this project* The developer is currently working with the park people to try to provide not only an access but parking facilities. I'd be happy to answer any questions. Tolsma: You say they are working on that parking lot. the parking lot was part of the original plan. I thought Hubble: There's an existing parking lot there within the Fuller Park boundary, but this new parking lot would be constructed on the developers land. That is additional parking of 90 spaces. Tolsma: The access roads that are there now are no longer going to be there then, is that correct? Hubble: That's right, existing roadways will be abandoned once this public access is connected. Tolsma: Isn't that going to make it a little unhandy sometimes for as many people that run back and forth through there that use that facility? Hubble: Where they will be entering and exiting will be on the Collector Street. Tolsma: The school accesses off of Ten Mile Road also? MERIDIAN CITY COUNCIL JULY 7., 1992 PAGE g Hubble: I'm not familiar with their plans~ Corrie: What culdesacs are you talking school if it goes in? Would you have all that area or one? about as far as the four culdesacs go into Hubble: Probably just the one, it's their choice. Corrie: So in other words we have one access through a culdesac area. into that school Hubble: If they purchase the site they are negotiating with there's another piece of property that lays between the proposed school site and Ten Mile so that the only way that they could get to this property right now would be through this culdesac through this subdivision down one of those culdesacs. '\/erri ngt on: corner? Do you plan on tiling the ditch on the northeast Hubble: it. Plans are now to leave that as an open ditch and fence Corrie: Have you seen the Engineer's comments? length variance request, he mentioned that Pine would connect to Fur Creek to eliminate one culdesacs. Has then been thought of? On the culdesac Creek possibly of those long Hubble: We wanted to provide as many lots on a culdesac street as possible. That would discourage through traffic so even though it appears as a natural connection there and what actually increased the number of lots it wouldn't provide the same affect as the culdesac lots. We are trying to eliminate the through streets. We would like to not have to connect those streets. Corrie: You may have a problem with the fire department with them not being connected. There was mention of who was going to maintain the walkways has that been resolved? Hubble: The homeowners. Corrie: On Comment #11 who owns and maintains the off site storm drainage system? That's a pretty big task for the homeowners to maintain. MERIDIAN CITY COUNCIL JULY 7, 1992 PAGE 10 Hubble: The final plans for the storm drain facilities haven't been completed yet. One of the alternatives was to try to utilize a pond on Fuller Pa~k to contain the storm water runoff~ if that's not possible another alternative is to create a pond within the project site. Listed other alternatives. Tolsma: Have you addressed his comment about the impact lift station? on the Hubble: We've been in touch with your Engineer about that and the developer will do whatever is necessary to be sure it has adequate capacity. Kingsford: Do you have an idea of which will be the fi~st phases and when you might be looking at that ten acres that might require a lift station? Hubble: That would certainly be the last phase of the westerly area that would need the lift station. Kingsford: Thank you. Anyone else to testify? Charlie Rountree, 3751 Woodmont, was sworn by the attorney. Rountree: I'm here tonight as the chairman of Western-Ada Recreation District, the caretakers and owners of Fuller Park. I'd like to start out be indicating that we have been as a Board in contact with the developer and there representative, Hubble Engineeringa I'd like to indicate they have been very up front with us about the development and have been working out the details on some of our concerns. The things we have discussed with the developer, I believe we've got resolutions to them but I think they are concerns that you folks need to look at and factor into your decision. First concern is about irrigation water. We own a third of the well that's located on Ten Mile and water is delivered down a concrete irrigation facility at this point and ultimately ends up into the pond in the park. We also get water from Eight Mile Lateral and it comes down another ditch facility and again ultimately ends up in our irrigation pond~ We have to have that water to maintain that park and the developer at this point has indicated that they would be willing to tile and provide that service to us. Parking is another issue. Right now the paved parking in Fuller Park can accommodate approximately 30 vehicles. The rest of the parking and the access into and out of Fuller Park is provided by easement~ That easement would have to be vacated or given up by the Western Ada Recreation Board prior to the development. MERIDIAN CITY COUNCIL JULY 7, 1992 PAGE 11 Kingsford: Is that now a recorded easement? Rountree: No it is not. The parking they are proposing is an additional sixty spaces at this point. The single most significant concern of the board is the handling of storm drainage. Ultimately that drainage is going to have to pass over through the park at some point. Our concerns about that drainage is that we don1t put ourselves into liability situation of receiving toxic substances from a chance occurrence of a spill in the subdivision or accumulation of oil or grease or whatever might be the case~ The developer seems to be open for discussion for that. Access will be in one way improved. This development would ultimately provide paved access into and out of the park from both Ten Mile and Che~ry Lane. We welcome the opportunity to serve a few more people out there. However, we are concerned with a couple of the access points because of the proximity to what might become an attractive nuisance, the irrigation pond. Another pedestrian access that will be on the east side, it's not going to be a problem for the park but if it ever does become developed in that area it's going to be a problem with people parking in the culdesac and accessing the park. Kingsford: Thank YOUM Anyone else? Dan Mabe, 5101 Decatur Dr., Boise, was sworn by the attorney. Mabe: I think this is an unusual opportunity for the School District, the Recreation District and the developer to work hand- in-hand. (Explained further) Tolsma: You disappointed there into that school. is two entrances and two exits Mabe: Well we have to get a primary and then we have to get an emergency or secondary access even though if it's blocked off with break-away poles so we can get emergency vehicles in. Kingsford: Thank you. Anyone else to testify? No response. I will close the public hearinga Giesler: What will happen to that well on site? Kingsford: I think that's just an irrigation well. The Motion was made by Corrie and seconded by Tolsma to have the attorney prepare Findings of Fact and Conclusions of Law for Parkside Subdivision. Motion Carried: All Yea: MERIDIAN CITY COUNCIL JULY 7, 1992 PAGE 12 ITEM #4: BODINE OIL THE-BOX) : PUBLIC HEARING: REQUEST FOR CONDITIONAL USE PERMIT BY & FOODMAKER, INC. FOR DRIVE-IN RESTAURANT (JACK-IN- Kingsford: I will open the Public Hearing and invite the representative to speak first~ Lance Saladay, Attorney for Bodine Oil, 407 W. was sworn by the attorney. Jefferson, Boise, Saladay: Presented project drawings to Council. The proposal is to construct a Jack~In~The-Box Restaurant at Fairview and East First Street here in Meridianw The location would be immediately west of the existing First Security Bank building on that same intersection. All utilities are available on site. My understanding is that the Planning and Zoning's main concern was with the traffic situation out there at that intersection. Planning and Zoning requested that the two parties here tonight work towards a solution of that traffic concern. We've approached ACHD who has jurisdiction out there, and recommended a stop sign at the flying Y portion of the intersection. ACHD has indicated that in their opinion there is no problem at that intersection and a stop sign would be inappropriate and inadvisable. As a result we are not able to deal with that traffic concern. At this point and time we have exhausted all alternatives in terms of attempting to resolve that traffic problem given ACHD's contention or belief that there is simply no problem in that area. We have also addressed some concerns with First Security Bank. I believe you received a letter from First Security stating their concerns. We have reached an agreement with First Security. The entire area is to be landscaped. With the new design and in an effort to accommodate the bank's desires to increase their lease hold property, the bank will be increasing it's occupation to the west of it's existing location in sort of a zig-zag curbed area. Explained on drawing the design and bank property. Kingsford: I understand that one one that we have is from June 24th. one. is forth coming but the only We have not received another Saladay: I do have, In my possession, a letter from them indicating their agreement to this layout and I'd be more than happy to make a copy available. MERIDIAN CITY COUNCIL JULY 7, 1992 PAGE 13 Kingsford: The ather concern I had is back in 1984 on behalf of the Bodine's I wrote a letter to Smith's Food King, at that time, Green Acres Property with regard to getting something done on that corner because it is just dirt and gravel. They said at that time their condition was that it only be paved for parking and that they did not want to see anything but that. Has that been resolved? Saladay: That is in the process. They have now sold that property very recently to Doug Kowallis and a partner of his who intend to do some knew development. We have worked with them and we are in the process of trying to finalize an agreement~ What we need to work out are some very minor things. Giesler: Asked that Mr. Saladay come up and show the access and exit points. Saladay: Access to the restaurant will be primarily to the curb cuts on E. First Street, those curb cuts would also serve the Payless stores and the old Falk's I.D. building. Primary access would be on the northern most curb cut which would then run traffic into and across the parking area somewhat to the Jack-in- the-Box - First Security Bank, it will be essentially a joint driveway. Explained further on the map presented. Kingsford: Thank you. Anyone else to testify? No response. I will close the public hearing. Mr. Crookston, do you think we have new findings? Crookston: No, but I think the traffic suggestions do. The Motion was made by Tolsma and seconded by Giesler to have the City Attorney amend the Findings of Fact and Conclusions of Law referencing the new testimony. David Leeder, attorney. 110 Parkway Drive, Boise, was sworn by the MERIDIAN CITY COUNCIL JULY 7, 1992 PAGE 14 Leeder: I'm here representing the Capital Christian Center tonight. We are proposing a pun with a zone of L-O on forty acres there on Fairview Avenue across from the business industrial park. The main access road there being N~ Hickory that would eventually tie in with Emerald Street extended. The primary purpose here is for a church but in trying to master plan the forty acre site that the church has purchased we wanted to get together with a planned unit development that would be appropriate for the church and for the property. The PUD we thought was an appropriate way to go both zoning wise and PUD wise as a transitional from the industrial to the south and the potential single family residential to the north~ It has been indicated they wanted to see Hickory extended onto the site as a Collector Street which we are in agreement with. We are also working with the developer that has option on some of the property to the west to get a more complete plan as far as what he's doing and how this could work in conjunction with him. What ditch is it that they are talking about not Leeder: Presently there's a drain ditch that is there, but all we are saying is that if we are working in the park area there with a drainage we might like to create a swail and eliminate steep banks and use it as a landscaping feature~ As far as irrigation ditches, again if they are in the area of the church where they need to be tiled or an area of intensed developed area we have no problem at all. The low bidder is Stevens and Sons Drilling Inc. of Boise, Idaho. There were three schedules to this bid. Schedule A was cable tool drilling of the well; Schedule B was reverse rotary drilling of the well; and Schedule C was drilling of a test well. The total bid is $93,290.00. It is my recommendation to award the bid to Stevens and Sons Drilling and I have received from them today their bonds for Performance and Payment and also their Certificate of Insurance. We are currently seeking from the County an approval of the planned residential development, which consists of a mixed use residential development of single family dwellings, duplexes and townhouses. We have obtained a permit to appropriate water. Our specific request this evening is to seek an endorsement of the land use concept for the project by the City of Meridian and to gain preliminary approval of a municipal sewer service. This approval would create two immediate benefits. The first of which would assure to Ada County that Meridian does in fact support the development plan and would service the units with City sewer. The second benefit would be that the approval would send a message to the adjacent neighbors that an annexation into the City is in fact achievable in the near futurea Tolsma: This plat that we received looks like there a couple of culdesacs that are terribly long, and I have a problem with that. ACCEM shall identify potential hazards affecting local governments and other jurisdictions within Ada County; prepare, keep current and distribute an intergovernmental emergency operations plan; coordinate resources before, during and after an emergency; coordinate emergency management among Ada County, its incorporated cities and other affected jurisdictions specifically including warning, communication, planning, training, public education and exercising. In addition, ACCEM shall be responsible for providing coordination and control of emergency operations as may be deemed necessary by the Executive Council from time to time; and BE IT FURTHER RESOLVED, that ACCEM shall be headed by a coordinator who shall prepare and administer a program of activities that is endorsed by the Council and shall provide support to the Council during emergency operations; and BE IT FURTHER RESOLVED, that a Local Emergency Planning Committee, hereinafter referred to as LEPC, shall be formed in accordance with SARA Title III, Section 301. The LEPC's mission shall be to support and implement SARA Title III as well as to advise the Council on matters related to emergency management; to increase local awareness, education and preparedness of all natural and technological hazards; and to provide a continuing forum through which all levels of government, business and industry, and the general public can address issues relating to emergency management. The LEPC shall establish bylaws by which it shall function and present them to the Council for adoption. The forgoing supersedes all previous ordinances and resolutions pertaining to civil defence/emergency management which conflict with the language and intent of this resolution. WITNESSETH: WHEREAS, Developers are private citizens seeking permission from City to develop an apartment complex known as Hunters Glen in Meridian; WHEREAS, the Developer has submitted an application for a rezone and conditional use of certain property described in Exhibit 11111 which is attached hereto and incorporated herein as if set forth in full, and requested the zoning of R-8 residential be changed to R-15 and has submitted plans for the subject property as required by the City; WHEREAS, the Developer made certain representations at the public hearing and meetings before the Meridian City Council as to apartment sizes, quality of construction, site amenities to be constructed, off-site improvements for access, and the rental values of the apartments that would be constructed; WHEREAS, Developer is seeking a zoning change of their property from R-8 to R-15 and are seeking a conditional use permit for the construction of Hunters Glen in three phases. Phase 1 of Hunters Glen is currently before the Meridian City Council for approval of construction of 44 apartment units of approximately 945 square feet each, with two bedrooms, 1 1/2 baths and carports, and with anticipated rentals of approximately $530.00 per month, all as more particularly described in their Conditional Use Permit Application. City is inclined to approve the Exhibit 11111 property so long as it receives assurances that the property described in Exhibit 11211 which is attached DEVELOPMENT AGREEMENT FOR HUNTERS GLEN, Page 1. RRJ/slr/07/07192(LeavellAgreement) hereto and incorporated by this reference is constructed with the quality and amenities equal to or better than those provided in the Exhibit 11111 property. Developer is desirous of obtaining approval for immediate construction of the Exhibit 11111 property and contingent approval for construction of the Exhibit 11211 property, subject to terms and conditions imposed by City; WHEREAS, the State of Idaho legislature, in 1991, passed Idaho Code 67- 6511A, Development Agreements, which provides that cities may enter into development agreements with developers upon rezoning land; that the City has not passed a development agreements ordinance, but is in the process of adopting such an ordinance; that Developer was granted a rezone and a conditional use permit based on the representations of Developer made during the rezone and conditional use permit process conducted on Developer's initial Applications; Developer subsequently desired to have the conditional use permit changed and requested the City Council to alter the conditions which lowered the standards and reduced the representations of the Developer made pertaining to the Exhibit 11111 property; it is the concern of the City that if Developer is allowed to reduce the conditions and requirements of the Exhibit 11111 property that the Exhibit 11211 property may not be constructed as represented or may not be constructed at all; that rather than go forward with the original development, developer desires to commit to development of the entire parcel of land described in both Exhibits 11111 and 11211, and does not desire to wait until a development agreements ordinance is passed by the City; WHEREAS, Developer desires the City to enter into a development agreement, even though the City does not have a development agreements ordinance in force, and is urging and pursuing this agreement so that Developer may proceed with its planned development; DEVELOPMENT AGREEMENT FOR HUNTERS GLEN, Page 2. RRJ/sl rJ07/07/92 (Leave I lAgreement) WHEREAS, the City has authority to place conditions and restrictions upon rezoning of property even though it does not have a development agreements ordinance in force; . WHEREAS, Developer deems it to be in their best interest to be able to enter into this agreement and acknowledges that this agreement was entered into voluntarily and at its urging and request; NOW, THEREFORE, IT IS HEREBY AGREED as follows: 1. The above recitals are contractual and binding on the parties hereto as if set forth herein in full. 2. This Agreement is entered into pursuant to Idaho Code 967-6511 (a), which provides for development agreements between municipal governments and developers. 3. The properties referred to herein are commonly known as Hunters Glen and identified as Exhibits 1 and 2. Developer intends to develop the Exhibit 11211 property in two phases. 4. The City has rezoned the land described in Exhibit 11111 and agrees to process Developer's request for a rezone of the parcel described in Exhibit 11211 when application is made therefore, but does not hereby commit or agree to rezone said parcel. Specifically, City has granted a zoning change from R-8 to R-15 pursuant to Ordinance No. 575 passed March 17, 1992 and a conditional use permit for the construction of the Exhibit 11111 property of Hunters Glen, subject to the terms and conditions specified by City in its Findings of Fact and Conclusions of Law passed March 17, 1992, as modified by its decision of June 16, 1992 and this Agreement. 5. Developer intends to submit an application for rezone from R-8 to R-15 and an application for a conditional use permit for the Exhibit 11211 property. Such DEVELOPMENT AGREEMENT FOR HUNTERS GLEN, Page 3. RRJ/slrI07/07192(LeavellAgreement) application shall include plans for and require Developer to construct apartment units equal or greater in size and of construction quality equal or greater than those approved by City for the Exhibit 11111 property. In addition, the application for improvements of any portion of the Exhibit 11211 property shall include and require the construction of two amenities. "Amenities", for purposes of this Agreement, shall mean: (a) the first amenity shall be a clubhouse constructed of materials equal to or greater in quality of the improvements constructed on the Exhibit 11111 property and size and type to serve all of the existing residents residing in the Exhibit 11111 property and future residents of the Exhibit 11211 property; (b) the second amenity, which shall be selected by Developer, shall be either a tennis court or a swimming pool. 6. Nothing in this Agreement shall be construed as requiring City to grant the rezone for the property described in Exhibit 11211. Upon Developer's submission of an application for development for all or any portion of the Exhibit 11211 property complying with the requirements set forth in this Agreement, City shall conduct a review and hold a hearing for Developer's. application for a rezone of the Exhibit 11211 property from R-8 to R-15 in accordance with City's ordinances and applicable state law and should City approve such rezone, the requirements imposed upon Developer in this Agreement shall apply. 7. If the rezone from R-8 to R-15 for the Exhibit 11211 property is approved and a conditional use permit is issued for any portion of the Exhibit 11211 property, Developer shall diligently pursue construction of the improvements approved and amenities required and the required two amenities shall be completed within one year of such approval. 8. That Developer agrees to abide by all ordinances of the City of Meridian and the property described in Exhibits 11111 and 11211 shall be subject to rezone to R-8 if the DEVELOPMENT AGREEMENT FOR HUNTERS GLEN, Page 4. RRJ/slr/07/07192(LeavellAgreement) owner or his assigns, heirs, or successors shall not meet the conditions contained in the Findings of Fact and Conclusions of Law, this Development Agreement, this Agreement, and the ordinances of the City. 9. This agreement shall be recorded in the Recorder's Office of Ada County, Idaho, and shall be binding on the heirs, executors, successors and assigns of the parties hereto, on all purchasers of lots or parcels of land in the property annexed and zoned property, and all persons acquiring an interest in the annexed and zoned property. 10. Developer hereby waives any and all rights it may have if this agreement is declared null and void for failure of City to have a developments agreement ordinance enacted or rules and regulations enacted governing the creation, form, recording, modification, enforcement and termination of development agreements and specifically agrees to hold City harmless and indemnify City in the event that a person or entity not a party to this agreement institutes actions or proceedings to have this agreement, or any part of it, declared null and void, including attorneys fees and costs and agrees to defend City in any such actions or proceedings. 11. This Agreement may only be amended in accordance with the requirements of Idaho Code 967-6511A. 12. This Agreement shall be deemed a covenant running with the lands above-described and shall be binding upon and inure to the respective successors and assigns of City and Developer.
