UPDATE ON MERRYWOOD SUBDIVISION:

I
am officially stepping down due to a conflict of
Jack Riddlemoser: In review of the site it indicates that the
fence along the railroad side of the property is in. The
pressurized irrigation system is hooked up and available. Dirt
has been hauled in for the berm, some of the water line for the
sprinkler system on the berm has been installed and it is evident
there is some testing being done. As far as any finish work on
the berm, considerable needs to be done and there is no
landscaping.
Kingsford:
Do you have a recommendation to the Council?
Riddlemoser: No I don't believe under these circumstances I have
a ~ecommendation.
Corrie: Roy Johnson asked for a couple of weeks to get this
completed. I assumed that he was going to have it completed by
then.
Giesler: Is there any other problems that we are not aware of or
is it just the completion they would like done?

Sheri Schweitzer, 703 N. Rotan. We did get water, it was August
1st, we did get a fence that came in August 2nd. I was afraid if
you didn't really stay on top of it the rest of it wouldn't get
finished either. We still have no front landscaping, that was a
priority you know if might promote the sale of the subdivision or
rather the rest of the lots out there.
Tolsma: Mr. Johnson said the last time when we had this down
here we discussed a $300.00 fine and I'd suggest to you that if
its not done post-haste then I think that's fair. It was
supposed to be completed in two weeks. Maybe if we instituted
the fine it would be done a little faster.
Bill Hammons with Caldwell Banker - Aspen Realty. I believe the
fine is probably in order, I don't think she has any problem with
that. Mrs. Arnold will be returning tonight and she does send
her apologies. I have a little problem with it. If our
landscapers would have performed, it would have been done.
Explained reasons for landscaping not being done yet.
Kingsford: I recommend that the Council vote the $300.00 fine
starting tomorrow.

institute the $300.00 a day fine against Merrywood Subdivision.

ORDINANCE VACATING EASEMENTS IN

EASEMENTS AS FOLLOWS: 1. ONE EASEMENT BETWEEN LOTS 1 AND 2,
BLOCK 1, SETTLERS VILLAGE, AND 2. ONE EASEMENT BETWEEN LOTS 2 AND
3, BLOCK 1, SETTLERS VILLAGE, MERIDIAN, ADA COUNTY, IDAHO; AND

ITEM #6: PUBLIC HEARING: AMENDMENT TO THE 1991/92 FISCAL YEAR
BUDGET:
Kingsford: I will open the Public Hearing. Is there anyone
present who wishes to testify? Again for the audience, we had
more money come in from building permits than what we estimated a
year ago as we set the budget. There are some projects that need
to be done so we are amending the budget to accommodate some of
those. No response. I will close the public hearing.
ITEM #7: ORDINANCE #583: ORDINANCE AMENDING 1991/92 FISCAL YEAR
APPROPRIATION ORDINANCE:
Kingsford: AN ORDINANCE OF THE CITY OF MERIDIAN, IDAHO AMENDING
ORDINANCE NO. 554, THE APPROPRIATION ORDINANCE FOR THE FISCAL
YEAR BEGINNING OCTOBER 1, 1991 AND ENDING SEPTEMBER 30, 1992;
APPROPRIATING ADDITIONAL MONIES THAT ARE TO BE RECEIVED BY THE
CITY OF MERIDIAN, IDAHO, IN THE SUM OF $815,600.00 AND PROVIDING
AN EFFECTIVE DATE: Is there anyone who wishes Ordinance #583

ITEM #8: MOFFITT & BRATTON MACHINE SHOP:
GRANDFATHER RIGHTS FOR LEMKE PROPERTY:
REGARDING TRANSFER OF
Kingsford: You've had some information do you have any questions
you might want to ask Counsel?
Corrie: Max and I went to Boise to the Machine Shop and saw
their facilities down there. It's a very clean, nice facility
and I would recommend that we do extend the grandfather rights to
the Moffitt and Bratton Machine Shop.
Giesler: It is a very professional business and is first class
and I also recommend that we approve this.
Yerrington: There has also been an offer from another concern
interested in this property for a different use.
Giesler: I would hate to
nothing going in there.

If we approve it, will if be brought up to code?
Kingsford: I would think it would. I'm not totally sure that it
would be appropriate to put a new building in that area.

Bratton Machine Shop.

ITEM #9:
DELINQUENCIES:
PRE-TERMINATION
HEARING:
WATER/SEWER/TRASH
Kingsford: This is to inform you in writing, if you choose to
you have a right to a pre-termination hearing at 7:30 p.m.,
August 4, 1992 before the Mayor and City Council, to appear in
person to be judged on the facts and defend the claim made by the
City that your water, sewer and trash bill is delinquent. This
service will be discontinued on August 12, 1992 unless payment is
received in full. Is there anyone from the public who would like
to contest their water, sewer and trash delinquency? No response.
The Motion was made by Tolsma and seconded by Yerrington to
approve the turn off list.
Motion Carried: All Yea:
Kingsford: They are hereby informed that they may appeal or have
the decision of the City reviewed by Fourth Judicial Court
pursuant to Idaho Code, even though they appeal their water will
be shut off. The amount of the turn off list this month is
$8,683.95.

DEPARTMENT REPORTS:
Eng. Smith: They are started on the test well over at Well #14
site today. They are down about 300 feet and are finding some
good materials. The booster pump, as of this morning I have been
told scheduled to be here FridaYM

Walt Morrow, Transportation Chairman: Our next meeting that I
represent you at will be on August 10, 1992 so any adjustment
that we need to make in the budget on items that concern us,
after we've reviewed them this evening I will make it at that
time.

In January our Transportation Committee met, we have a list of
ten items that we felt were really important for our area: 1)
Reconstruct of N. Locust Grove from Fairview north to Chateau,
investigate a signal at Fairview and Locust Grove; 2) To conduct
a study to resolve the Meridian Road/Waltman Lane/E~ First
intersection; 3) Reconstruct Cherry Lane from Linder to Blackcat
Rd.; 4) Reconstruct Eagle Road from Fairview north to Chinden.
The current status of that is the Idaho Department of Highways
has indicated that that project is being funded for sometime in
1995. I personally think that that's three years away, that's a
long time to go on a two lane, high speed road with increased
traffic. 5) Reconstruct Franklin Road from Meridian Road through
Linder Road, study signal light warrant at Franklin and Linder
intersection; 0) Reconstruct Overland Road from Kuna Meridian Rd_
east to Eagle Road; 7) Reconstruct N. Meridian from Ustick to
Chinden Blvd.; 8) Reconstruct and upgrade the railroad crossing
at Meridian Street; 9) Construct a study of roads in Old Town
area to alleviate water surface drainage problems, pedestrian
safety problems; 10) Construct a third east bound lane for 1-84.
Not much is happening on the East bound lane of 1-84. We do have
some things going. I will review the budget now for 1993.
Projects that are in the design budget under minor bridges,
there's $20,000.00 funded for Cherry Lane west of Linder;
$20,000.00 funded for McMillan east of Meridian; $20,000.00
funded for Meridian south of Franklin; That's the three major
bridges that would be designed in 1993~ Roadway Projects-
Cherry Lane from Linder to Blackcat for 1993 a design budget of
$160,000.00. From McMillan between Eagle and Cloverdale, a
design budget of $90,000.00. For Meridian/E. First/Waltman a
design budget of $20,000.00, I might add that the contract for
that has been awarded to CH2M Hill. That's an on-going design
process that has already begun. These monies would be to pay for
the finish of that study. In terms of construction projects for
1993, the Ten Mile Bridge over the Ridenbaugh $206,000.00 has
been budgeted; The Meridian railroad crossing, which is just down
the street here, $80,000.00 has been budgeted; McMillan, Eagle,
Cloverdale Road Phase I $300,000.00 has been budgeted;
Fairview-Locust Grove, that's the public hearing that was held on
Friday, with the preliminary design work having been done by CH2M
Hill, $110,000.1210 btJdgeted to do that work~ Meridian, E. First,
and Waltman, $175,000.00 has been budgeted for construction in
1993. Also for Fairview and Locust Grove traffic signal,
$40,000.00 has been budgeted for that project. What we are also
doing now at ACHD is we finally have convinced them over the last

couple of years that it might make a certain amount of sense to
start budgeting a little farther in the future, where that comes
into play here, this would be 1994 budget priorities that apply
to us. Cherry Lane bridge west of Linder $75,000.00; McMillan
bridge east of Meridian - $75,000.00; Meridian south of Franklin
- $75,000*00; That's the construction of the three bridges that
were funded for design purposes in 1993. In terms of Cher~y Lane
from Linder to Blackcat - the actually construction would occur
in 1994, $1,310,000.00 has been budgeted for that. For McMillan,
Eagle Rd., Cloverdale - $8&0,000.00 - $600~000.00 of that would
be for construction and $250,000.~0 for right of way. Franklin
Road from Meridian to Linder - $229,000.00 would be budgeted. In
1994, $104,000.00 of that is design and $125,000.00 is right of
way acquisition. The Meridian area interconnect where the CA &
AQ funds $350,000.00 which is basically the funds from the
federal government for the non-attainment counties that there's
kind of been a little rollover lately with the Idaho
Transportation Department. Our area for bike paths, for a park-
n-ride facility, those funds would amount to $350,000.00 and
that's budgeted for 1994. In terms of 1995, design Meridian
south of McMillan bridge - $97,000.00; Ten Mile north of Ustick -
$97,000.00; Blackcat Road from Cherry Lane to UstiCH
$838,000.00 for reconstruction; then Franklin Road from Meridian
to Linder - $980,000.00, $80,000.00 for right of way for a total
of $1,060,000.00 - so basically that's the major projects that
are budgeted for over the next couple of years from ACHD. Do you
have any suggestions or any different direction that you want me
to go? I should bring you up to status that Overland Road from
Meridian Kuna Highway to Eagle is now being designed to the five
lane status so that any new coming subdivisions or industries can
put in their curb, gutter, sidewalks and their share of the
roadway. I have talked with Walt Casey of the Cherry Lane
Homeowners Association. I've asked him to head up the private
sector with the Cherry Lane people so that when we put together
the design data for Cherry Lane from Linder to Blackcat that they
have input into that system and we can see what we can do in
terms of resolving the problem with the canals and the ditches.
I've also asked Walt to check into what the job status in the
Meridian area is. The idea there being that I think as soon as
we approach a job neutral position that we should be able to do a
better job of negotiating our share of the impact fees so that we
don't have to spend them so far to the east. He is going to meet
with the Chamber of Commerce and see if we can't develop those
statistics and find out just where we are at. A couple

things that we do need from the City Council is is that we are
going to be coming up with a Comprehensive Plan Amendment within
that Plan Amendment we need to in the Transportation section
delineate our section line roads to be 80 ft. right of ways with
five lane construction. We also need to change some of the
naming and terminology on the existing roads that we have in
there. We need support from the Council to get those things
accomplished. The last thing is that is may help us with ACHD to
have a letter from the Council supporting those changes. Any
questions or comments?
Tolsma: On the Eagle Road project, isn't that State of Idaho,
Department of Transportation, that's not an Ada County
jurisdictionM
Morrow: That's correct it's not, but we testified at the
hearings and as a City and a City Transportation Committee and as
also ACHD, it seems that that issue probably is a political issue
that needs to be dealt with by Ada County as a whole to bring
some pressure on the Department of Highways. Apparently they
don't understand how critical the road is in terms of traffic
accidents, property damage, general p~oblems. We just can't seem
to get the thing funded to get actual construction going within
the near future.

Morrow: In the past we've had some problems with some citizens
in terms of conflict of interest and those kinds of thingsa I
think for the record I want to state right now that Bob and I are
currently working on a redesign at his project and I think that
even though it's a little unusual at this stage to make those
things public, certain things could happen before we meet again

and so I'd like to see that the City Council and the general
public is aware of the fact that we are involved in designing a
project for his place of business. Should that project be
decided to go forward then we would ask the City Council to hire
an outside building department and building inspector to handle
both the on-site inspections and to handle the plan checks so
that none of that would occur within the City of Meridian and
that it would be paid for by he and I. Is that satisfactory

WHEREAS, the City Council and the Mayor of the City of
Meridian, Idaho, have concluded that it is in the best interest
of said City to vacate the two easements in Settlers Village,
specifically 1. one easement between Lots 1 and 2, Block 1,
Settlers Village, and 2. one easement between Lots 2 and 3, Block
1, Settlers Village.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO:
Section 1:: That pursuant to Section 50-1306A,
specifically, and Title 50, Chapter 13, Idaho Code, generally,
the City of Meridian, having held the required~aring and it
appearing that proper notice of said hearing was given, hereby
vacates one easement between Lots 1 and 2, Block 1, Settlers
Village, and one easement between Lots 2 and 3, Block 1, Settlers
Village, Meridian, Ada County, Idaho.
Section 2: WHEREAS, there is an emergency therefor, which
emergency is hereby declared to exist, this Ordinance shall take

Gentlemen:
Thank you for your time and assistance during the pretreatment inspection conducted on July 3, 1991.
The main purpose of the inspection was to evaluate your facility's compliance with pretreatment
regulations contained within Title 8, Chapter 14 of the Boise City Code. Based on inspection
observations, Moffit and Bratton appears to pose little threat to the municipal collection and
treatment systems. However, periodic inspections will continue as a service to you to ensure your
facility's compliance with Boise City codes.
The City recognizes and appreciates the efforts put forth by industrial/commercial dischargers to
ensure continued compliance with the General Pretreatment Regulations. Please keep up the good
work and continue an environmentally-minded management approach in handling waste streams
generated at Moffit and Bratton Auto Machine Shop.

Non-Conforminq Buildinqs, Structures and Uses: Any lawful
building, structure or use existing at the time of the
enactment of this Ordinance may be continued, even though
such building, structure or use does not conform to the
provisions herein for the district in which it is located.
Whenever a district shall be changed hereafter, the then
existing lawful use may be continued but subject to. the
provisions of this Ordinance.
3.
Buildinq Permits: Where a building permit for a building or
a structure has been issued in accordance with law prior to
the effective date of this Ordinance, and provided that
construction is begun within ninety (90) days from such
effective date and diligently pursued to completion, said
building or structure may be completed in accordance with
the approved plans on the basis of which the building
permit was issued, and further may upon completion be
occupied under a Certificate of Occupancy by the use for
which originally designed, subject thereafter to the
provisions of this Ordinance. (Ord. 430, 4-2-84)

USE AND BULK REGULATIONS
1. Use: A building, structure or land shall hereafter be used
or occupied, and a building or part thereof, or other
structure, shall be erected, raised, moved, reconstructed,
extended, enlarged or altered only as in conformity with
the regulations herein specified for the district in which
it is located. Exceptions to the use and bulk regulations
of this Ordinance shall be only by Variance.
2.
Bulk: All new buildings and structures shall conform to the
regulations established herein for the district in which
each building shall be located except as otherwise
permitted in this Ordinance by Variance. (Ord. 557,

LOT COVERAGE
1.
Maintenance of Yards, Courts and Other Open Spaces: The
maintenance of yards, courts, other open spaces and minimum
lot area legally required for a building shall be a
continuing obligation of the owner or his successor in
title of such building or of the property on which it is
located as long as the building is in existence.
Furthermore, no legally required yards, courts, other open
space or minimum lot area allocated to any building shall
(by virtue of change of ownership or for any other reason),
be used to satisfy yard, court, other open space or minimum
lot area requirements for any other building.

Due to the City receiving additional funds from the increase
in building, plumbing, electrical and related fees, the City
collecting Impact Fees for ACHD, and receiving the Grant for the
Downtown Project Phase II, and the Gem Community Grant, it is
recommended that both the General Fund and the Enterprise Fund
1991/92 Fiscal Year Budget be amended.
The City needs to show the expenditure for the Downtown
Project Phase II as well as there is the possibility of the
purchase of an additional park for which we need to budget, as
well as budget some additional funds for the Fire Department to
cover the Hepatitis B Shots and the Cooley property. Below is

MISS MERIDIAN SCHOLARSHIP PAGEANT PROCLAMATION
WHEREAS, Meridian supports the Miss Meridian pageant which is
celebrating its 10th year of providing scholarships to
Meridian area young ladies;
WHEREAS, The Miss Meridian Scholarship Pageant has awarded more
than $14,000 in scholarship money over the past nine
years, more than any other local pageant in the State of
Idaho;
WHEREAS, the Miss Meridian Pageant is much mot'e than a beauty
pageant as judging of contestants is based 40% on their
talent, 30% on their personal judges interview and the
remaining 30% based on modeling, poise and physical
fitness.
WHEREAS, This is the 10th year of the Miss Meridian Scholarship
Pageant and seven out of nine previous Miss Meridians,
including Holly Hill, Kendra Ruwe, and Stephanie Smith,
all three of whom went on to becorne Miss Idaho. are
planning to return to Meridian to participate in and help
celebrate the 10th anniversary of the Pageant;
NOW, THEREFORE, I, GRANT P. KINGSFORD, Mayor of the City of
Meridian, Idaho, do hereby proclaim the week of August 9 to August
15, 1992 as
MISS MERIDIAN SCHOLARSHIP PAGEANT WEEK
