However, Grantee shall not be responsible for repairing, replacing or restoring anything placed within the area described in this easement that was placed there in violation of this easement. THE GRANTOR covenants and agrees with the Grantee that should any part of the right-of- way and easement hereby granted shall become part of, or lie within the boundaries of any public street, then, to such extent, such right-of-way and easement hereby granted which lies within such boundary thereof or which is a part thereof, shall cease and become null and void and of no further effect and shall be completely relinquished. THE GRANTOR does hereby covenant with the Grantee that Grantor is lawfully seized and possessed of the aforementioned and described tract of land, and that Grantor has a good and lawful right to convey said easement, and that Grantor will warrant and forever defend the title and quiet possession thereof against the lawful claims of all persons whomsoever. Additionally,the applicant has reduced the number of buildable lots in this phase by one(1) compared to the preliminary plat. The applicant also revised the phasing plan to allow required access points to be constructed in different phases. Although this represents a deviation from the approved phasing plan, staff has discussed the modification with the applicant and determined that the change is primarily driven by market demand considerations and the desire to provide a second access point to the subdivision. Because the number of buildable lots has decreased by one(1) and the amount of common open space has increased slightly, staff finds that the proposed final plat remains in substantial compliance with the approved preliminary plat, as required. A non-resident fee is a"fair-share" fee that reflects the investment Meridian residents make through city taxes to support Parks & Recreation facilities and services. The fee would apply to eligible programs, shelter reservations, field reservations, and facility rentals, ensuring that individuals who live outside the city limits contribute to the cost of city-funded amenities. Over the past several months, staff has evaluated our current registration and reservation software (Recl)to determine the feasibility of implementing a non-resident fee. Our review confirmed that the system has the capability to administer this fee. While implementation would involve some additional software costs, those expenses would be offset through revenue generated once a non-resident fee policy is established. The proposed policy was presented to the Parks &Recreation Commission, who reviewed and supported the current proposal. Objective To present the proposed non-resident fee policy and receive Council feedback. Based on Council's direction, staff will make any necessary revisions to the proposed policy and, if needed, return the policy to Council for additional review and feedback prior to implementation. Once the policy is adopted, all future applicable Parks & Recreation fees presented to Council will include corresponding non-resident fees in accordance with the established policy. Costs and Estimated Additional Revenues -Our current Registration and Reservation Software called "Civic Rec" is $8,000 annually and has a component we can add to it called ArcGIS. The purchase of ArcGIS for the non-resident capabilities will be an additional $1,500 a year. If our proposed Non- Resident Policy is established, the best time to activate these fees would be October or November of 2026. This allows our department to advertise the new fees and promote the new fees to all users prior to the winter activity guide and the first of the year. Shelter Reservations (2025 numbers) Out of the 2,490 reservations we had, 660 of them were non-residents. Using our total 2025 shelter reservation revenues ($285,574) and the 2,490 reservations, we can estimate the impact of a 20% increase on the 660 non-resident reservations.
