NOTICE OF SPECIAL MEETING
NOTICE IS HEREBY GIVEN that the City Council of the City of
Meridian will hold a special meeting at 7 : 30 0' clock p.m.,
Tuesday, October 13, 1992, at Meridian City Hall, 33 East Idaho,
Meridian, Idaho. The purpose of said meeting is to meet with the
Meridian Planning and Zoning Commission at its regularly scheduled
meeting on the above date and time and take any action required.
Representatives of the Ada County Highway District will make a
presentation regarding strategic planning for the Ada County
Highway District.
The public is welcome but no comment or testimony will be
taken regarding the above matter.

FINDINGS OF FACT AND CONCLUSIONS
The above entitled matter having come on for public hearing
September 15, 1992, at the hour of 7:30 o'clock p.m., the
Petitioner appearing through Guy Walker, the City Council of the
City of Meridian having duly considered the evidence and the
matter makes the following Findings of Fact and Conclusions:
FINDINGS OF FACT
1. That a notice of a public hearing on the Rezone and the
Conditional Use Permit Application was published for two (2)
consecutive weeks prior to the said public hearing scheduled for
September 15, 1992, the first publication of which was fifteen
(15)
days prior to
said hearing;

that the matter was duly
considered at the September 15, 1992, hearing; that the public was
given full opportunity to express comments and submit evidence;
and that copies of all notices were available to newspaper, radio
and television stations;
2 . That this property is located within the City of
Meridian and the Applicant is the owner of record of the property
which property is described in the application which description
is incorporated herein; that the property is now zoned R-4; the
area in which Applicant's property is located is developed as an
R-4 Residential subdivision; that the property to the east lS

L-O and is used for dental offices; the property to the north and
west is residential property zoned R-4; the property to the south
is Meridian Middle School.
3. That the Applicant requests that the property be re-
zoned from R-4 to L-O Limited Office; that the Applicant has
submitted a Conditional Use application for the operation of a day
care center; that the Meridian Planning and Zoning Commission
recommended that the rezone be denied and, since a day care center
is not an allowed use in the R-4 Zone, the conditional use permit
for a day care center also be denied.
4. That a day care center is not a permitted use in the
R-4 District; the Limited Office Zone requires a conditional use
permit for the operation of a day care center caring for thirteen
(13) or more children, which is the use the application requests;
that such use requires a conditional use permit in any zone where
allowed.
5. That the L-O District is described in the Zoning
Ordinance, 11-2-408 B. 5 as follows:
(L-O) LIMITED OFFICE DISTRICT: The purpose of the (L-O)
District is to permit the establishment of groupings of
professional, research, executive, administrative,
accounting, clerical, stenographic, public service and
similar uses. Research uses shall not involve heavy testing
operations of any kind or product manufacturing of such a
nature to create noise, vibration or emissions of a nature
offensive to the overall purpose of this district. The L-Q
District is designed to act as a buffer between other more
intense non-residential uses and high density residential
uses, and is thus a transitional use. Connection to the
Municipal Water and Sewer System of the City of Meridian is
a requirement in this district.

neighborhood as designated on the Policy Diagram at Page 7 of the
Meridian Comprehensive Plan; neighborhoods are defined in the Plan
at Page 6 and states as follows:
"Definition: The neighborhood is a residential area with
uniform characteristics of a size comparable to that usually
served by an elementary school or a small business
convenience center or a local park. Although neighborhoods
occur in various shapes and sizes, a section of the City
measuring one-half to one and one-half miles across is
usually used for planning purposes. It has facilities within
easy walking distances and provides the basis for community
identification."
7 . That the use proposed by the Applicant is set forth
above, which is to provide a day care center for 35 children
between the ages of infant to three years of age.
8. That the subject property has previously been used as
a residence; that the structure on the premises is designed as a
single-family dwelling; that the property is 'not fenced but the
applicant shows a proposed new fence in the front yard of the
property; that the proposed fence is a chain-link fence that the
Applicant proposes to construct to a height of approximately six
feet next to the sidewalk along Cherry Lane; that the Meridian
fence Ordinance requires that fences in the front yard be a
maximum height of three feet if closed vision and a maximum of
four feet if open vision; that the Ordinance also requires that
in the sight triangle that the fence, regardless of open vision
or closed vision, be a maximum, height of three feet; that the
height is measured from the crown of the adjacent road for fences
in the front of the property; that the Applicant's representative
testified that the ground level of the property is approximately
eighteen inches (18") below the level of the road.

9. That the property has no irrigation canals but does have
an irrigation facility on the property which is a diversion box;
that there are no visible hazardous areas on the property.
10. That the Applicant, in her original drawing of the
proposed layout of the facility, proposed to have two access
points on Cherry Lane; the eastern access was a very short
distance from the 11th street intersection with Cherry Lane; that
vehicular access under the original drawing was a problem and the
proposed use required greater better access. That access to the
property is now proposed to be from the Cherry Lane access farther
to the west and the Applicant has designed a driveway that
encircles the property with an entrance on Cherry Lane and an exit
on 11th Street from the back of the property; Cherry Lane is a
principal arterial and carries a substantial amount of traffic.
11. That sewer and water is already connected to the
property, but the use may require additional charges or fees.
12. The City Engineer, Central District Health Department,
Nampa & Meridian Irrigation District, Meridian Fire, Sewer, and
Police Departments submitted comments which are incorporated
herein as if set forth in full herein.
13. That Ada County Highway District submitted comments
which are incorporated herein as if set forth in full herein; that
the comments indicated that the access as originally proposed by
the Applicant was not acceptable and that the parking in the front
was insufficiently designed; that the Applicant has significantly
modified her original plan.

is located was approved within the past year and one-half; that
there were no residents in the residential area that appeared
objecting to the application.
15. That there is a dental office on the property east of
the subject property which is zoned Limited Office; that there is
a church farther to the west of Applicant's property.
16. That there was testimony from Jane Davlin, who is not
a resident of the area, objecting to the operation of the day care
the Applicant operates on Crestmont Drive in Meridian and implying
that the operation of the subject facility would be in the same
fashion.
17. That there was testimony from the owner of the property
adjacent on the west, Pat Fujii; that her concern was that she
desired that a six foot fence separate the properties or keep the
hedge if it is properly maintained.
CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicants'
property.
2. That the City has the authority to take judicial notice
of its own ordinances, other governmental statutes and ordinances,
and of actual conditions existing within the City and state.
3. That the City of Meridian has authority to place
conditions upon granting a zoning amendment.

amendment upon the basis of guidelines contained in Section 11-2-
416 of the Revised and Compiled Ordinances of the City of Meridian
and upon the basis of the Local Planning Act of 1975, Title 67
Chapter 65, Idaho Code, the Comprehensive Plan of the City of
Meridian, and the record submitted to it and the things of which
it can take judicial notice.
5. That Section 11-2-416 A. states in part as follows:
"When the public necessity, convenience, general welfare or
zoning and development practice require, the Council .
may amend, supplement, change" or repeal the regulations,
restrictions, and boundaries or classification or property
as well as the regulations and provisions of this Ordinance."
6. That 11-2-416 (K) of the Revised and Compiled Ordinances
of the City of Meridian sets forth standards under which the City
shall review applications for zoning amendments; that upon a
review of those requirements and a review of the facts presented
and conditions of the area, the City Council specifically
concludes as follows:
(a) The L-Q zoning would be harmonious with and in
accordance with the Comprehensive plan since the
property is included in the CAIRNS Neighborhood and the
Comprehensive Plan describes a neighborhood as a
residential area served by an elementary school or a
small convenience center or a local park.
(b) The area was not intended to be rezoned in the future
but there is a parcel of property adjacent to the east
that is already zoned Limited Office.
(c) The area included in the proposed zoning amendment is
intended to be developed in the fashion that would be
allowed under the proposed new zoning.
(d) There has been one change in the area or adjacent areas
which dictate that the property could be rezoned, that
is the dental office that is adjacent to the east.
(e) That the property, if designed and used as allowed in
the L-Q District and as it presently exists, would be
designed and constructed to be harmonious with the

surrounding area, which is developed in the R-4 fashion.
(f) The L-Q use would not be hazardous to the existing or
future uses of the neighborhood.
(g) The property, if developed in the L-Q fashion, would be
able to be adequately served with most public
facilities.
(h) L-Q development would not create excessive additional
requirements at public cost for public facilities and
services and would not be detrimental to the economic
welfare of the community.
(i) The proposed use would not involve uses, activities,
processes materials, equipment or conditions of
operation that would be detrimental to any person,
property or the general welfare of the area however the
traffic would be increased more than it would be under
R-4 development.
(j) Development in the L-O district, and particularly as
planned by the Applicant, would cause an increase in
vehicular traffic over and above what the traffic
increase would be if developed as R-4.
(k) That a rezone would not result in the destruction, loss
or damage of any natural or scenic feature of major
importance.
(1) The proposed zoning amendment 1S ln the best interest
of City of Meridian.
7. That the City has judged this Application for a zoning
amendment upon the basis of guidelines contained in Section 11-2-
416 of the Revised and Compiled Ordinances of the City of Meridian
and upon the basis of the Local Planning Act of 1975, Title 67
Chapter 65, Idaho Code, the Comprehensive Plan of the City of
Meridian, and the record submitted to it and the things of which
it can take judicial notice.
8. That 11-2-418(C) of the Revised and Compiled Ordinances
of the City of Meridian sets forth the standards under which the
City Council shall review applications for Conditional Use
Permits; that upon a review of those requirements and a review of

the facts presented and the conditions of the area, the Ci ty
Council concludes as follows:
a. The use, would in fact, constitute a conditional use and
a conditional use perIni t would be required by ordinance.
b. The use would be harmonious with and in accordance
with the Comprehensive Plan but the Zoning
Ordinance requires a conditional use permit to
allow the use.
c.
The use would be designed and constructed

traffic will increase because of the proposed day care
center, but due to the drop-off and pick-up being off
of Cherry Lane or 11 th Street it should not be a

requirements at public cost for public facilities and
services and the use would not be detrimental to the
economic welfare of the community.
g. The use would not involve a use, activity, process,
material, equipment or conditions of operation that
would be detrimental to person, property or the general
welfare by reason of excessive production of traffic or
noise.

met and the boundary separation between Applicant's property and
that of Mr. and Mrs. Fujii shall be worked out to the satisfaction
of Mrs. Fujii; that the driveway shall be signed so that it is a
one way drive with traffic entering from Cherry Lane and exiting
onto 11th street.
11. That the testimony of Jane Davlin regarding the
operation of the Applicant's other day care facility is not a
grounds for denial of the rezone or of the conditional use permit
in that the testimony pertained to licensing issues which the City
of Meridian does not perform; the testimony is however appreciated
and Mrs. Davlin is encouraged to approach the Department of Health
and Welfare with her concerns; it is also suggested to the
Applicant that she personally investigate the complaints and
determine whether corrective action needs to be taken.
12. That due to the location of the day care facility on
Cherry Lane, it is also a condition of the Conditional Use Permit
that an adult shall at all times accompany one or more children
playing in the front yard of the day care facility.
APPROVAL OF FINDINGS OF FACT AND CONCLUSIONS
The Meridian City Council hereby adopts and approves these
Findings of Fact and Conclusions of law.

DECISION
The Meridian City Council hereby approves the Rezone and the
Conditional Use Permit requested by the Applicant for the property
described in the application with the conditions set forth in
these Findings of Fact and Conclusions of Law and that the
property be required to meet the water and sewer requirements, the
fire and life safety codes, and the Uniform Building Code, and
other Ordinances of the City of Meridian, including that all
parking areas shall be paved and the fence Ordinance shall be met.
The conditional use permit shall be subject to annual, or
periodic, review upon motion by the City, and all children shall
be dropped off and picked up in the parking area in the back of
the property.

dwellings shall be allowed, construct water and sewer line
extensions to serve the property, and construct streets to and
within the property, meet the requirements and conditions of the
Findings of Fact and Conclusions of Law and of this Ordinance; if
Applicant fails to meet these conditions the property shall be
subject to de-annexation, which conditions subsequent shall run
with land and also be personal to the owner.
Section 3.
That the City Clerk shall cause one (1) copy
of the legal description, and map, which shall plainly and clearly
designate the boundaries of said property, to be filed with the
Ada County Recorder, Ada County Assessor, and the State Tax
Commission within ten (10) days following the effective date of
this Ordinance.

AN ORDINANCE OF THE CITY OF MERIDIAN AMENDING THE REVISED AND
COMPLIED ORDINANCES OF THE CITY OF MERIDIAN BY REPEALING SECTION
1-704 AND RE-ENACTING SAID SECTION 1-704, TO SET FORTH THE TIME
AND PLACE OF CITY COUNCIL MEETINGS; AND PROVIDING AN EFFECTIVE

WHEREAS, the Mayor and the City Council of the City of
Meridian, State of Idaho, have concluded that it is in the best
interest of the said City to amend the Revised and Compiled
Ordinances of the City of Meridian by repealing Section 1-704 of
the Revised and Compiled Ordinances, and re-enacting said Section
1-704 of the Revised and Complied Ordinances of the City of
Meridian.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO:
SECTION 1: That Section 1-704, TIME AND PLACE OF
MEETINGS, is hereby repealed.
SECTION 2: That Section 1-704, TIME AND PLACE OF
MEETINGS, is hereby re-enacted and shall read as follows:
1-704: TIME AND PLACE OF MEETINGS: The regular meetings of
the City Council shall be held at the Meridian City Hall at
33 East Idaho Street, by the Mayor and City Council on the
first and third Tuesday of each month at seven thirty o'clock
(7:30) P.M. of said days. If the said first or third Tuesday
of any month is a holiday, the meeting shall be held the
evening following at the same hour and place and in the event
the said first Tuesday of November is an election day,
Meridian City or general election, the meeting shall be held
the following Wednesday at the same hour and place.

Dear Mr. Neimann,
On behalf of Kevin Howell, we respectfully request that the 28-acre parcel shown on the
attached map be provided with sewer and water service from the City of Meridian. The
intention of our client is to develop this property into a residential subdivision.
Please note that the City's 18" trunk sewer, which is proposed along the South Slough,
could be extended through this subdivision to Locust Grove. Also, domestic water would
be extended north from Hunter's Points to serve this property. If I can be of any
