Members of The Meridian City Council
As long time residents and taxpayers of Ada County currently
residing in the City of Meridian's area of impact, we are greatly
concerned about the activities being conducted at 1580 West
Overland Road. Our concerns are as follows:
1. Our neighbor was told that the property has been zoned "Light
Industrial It and it was not necessary to notify neighboring
residents regarding the start-up of business operations at the
above ci ted location, which began during the Memorial Day
weekend of this year. Is this correct?
2. What is the cri teria that a "Light Industrial" business within
the Me~idian City Limits has to meet to conform to zoning
rules and regulations?
3. Since we are in the City of Meridian's Impact Area and are
zoned as Rural Residential, what obligations do businesses
within the Meridian City Limits have to meet in order to not
adversely impact our property values? Shouldn't we have had
the right to express our concerns prior to zoning and/or start
up of the business?
4. Has the business located at 1580 West Overland Road filed all
nece ssary building permi ts, archi tectural drawings or
prospectus showing his intent to comply with zoning rules and
regulations? Isn't this supposed to be public information?
5. Is it permissible for people to live on land zoned Light
Industrial? The property in question has two fifth-wheel
camper trailers on it which appear to be occupied. These
trailers don't appear to be hooked up to any sani tation
facility (e.g. septic tank or sewer).

6. What are the City of Meridianls ordinances pertaining to noise
and dust abatement? The business at this location operates
from sun-up to sun-down, which during the summer months means
that heavy equipment, large truck traffic (flat bed trucks,
cement mixers etc.) started as early as 6:00 a.m. and didn't
cease until after 9:00 p.m. It also was not uncommon for
operations to continue throughout the summer 6 days a week and
sometimes even 7. Because the type of work being done, dust
is a serious problem during the dry summer months, making it
impossible to open windows or go outside wi thout becoming
covered with dirt.
7. Was an environmental impact study done prior to the start-up
of this business? The property had a live stream on it,
'tvhich now seems to have been obliterated. There are also
above ground gasoline and diesel storage tanks on the
property. What is being done to assure protection of the
surrounding area and ground water from these contaminants?
8. We were told that a registered letter had been sent to the
owner of the property regarding his non-compliance to zoning,
particularly as it pertained to landscaping and screening this
ugly eye sore from view and that the owner's attorney had
responded? What was this response?
The owner of this business has made no attempt to turn this
property into anything other than ugly eyesore and" junk" continues
to be dumped on the property - such as two broken windmills laying
on the ground, vehicles with no engines parked along Overland Road,
piles of dirt and concrete waste. Is this business going ,to be
forced to comply to City zoning regulations?

The group forrned 6 years ago, and those years have been filled
with activities connected v1ith the collection and preser'vatlon
of Meridiarl area historical information and items. OIJr official
boundaries co-jncide with those of the Merldian Rural Fire
D1 stri ct;
During those 6 years we have been very busy-
Our first project, wlth a grant from the National- Parks Servlce
was a reconnaisance study of the buildings in Meridian)
identifying those structures that were still standing that were
here in 1926-the year the first sewer was installed-and also
US] ng the sewer assessrrlerlt r.ecor.ds whi ch sf-lowed the earl i est
legal descriptions of existing property without having to do
weeks of deed research to get the same information.
We have an ongolng project of extractlng details from early
Statesman, Evening Capitol News and the existing Meridian
Times into categories of homes, businesses, peopie, to rnention
a few; We have completed this through most of the 19205;
Existing school records from the many districts have been card
catalogued by school district by surnames and family groups.
We made additions and corrections to the Idaho State
Genealogical Societ.y's Meridian Cemetery records, adding
almost 200 reported burials not available through the head
stones and cemetery records. These are now being cross
checked with the local rnortuary records.
We have an ever enlarging collection of family histories and
genealogies-adding more to this by donation this past week.
We have done documentation for S.S. verification} passports} and
family history.
We provided information for the Ada Co. Driving Tour-most of
you hllve seen the historiClll displllY in the new post office.
Our most recent large project was the Meridian Centennial
Calendar which was about 2 years from start to finish. One of the
members is currently preparmg a walking tour of the old
downtown area that can be used as a handout type brochure for
the Centennial,
We would like to ask for an official action that would recognize
the Meridian Historical Society as the official historical society
for the area in the event that we should be questioned as to

activities that we have been doing and plan to continue in the
future,

FACTS & FINDINGS:

1. Maws Addition is a 45-10t single family residential aubdivision located
on 9.4 acres at the northwest corner of Locust Grove Road and Pine
A venue.
2 . Maws Addition was approved by the ACHD Commission on March 26 ,
1992. The Site Specific Requirements included these requirements,
among others:
#2. Construct curb, gutter, 5-foot sidewalk and match paving on Lo-
cust Grove abutting parcel. Improvements shall be constructed to a
52-foot back-to- back street section.
#5 . Construct curb, gutter, 5-foot sidewalk and match paving on Pine
abutting parcel. Improvements shall be constructed to a 41-foot back-
to- back street section.
See the attached staff report dated March 17, 1992.
These two conditions require the construction of improvements (curb
and pavement widening) along Pine and Locust Grove which amount to
"system improvements", by definition of the Road Impact Fee Ordi-
nance. The developer has requested offsets from Road Impact Fees for
the construction of these required improvements, which he is allowed to
do.

The Road Impact Fee Ordinance and the State Law both state that in
order to be approved for offsets, the Capital Improvements Plan adopt-
ed by the District must qualify the particular stretch of roadway for
the granting of offsets. In this case, the Capital Improvements Plan
shows that neither Pine nor Locust Grove at this location are qualified
for the use of Impact Fee Revenue or offsets because the projected 2010
traffic does not exceed the capacity of the existing roadway.
It now appears that the requirements for the curbing and widening of
these two streets were imposed in error. The conditions should have
only required the installation of the 5-foot sidewalk along both streets
and not required the widening of the two streets. The sidewalk is a
"site - related improvement" and is not eligible for use of Impact Ree
revenue or offsets.

The point is, both the Ordinance and the Statute require the District
to give offsets or reimbursements for any "system improvement", which
the curbing and widening are. However, The Capital Improvements
Plan does not qualify these two stretches of Locust Grove and Pine to
receive offsets. It appears to staff that the District should not require
the system improvements. However, we are informed by City of Meridi-
an staff that their Planning Commission and Council are strongly in
favor of having the improvements put in now.
Since the implementation of the Road Impact Fee Ordinance, staff has
not recommended the requirement that system improvements be installed
on any collector or arterial road designated by the Functional Street
Classification Map to avoid this situation. In some cases, developers
have asked permission to install system improvements and be given
offsets for that installation. Each case is reviewed individually and
decisions made to allow the improvements and grant offsets according to
the Capital Improvements Plan.
SITE SPECIFIC REQUIREMENTS:
Therefore, staff recommends that Site Specific Requirements #2 and #5 be
amended to read as follows:
#2 . Construct 5-foot sidewalk along Locust Grove abutting parcel.
#5 . Construct 5-foot sidewalk along Pine abutting the parcel and the
au tparcel.

FACTS & FINDINGS:
1. Maws Addition is a 45-10t single family residential subdivision located
on 9.4 acres at the northwest corner of Locust Grove Road and Pine
Avenue; 1,535-feet of new public streets are planned.

2. Locust Grove is designated a minor arterial street on the 2010 Urban
Functional Street Classification Map requiring a minimum 66-foot right-
of-way and 52-foot street section with 4 traffic lanes.
Locust Grove road has 50-feet of right-of-way and is improved with
24-feet of paving.
3. Pine is designated a collector street on the 2010 Urban Functional
Street Classification Map requiring a minimum 60-foot right-of-way and
41-foot street section with 3 traffic lanes.
Pine A venue has 50-feet of right-of-way and is improved with 24-feet of
paving.
4. Florence Street (Adkins Street) has 40-feet of right-of-way (50-feet is
required), and is improved with 14-feet of gravel. The proposed plat
shows that this street will be vacated, although application has not
been submitted to the District yet. There is no provision for public
access to the existing residences that take access to the street if the
street is vacated, so staff recommends that the application for vacation
of Florence (Adkins) Street not be accepted.
5. There is an existing house (outparcel) at th~ northeast corner of Pine
and Florence (Adkins) that takes access to Pine.
6. This application is scheduled for public hearing by the Meridian Plan-
ning and Zoning Commission on April 14, 1992.

1. Dedicate 33-feet of right-of-way from the centerline of Locust Grove
abutting parcel (8 additional feet).
2. Construct curb, gutter, 5-foot sidewalk and match paving on Locust
Grove abutting parcel. Improvements shall be constructed to a 52-foot
back-to-back street section.
3 . Direct lot or parcel access to Locust Grove is prohibited, in compliance
with District policy. Lot access restrictions shall be stated on the final
plat.
4. Dedicate 30-feet of right-of-way from the centerline of Pine abutting
parcel and the outparcel (5 additional feet).
5. Construct curb, gutter, 5-foot sidewalk and match paving on Pine abut-
ting parcel and the outparcel. Improvements shall be constructed to a
41-foot back-to- back street section.
6. Direct lot or parcel access to Pine (except the outparcel) is prohibited,
in compliance with District policy. Lot access restrictions shall be
stated on the final plat.
7 . Dedicate a 15' x 15' triangle (or appropriate curve) of right-of-way at
the corner of Locust Grove and Pine abutting parcel to keep the street
improvements in the public right-of-way.
8. Dedicate 25-feet of right-of-way from the centerline of Florence
(Adkins) abutting parcel and the outparcel (5 additional feet).
9. Dedicate a 10' x 10' triangle (or appropriate curve) of right-of-way at
the corner of Pine and Florence (Adkins) abutting the outparcel to
keep the street improvements in the public right-of-way.
STANDARD REQUIREMENTS:
1 . Street and drainage improvements required in the public right-of-way
shall be designed and constructed in conformance with District stan-
dards and policies.
2. Dedicated streets and drainage systems shall be designed and construct-
ed in conformance with District standards and policies.
3. Specifications, land surveys, reports, plats, drawings, plans, design
information and calculations presented to ACHD shall be sealed, signed
and dated by a Registered Professional Engineer or Professional Land
Surveyor, in compliance with Idaho Code, Section 54-1215.
4. Provide written approval from the appropriate irrigation/drainage dis-
trict authorizing storm runoff into their system.
5 . Locate obstructions (utility facilities, irrigation and drainage appur-
tenances, etc.) outside of the proposed street improvements. Authoriza-
tion for relocations shall be obtained from the appropriate entity.

Crookston: Yes. There's just some language questions that I
have that are probably better addressed with the developer. In
Article C they say that Hall residential buildings erected upon
said property shall have a minimum floor area as designated on
the official plat. II Normally they aren't designated on the plat
unless their variable sized homes. My questions is whether or
not they are shown on the plat?
Clerk Niemann: They are.
Crookston: Just a comment, on page 3 under general appearance
and neatness of the property talking about recreational vehicles
not being able to be parked on the street or in the setback, they
have "recreational vehicles shall include but not limited to

boats, campers, motorhomes, snowmobiles1 motorcycles and race
carsll even thought the language is recreational vehicles shall
include but not limited to, I think it would be wise to include
specifically trailers so that it's noted. If it's not your
intention it's not required but I think it would be wise to state
that also self propelled R.V.'s. On page 3 under animals I think
we need the clause in there that the City only allows two cats or
dogs. On page 5 talking about Architectural Control Committee
hereinabove designate shall constitute a committee subject to the
aforementioned Ordinances and rules and regulations of the
various Planning and Zoning Commissions having jurisdiction to
determine and designate the location upon such easements of all
irrigation ditches, we do have the Ordinances that require
irrigation ditches to be tiled. I just wanted to bring that to

BID ON PUMP & PUMPHOUSE WELL #14:
Eng. Smith: We opened bid on October 23rd for construction of
the well house for Well #14 and for supplying of the pump, motor
and control systems. We had two bidders, Dave Allen Construction
and the DevCon Group. The low bidder was DevCon Group, the low
bid was $79,980.00. Dave Allen Construction has a bid of
$g6,80B.00. The major difference between the two bids is in the
construction of the well house. I had separated that bid into
four different bid items and the well house accounted for
approximately $13,000.00 of that difference, the other four
$4,000.00 is basically ~n the face piping itself and we're not
sure why because face piping is face piping. It is my
recommendation that DevCon Group be awarded the bid.

WATER/SEWER/TRASH
Kingsford: This is to inform you in writing, if you choose to
you have the right to a pre-termination hearing at 7:30 P.M.,
November 4, 1992 before the Mayor and City Council to appear in
person to be judged on the facts and defend the claim made by the
City that your water sewer trash bill is delinquent. You may
retain Counsel. Service will be discontinued on November 18,
1992 unless payment is received in full. Is there anyone present
who wishes to contest their sewer/water/trash bill? No response.

DEPARTMENT REPORTS:
Wayne Forrey: APA is going to be updating their population and
demographic projections out to the year 2025. In that process
they will be allocating population between all the City's and
Districts in Ada County and that's a pretty important process for
the City to get involved in because that does have some funding
implications as they parcel out future population.
Kingsford: Specifically I was concerned about the State Revenue
Sharing among other things. They asked for a representative and
I thought because of Wayne's involvement with the housing plan
and so forth that it might be a good idea if we have him work on
this.
Forrey: I've tentatively set up a meeting for Monday, November
16th here at City Hall at 4:30 if this meets with your schedule.
Is that tentatively acceptable. Also I think previously we've
talked about the Transportation Act. The State finally now has
put an application package together and last week Meridian
received a copy of that and the Transportation Department has
basically told Twin Falls and other cities slow down let's let
everyone have an equal opportunity to apply. There is a deadline
of November 18th to return this. (Explained further)

Dinners. We need to get feedback to the AlC Office as soon as

to him originally so I don't know what the legal implications

1. IDOT will be awarding millions of dollars to Cities for transportation
improvement projects in various funding categories during the next 6 years.
2. Several Cities have jumped ahead and already applied for funds.
3. IDOT now has an application process. Meridian received it last week. All
applications are now due Nov.18, 1992. Considered by ITB in Jan. 1993.
4. Where do we go from here?
(Recommendations)
A. GDS to review program and eligible projects.
B. Meet with IDOT...LEROY MEYER... review procedures.
C. Meet with APA (if necessary) to solicit support.
D. Review eligible projects and funding with City Council and
Transportation Committee prior to Nov. 16, 1992.
E. Meet with APA Board on Nov. 16 (if necessary)
FI Prepare application and submit by Nov. 18, 1992.
Note: this is a reimbursement program with local matching requirements.
