Broadway Ave. Suite 102 Meridian,ID 83642 Subject: Request for Vacation of Landscape Easement—Vanguard Village Subdivision No. 1 Dear Members of the Planning Department, The plat for Vanguard Village Subdivision No. 1 was recorded, establishing the subdivision layout, including easements and associated development requirements. Shortly after recordation,an error was identified in the depiction of a 5-foot landscape buffer easement located on Lot 6,Block 1 of Vanguard Village Subdivision No. 1. Upon further review, it was determined that the landscape requirements intended for this area are already incorporated within the existing Public Utility Easement(PUE) along the same frontage.As such,the separate 5-foot landscape buffer easement is redundant and unnecessary for ensuring compliance with applicable landscaping standards. The presence of this additional easement imposes unintended restrictions on the affected parcels and limits the ability of current and future property owners to fully utilize their property.Vacating this easement will eliminate redundancy while maintaining all required landscape standards through the existing PUE provisions. Therefore,we respectfully request the vacation of the 5-foot landscape buffer easement on Lot 6,Block 1 within Vanguard Village Subdivision No. 1. This action will correct the platting error and allow property owners reasonable use of the affected area without compromising the subdivision's design intent or regulatory compliance.
