APPLICANTS
1. The property is approximately 0.97 acres in size. The property is generally located
at the northeast corner of Magic View Drive and Allen Street in Meridian.
2. The owner of record of the subject property is Magic View Partners, an Idaho
General Partnership, P.O. Box 8204, Boise, Idaho.
3. The Applicants are Blaine and Cynthia Jacobson, 2233 Blue Stem Lane, Boise,
Idaho.
4. The property is presently zoned as L-O (Limited Office), and is vacant.
5. The Applicants request the property be rezoned to C-G (General Retail and
Service Commercial District).
6. The proposed site is bordered on the north by two vacant parcels of land, to the
south by Jackson’s Texaco Gas and Convenience Store, to the east by a Chevron
Gas and Convenience Store, and to the west by Lincoln Plaza. The site is located
at the intersection of Magic View and S. Allen Street, approximately 1000’ west of
Eagle Road.
7. The subject property is within city limits of the City of Meridian.

8. The entire parcel of the property is included within the Meridian Urban Service
Planning Area as the Urban Service Planning Area is defined in the Meridian
Comprehensive Plan.
9. The Applicants propose to develop the subject property in the following manner:
Build a 1,743 sq. ft. Subway sandwich shop to include a single-window drive-thru,
and a future Office/Retail Building of approximately 5,840 sq. ft.
10. The Applicants’ requested rezoning of the subject real property as C-G is
consistent with the commercial designation on the Meridian Comprehensive Plan
Generalized Land Use Map which designates the subject property as Mixed
Planned Use Development.
11. There are no significant or scenic features of major importance that affect the
consideration of this application.
RECOMMENDATION
1. The Meridian Planning and Zoning Commission hereby recommends to the City Council
of the City of Meridian that they approve the rezoning as requested by the Applicants for the
property described in the application, subject to the following:

The Planning and Zoning Commission advises:
1.1No sign or signs upon the lot may be taller than 20’ in height.
1.2For any use not presently allowed under the L-O designation, Applicant, or
subsequent title holder, must submit plans for the approval of both the Meridian
Planning & Zoning Commission and the Meridian City Council.
1.3Standing signs upon the property are limited to one without further submission to
both the Meridian Planning & Zoning Commission and the Meridian City Council.
Adopt the Recommendations of the ACHD as follows:
1.4Dedicate 29 feet of right-of-way from the centerline of Magic View Drive abutting
the parcel by means of recordation of a final subdivision plat or execution or a
warranty deed prior to issuance of a building permit (or other required permits),
whichever occurs first. Allow up to 30 business days to process the right-of-way
dedication after receipt of all requested material. The owner will not be
compensated for this additional right-of-way because Magic View Drive is a
local/local commercial street and is to be brought to adopted standards by the
developers of abutting properties.
1.5 Applicant is proposing two driveways on Magic View Drive.
Proposed driveway #1 is located approximately 110 feet from the
intersection of Allen Street and Magic View Drive. This location meets District
policy and is approved with this application. Pave the driveway to its full required
width of 25 to 30 feet and to a point 30 feet beyond the edge of pavement of
Magic View Drive.
Proposed driveway #2 is located approximately 250 feet from the
intersection of Allen Street and Magic View Drive. This location meets District
policy and is approved with this application. Pave the driveway to its full required
width and to a point 30 feet beyond the edge of pavement of Magic View Drive.
Pave the driveway to its full required width of 25 to 30 feet and to a point 30 feet
beyond the edge of pavement of Allen Street.
1.6 Construct curb, gutter, 5 foot wide concrete sidewalk, and match paving on Magic
View Drive abutting the parcel. Improvements shall be constructed to one-half of a
40 foot street section.
1.7Replace any damaged curb, gutter, and/or sidewalk on Allen Street to match
existing improvements. Segments to be replaced shall be determined by ACHD
Construction Services staff. Contact Construction Services at 387-6280 (with file

1.8Utility street cuts in pavement less than five years old are not allowed unless
approved in writing by the District. Contact ACHD’s Utility Coordinator at 387-
2516 or 387-6258 (with file number) for details.
1.9Meet District drainage requirements per section 8000 of the ACHD Development
Policy Manual. Contact District staff at 387-6170 for details.

1.10If utility relocation is necessary to construct improvements required with this
development, then all utility relocation costs associated with improving street
frontages abutting the site should be borne by the developer.
1.11Any existing irrigation facilities should be relocated outside of the right-of-way.
Adopt the Recommendations of the Meridian Fire Department:
1.12That a fire-flow of 1,000 gallons per minute shall be available for duration of 2
hours to service the entire project. Fire hydrants shall be placed an average of 400’
apart.
1.13 Acceptance of the water supply for fire protection will be by the Meridian Water
Department.
1.14 Final Approval of the fire hydrant locations shall be by the Meridian Fire
Department.
1.15 All radii shall be 28’ inside and 48’ outside radius for the internal road system.
1.16 The roadways shall be built to Ada County Highway Standards and shall have a
clear driving surface, which is 20’ wide.
