Mayor, Members of the Meridian City Council and Planning Sta?, Thank you for the opportunity to provide public comment regarding the proposed Pollard West Development Agreement Modification, H-2026-0015. After reviewing the current application materials, the original Pollard Development Agreement, subsequent Pollard-related modifications, associated recorded instruments, and supporting planning materials, I respectfully request additional clarification, analysis, and written findings prior to approval. My comments are not intended to oppose development or challenge the City’s authority to approve Development Agreement modifications. Rather, my request is intended to ensure this application is evaluated within the full historical and cumulative context of the broader Pollard development framework and that separation of Lots 1–7, Block 2 into an independent Development Agreement structure does not unintentionally alter, weaken, fragment, delay, transfer, or impair infrastructure obligations, transportation assumptions, mitigation measures, public-service commitments, access protections, or phasing relationships relied upon in prior approvals. The current application states that no substantial changes are proposed to approved infrastructure, development standards, or overall site design and that the purpose is to permit independent progression of the identified parcels. However, the broader Pollard Development Agreement framework has undergone multiple related approvals and modifications over time, including Pollard North and additional related amendments and recorded instruments associated with the original 2019 Development Agreement. Accordingly, I respectfully request that this application not be reviewed in isolation, but instead evaluated against the cumulative Pollard Development Agreement history and its associated infrastructure and transportation assumptions. Comprehensive Development Agreement Review Prior to approval, I respectfully request that the City identify and provide written findings regarding: 1 1. The original 2019 Pollard Development Agreement obligations applicable to the overall development framework; 2. All subsequent Pollard-related modifications, amendments, Findings of Fact, recorded instruments, and related approvals associated with the original Development Agreement structure; 3. Which original obligations, assumptions, mitigation measures, infrastructure commitments, easements, and public-service obligations have been: • preserved; • modified; • reassigned; • deferred; • satisfied; or • eliminated; 4. Whether the proposed Pollard West MDA further fragments, redistributes, alters, or isolates responsibilities related to: • infrastructure delivery; • roadway connectivity; • reciprocal access; • circulation planning; • utility coordination; • emergency access; • transportation mitigation; • phasing relationships; or • public-service commitments. Transportation Infrastructure, Access Preservation, and Future Mitigation Flexibility The original Pollard approvals were part of a broader mixed-use framework intended to support coordinated circulation, interconnected roadway planning, integrated access management, and long- term transportation functionality. Subsequent Pollard-related approvals appear to involve changes a?ecting residential density, circulation assumptions, roadway relationships involving Levi Avenue, Waverton, Black Cat Road, and broader corridor-level transportation planning considerations. Given the substantial ongoing growth in this area — including surrounding approved, planned, and reasonably foreseeable development — preservation of future corridor-level transportation flexibility remains critically important. Accordingly, I respectfully request written findings addressing: a. Whether all existing and future reciprocal access easements remain preserved, enforceable, and functionally coordinated across the broader Pollard framework; 2 b. Whether this modification preserves anticipated east-west connectivity opportunities contemplated under the broader development framework; c. Whether roadway reservation opportunities remain preserved; d. Whether parcel separation could reduce future transportation mitigation flexibility or impair coordinated corridor-level access-management strategies; e. Whether sta? evaluated how separation of these parcels may a?ect future transportation mitigation opportunities involving the surrounding corridor; f. Whether cumulative transportation impacts have been evaluated comprehensively alongside surrounding approved, planned, and reasonably foreseeable development rather than incrementally at the parcel level alone; g. Whether future opportunities remain available to direct higher-volume commercial tra?ic toward signalized intersections, including Levi Avenue, while limiting diversion into lower-capacity neighborhood routes where appropriate; h. Whether internal circulation assumptions relied upon during prior approvals remain unchanged; i. Whether independent parcel progression alters transportation sequencing assumptions relied upon in prior approvals or future infrastructure planning. Infrastructure Obligations and Public-Service Assumptions The original Pollard approvals relied upon coordinated infrastructure planning, utility sequencing, emergency-access assumptions, and public-service coordination across the broader development framework. Accordingly, I respectfully request written findings regarding: Wastewater Infrastructure and Utility Phasing • Wastewater infrastructure capacity assumptions; • Lift-station obligations; • Sewer easements and force-main requirements; • Utility phasing relationships; • Occupancy timing assumptions; and • Whether parcel separation shifts future infrastructure burdens to adjacent properties, future phases, taxpayers, or public agencies. Fire Protection and Emergency Access • Fire-flow assumptions; • Emergency-access requirements; • Fire apparatus circulation assumptions; • Roadway-access adequacy under full build-out conditions; 3 • Perpetual access easements and maintenance responsibilities; and • Whether future ownership separation could impair long-term emergency-access coordination. Water Capacity and Utility Coordination • Water-system capacity assumptions; • Pressure assumptions; • Public-safety utility coordination; • Infrastructure timing and sequencing; and • Whether utility responsibilities remain coordinated across the broader framework. Shared Access and Long-Term Operational Responsibilities • Shared drive aisles; • Reciprocal-access easements; • Cross-access obligations; • Roadway reservations; • Maintenance responsibilities; and • Whether future ownership separation a?ects enforceability or operational coordination. Comprehensive Plan Consistency and Development Sequencing Original approvals contemplated phased implementation of a coordinated mixed-use framework with integrated circulation and infrastructure assumptions. Accordingly, I respectfully request findings regarding: a. Whether approval remains consistent with the Meridian Comprehensive Plan’s goals regarding coordinated mixed-use circulation, access management, and corridor preservation; b. Whether separation changes assumptions supporting coordinated land-use and transportation planning; c. Whether conditions dependent upon coordinated implementation remain enforceable; d. Whether infrastructure delivery obligations continue to occur in the intended order originally contemplated by prior approvals. Requested Action Prior to approval, I respectfully request that the City provide written findings demonstrating that the proposed Pollard West MDA: • Preserves applicable obligations established under the original and subsequently modified Development Agreements; • Does not reduce future transportation-mitigation flexibility, coordinated circulation opportunities, or corridor planning options; • Does not impair future east-west connectivity, reciprocal access, or access-management objectives; 4 • Does not shift infrastructure burdens, deferred improvements, or public-service obligations onto adjacent properties, future phases, taxpayers, or public agencies; • Does not undermine emergency access, utility coordination, infrastructure sequencing, or public- safety assumptions relied upon in prior approvals; and • Remains consistent with the Meridian Comprehensive Plan and cumulative development history associated with the broader Pollard framework. These comments are submitted in support of transparency, comprehensive planning, infrastructure accountability, preservation of long-term transportation functionality, and ensuring that assumptions relied upon in prior approvals remain enforceable over time.
