Request to Modify the Approved Final
Plat for Hightower Subdivision
(File No. MFP-07-004)
Staff has reviewed this submittal and offers the following comments and conditions of the applicant:
APPLICATION SUMMARY & LOCATION
The applicant, The Land Group, Inc., has applied for a final plat modification to revise a portion of the
approved fencing plan and to remove the requirement of constructing a sidewalk along the northeast
section of N.Jericho Road in Hightower Subdivision. The perimeter fencing shown on the approved
landscape plan in Hightower Subdivision is a sixwfoot tall vinyl fence and the sidewalk shown on the
approved plan is five feet wide.
Hightower Subdivision is located on the south side of E. Chinden Boulevard approximately ~ mile west
of N. Locust Grove Road in the NE~ of the NE~ of T. 4N., R. IE., Section 30. The site has already
been platted. The City Council approved the final plat on August 15, 2006.
STAFF ANALYSIS & RECOMMENDATION
The applicant is requesting to modify the perimeter fencing adjacent to Lot 12 and Lot 14, Block 3.
These lots are adjacent to Chinden Boulevard. Instead of the six-foot tall vinyl fence, the applicant is
proposing to construct open vision fencing, not to exceed 4 feet in height, along the property lines of Lot
12 and Lot 14, Block 3. Also, the applicant is constructing a 6-foot tall decorative concrete wall
approximately 10 feet north of said property lines. The 6-foot concrete wall is required by ITD and will
provide sound protection to the neighboring residential area. The Unified Development Code (UDC)
does not have a requirement for permanent fencing; granting the applicant's request does not violate any
UDC requirement. Further, Staff believes that the open vision fencing will function as well, if not better
than the previously proposed 6-foot tall vinyl fence. Staff supports the request to modify the fencing
adjacent to Lot 12 and 14, Block 3.
The applicant is also proposing to revise the landscape plan to remove the requirement to construct a
sidewalk along the west side ofN. Jericho Road, north of Everest Street. The Jericho Road Right-of-Way
has been vacated north of Everest Street and the connection to Chinden Boulevard has been terminated.
Because Jericho Road will not exist in this location, Staff supports the request to remove the
requirement of constructing said sidewalk, provided an east-west pedestrian connection is made
from E. Everest Street to the Westborough Subdivision to the east.
Staff recommends that the Council approve the applicant's request to modifY the approved landscape
plan and fencing for Hightower Subdivision (MFP-07-004), as proposed by the applicant and
conditioned by Staff above (see attached in Exhibit 2 of this staff report for the revised landscape
plan).
