Broadway Avenue on the southwest comer ofW. 3rd Street and Broadway Avenue Applications: rezone HigWights of Proposed Development: Maria Vanbragt, has applied for a rezone of 0.19 of an acre from I-L (Light Industrial) to O~T (Old Town) for the existing residence. The applicant is requesting the subject property be rezoned so the existing single-family dwelling can be considered a conforming use in the zone (the I-L zone prohibits residential uses). Other: The property is designated as Old Town on the Comprehensive Plan. Elevations: Yes: photos of existing home Commission Recommendation: approval at their May 17,2007 public hearing. Written testimony: None Key Issue(s) of Discussion by Commission: None Key Commission Change(s) to Staff Recommendation: None Outstanding Issue(s) for City Council: In meeting with the applicant, Staff informed the Vanbragt's that, by strict interpretation, the proposed remodel of the existing structure will not comply with the Downtown Meridian Design Guidelines (DMDG) for the requested 0- T zoning district. As you know, those design guidelines are intended to guide the look and placement of commercial buildings within the downtown core. The Vanbragt's intend to enclose an existing carport to add a minimal amount of square footage to the structure. It would not seem to be within the intent of the design guidelines to require conditional use approval for enclosing said carport. Likewise, the existing structure is non-conforming (per the UDC) because it does not provide the required two enclosed parking spaces or the 20' x 20' required parking pad. We ask that Council consider entering into a DA with the Vanbragt's and determine that the requested modification will not jeopardize the non-conforming status of the structure. Notes: Project: Vanbragt Rezone (RZ-07-007) Location, size of property and existing zoning: The subject property is located at 305 W. Broadway Avenue, is 0.19 of an acre, and is currently zoned I-L. Adjacent Land Use and Zoning: 1. North: Existing single-family residences and an apartment complex, zoned R-15. 2. East: Existing single-family residences, zoned I-L. 3. South: Existing single family residence, zoned I-L. 4. West: Existing single family residence, zoned I-L. Applications: Rezone from I-L to O-T Existing Constraints and Opportunities: The existing residential use of the property is considered a nonconforming use in the I-L zone. Rezoning the property to O-T would make the residential use a conforming use in the zone and allow the applicant to enlarge the existing house. Comprehensive Plan Designation: Old Town Compliance with Comprehensive Plan: Yes Compliance with UDC: Yes; Single-family dwellings are listed as permitted uses in the O-T zone. Proposed DA requirements: None -History of Previous Actions: Several residential properties -in this area of Meridian that were zoned I-L have been rezoned to a residential zone so that the use conforms to the zone.
