Caleb Hood, Deputy Director Community Development Services Meridian City Hall RE:Apex Zenith/Momentum—Development Agreement Modification Dear Mr. Hood: Brighton is pleased to submit the enclosed application for the modification to the recorded development agreement 2025-010344, which describes how the area southeast corner of Meridian and Lake Hazel Roads will develop. PROJECT HISTORY The parcels within the development agreement were annexed into the City in 2016 with a city initiated mass annexation effort (H-2015-0016). Earlier this year, the project was rezoned from R-4 to C-G in preparation for this and future applications (H-2024-0052). During the rezone, this development agreement was also put into place. Road and landscape improvements are underway in the area. A final plat has been provided for the most northwestern area, and the retail anchor has begun construction of their building. Further subdivision efforts are underway for the remaining areas. APPLICATION SUMMARY The Director is the recommending body, and City Council is the decision-making body for this Development Agreement Modification application. THE APPLICATION IN DETAIL PROPERTY OVERVIEW This development agreement encompasses 141.66 acres of land, which include the following parcels: S1406223040,S1406212410,S1406233610,S1406223020,S1406223042,S1406223045, S1406247810,and S1406223030. The site is located at the southeast corner of Meridian and Lake Hazel Roads. BRIGHTON—Creating GREAT Places—2929 W. Navigator Drive,Ste.400, Meridian, ID 83642 www.brighton.co 208-378-4000 LANDSCAPING The current Development Agreement requires landscaping to be completed in full along Meridian Road, a portion of Aristocrat Drive, and a portion of Optima View Avenue, as shown in green, below. These improvements were required with the "first step" of Apex Zenith. The first step included annexation, rezone, and the subject Development Agreement. At the time, the roadways were not associated with an adjacent plat, and therefore subject to being completed with the first plat (Apex Zenith). Plans are now underway to submit the remaining portion of the development agreement area with a pre-plat called Momentum Subdivision. We request that the additional landscaping be completed with that development, to avoid installing and potentially damaging or ripping out improved landscape areas. It is our goal to have these items complete in a manner that is paced with construction and platting. We will install all of these buffers prior to any occupancy of buildings that are adjacent to buffer areas and/or in associated plats. 2 IN CONCLUSION Based on the foregoing, as supported by the accompanying applications and documentation, we request a recommendation of approval for the Development Agreement Modification.
