SECTION 11: That Sections II.A., lI.B. and II.C Chapter 14 Title 11 of the Meridian
City Code, be, and the same are hereby amended and shall read as follows:
11-14-11
ADMINISTRATION:
A. Inspection4 The Pla1hling Director Zoning Administrator and/or Building
Inspector are hereby empowered to enter or inspect, upon notification of the
property owner or manager, any building, structure or premises in the City on
which, or in connection with which a sign, is located, for the purpose of
inspection of the sign, its structural and electrical connections, and to insure
compliance with the provisions of this Code. Such inspections shall be
carried out during business hours, unless an emergency exists.
B. Maintenance. The Planning Director Zoning Administrator shall have the
authority to order the repair or structural alteration for safety of signs which
present a hazard to the public.
C. Signs Declared Illegal. Upon finding that any sign endangers public safety by
reason of inadequate maintenance, dilapidation or abandornnent, the Planning
Director Zoning Administrator may declare the sign illegal. The Director
Administrator shall send the owner written notice that the sign has been declared
illegal, specifying the reasons why the sign endangers public safety, and order that
the sign be repaired or removed by the owner within thirty (30) days. If a sign
determined to be illegal presents an immediate and serious danger to the public, it
may be immediately removed by the City without prior notice and the removal
costs charged to the owner4
SECTION 12: That Section 12 APPEALS Chapter 14 Title 11 of the Meridian City
Code, be, and the same is hereby repealed.
SECTION 11 14 12 -LAAPPE-LAALS:

ma:r make an appeal to the Cit)r Council. Such an appeal must be made '\.vithin ten (10)
calendar da)rs from the date of the decision.
SECTION 13: That title 13 ENFORCEMENT Chapter 14 Title 11 of the Meridian City
Code, be, and the same is hereby amended, and that Sections A. and A.2., A.3., D.I.,
E.I., E.34 and F. are hereby amended, and shall now read as follows:
11-14-12
ENFORCEMENT:
The remedies provided in this section for violations or failure to comply with provisions
of this Code, whether civil, criminal, or for sign removal, shall be cumulative and shall be
in addition to any other remedy provided by law.

A. Revocation of Sign Permits. The Planning Director Zoning Administrator shall
have the authority to revoke any sign permit which has been granted when it has
been determined that the sign authorized by the permit has been constructed or is
being maintained in violation of this Code or of the conditions and limitations of
the sign permit.
In a revocation proceeding, the Planning Director Zoning Administrator shall
follow the following procedures:
1. A notice of intent to revoke a sign permit shall be sent to the holder
of the permit, or to one of its representatives; or, if this is not
possible, the notice shall be posted in a conspicuous position at the
entrance to the premises and by the certified mailing of another
copy of the notice to the last known address of the permit holder.
2. The permit shall be revoked within fifteen (15) days of the
posting of the notice of intent to revoke unless the cause of
violation has been removed and evidence of the same has been
presented to the Planning Director Zoning Administrator within
that period4
34 Any action of permit revocation by the Planning Director Zoning
Administrator may be appealed directly to the City Council by
filing a written notice of such appeal with the Planning Department
within ten (10) days after the revocation of the permit.
B. Civil Remedies. The violation of or failure to comply with any of the provisions
of this Code, or the erection, use, display or the allowing of any sign not in
compliance with all of the provisions of this Code shall be and hereby is declared
to be unlawful and is declared to be a nuisance.
14 Injunction and Abatement: The City, through its authorized
agents, may initiate injunction or abatement proceedings or other
appropriate action in the courts against any person who violates or fails
to comply with any provision of this Code, or against the erector, owner
or user of an unlawful sign or the owner of the property on which an
unlawful sign is located, to prevent, enjoin, abate or terminate violations
of this Code and/or erection, use or display of an unlawful sign.
2. Civil Penalty: Any person who violates or fails to comply with any of the
provisions of this Code or the erector, owner or user of an unlawful sign or
the owner of property on which an unlawful sign is located shall be
subject to a maximum civil penalty of three hundred dollars ($300.00) for
each day or portion thereof that the use or display of the unlawful sign has
continued, except that the owner of property on which an unlawful sign is
located, who is not also the owner or user of the unlawful sign, shall be

subject to the penalty only if demand for removal or alteration of the
unlawful sign shall have been mailed to said owner at his last known
address by registered mail, return receipt requested, and the demand has
remained uncomplied with for more than thirty (30) days.
C. Criminal Penalty. The violation of or failure to comply with any of the provisions
of this Code or the erection, use, or display or the allowing of any unlawful sign is
a Misdemeanor. Each day or portion thereof upon which a violation occurs
constitutes a separate offense4
D. Removal of Unlawful Sign4
14 Any unlawful sign which has not been removed within thirty (30) days
after sign permit revocation or expiration of the appropriate notice to
remove period, may be removed at the request of the Planning Director
Zoning Administrator and the costs charged to the owner. If removal
costs have not been paid and the sign reclaimed within sixty (60) days of
its removal by the City, the City, upon compliance with the procedures
specified in subsection E. of this Section, may proceed to sell or othetwise
dispose of the sign and apply the proceeds toward the costs of removal.
Any proceeds in excess of the costs of removal shall be paid to the owner.
2. Neither the City nor any of its agents shall be liable for any damage to the
SIgn
when removed under this Section.
3. For all purposes hereinafter the owner of the premises shall be presumed
to be the owner of all signs thereon, unless the contrary shall appear from
facts brought to the attention of the City.
E. Sale of Sign Removed by City.
1. Notice of Sale. Not less than thirty (30) days before the sale or disposal of
a sign removed pursuant to Subsection D. of this Section, the Planning
Director Zoning Administrator shall send to the owner written notice of
the intent of the City to sell or dispose of the sign4 The notice shall
specify the proposed manner of disposal and if the sign is to be sold, shall
specify the time an place of the sale. The owner may request a hearing
before the Planning and Zoning Commission concerning the sale or other
proposed disposal of the sign. Such request shall be in writing and must
be filed with the Planning Director Zoning Administrator within ten (10)
days of the date of the notice of sale. Receipt of a request for hearing shall
stay all proceedings with respect to the sale or disposal of the sign.
2. Hearing. The Commission shall fix a reasonable time for the hearing and
shall notify the owner of the time and place thereof. The Commission shall

either approve, modify, or deny the sale or other proposed disposal of the
sign and may impose such conditions in connection therewith as it deems
appropriate under the circumstances.
3. Appeal to CounciL The owner may appeal the decision of the Conunission
to the City Council by filing written notice of appeal with the Planning
Director Zoning Administrator within ten (10) days after the decision has
been filed by the Conunission. Upon receipt of an appeal, the Plulll1ing
Director Zoning Administrator shall forward all necessary documents and
materials to the Council for review.
44 Action by Council. Within a reasonable time after receipt of an appeal,
the Council shall establish a date for hearing the appeal and shall notify
the appealing party, but no other notice of such hearing need be given. In
reviewing the decision of the Commission, the Council, upon due cause
being shown may affirm, wholly or partially, modify or reverse the
decision of the Commission4
54 Conduct of Sales. All sales of signs having an estimated value in excess
of five thousand dollars ($5,000400) shall be accomplished through
auction or formal written bid to the highest responsible bidder after due
notice inviting proposals. All signs having an estimated value of five
thousand dollars ($5,000.00) or less shall be sold on the open market to
the highest responsible bidder in accordance with the informal bidding
procedures of the City, provided, however, that where the value of the sign
is such that the solicitation of bids is economically unfeasible, or interest
in bidding is limited, competitive negotiation procedures may be followed
in order to develop proposals of maximum advantage to
the City.
F. Assurance of Discontinuance. As an additional means of enforcing this Code, the
Planning Director Zoning Administrator may accept an "Assurance of
Discontinuance" of any act or practice deemed in violation of this Code or of any
regulation adopted pursuant hereto, from any person engaging in, or who has
engaged in such act or practice. Any such assurance shall specify a time limit
during which such discontinuance is to be accomplished. Failure to perform the
terms of any such assurance shall constitute prima facie proof of a violation of
this Code or any rule or regulation adopted pursuant hereto or order issued
pursuant thereto, which make the alleged act or practice unlawful for the purpose
of securing any injunctive relief from the court of competent jurisdiction.
SECTION 14: That title 14 LIABILITY, CONFLICT, SEVERABILITY AND
VALIDITY Chapter 14 Title 11 of the Meridian City Code, be, and the same is hereby
amended and shall read as follows:

11-14-13 LIABILITY, CONFLICT, SEVERABILITY AND VALIDITY
A. Liability. The provisions of this Code shall not be construed as relieving or
limiting in any way the responsibility or liability of any person erecting or owning
any sign, for personal injury or property damage resulting from the placing of a
sign, or resulting from the negligence or willful acts of such person, its agents,
employees, or workmen in the construction, maintenance, repair or removal of
any sign erected in accordance with a permit issued hereunder. Nor shall it be
construed as imposing upon the City or its officers or employees any
responsibility or liability by reason of the approval of any signs, materials, or
devices under the provisions of this Code.
B. Conflicting Provisions. If any other provisions of the municipal code conflict
with the provisions of this division, the more restrictive provisions shall apply.
C. Severability. If any section, subsection, sentence, clause or phrase of this
Ordinance or its application to any person or circumstances is held invalid by the
decision of any court of competent jurisdiction, the remainder of this Code, or the
application of the provisions to other persons or circumstances is in effect and
shall remain in full force and effect.
D. Validity of Other Laws. It is not intended by this Code to repeal, abrogate, annul
or in any way impair or interfere with existing provisions of other laws or
ordinances, except those specifically repealed by this Code, or with private
restrictions places upon property by covenant, deed or other private agreement.
Where this Code imposed a greater restriction on signs than is imposed or
required by such existing provisions of the law, ordinance, contract or deed, the
provisions of this Code shall controL
SECTION 15: All ordinances, resolutions, orders or parts thereof in conflict
herewith are hereby repealed, rescinded and annulled4
SECTION 16: V ALIDITY:The Meridian City Council hereby declares that any
section, paragraph, sentence or word of this Ordinance as adopted and amended herein be
declared for any reason to be invalid it is the intent of the Meridian City Council that it

SECTION 17: SAVINGS CLAUSE: This Ordinance does not affect an action or
proceeding commenced or right accrued before this Ordinance takes effect.
SECTION 18: DATE OF EFFECT: That 11-14-5 1.(4) shall become effective thirty
(30) days after passage hereof, and the remainder of this Ordinance shall be in full force
and effect after its passage, approval and publication, according to law.

Boise Meridian.
SECTION 2: That the above-described real property be, and the same is hereby annexed and
made a part of the City of Meridian, Ada County, Idaho.
SECTION 3: That the real property herein by this ordinance annexed to the City of Meridian
hereinabove described shall be zoned Limited Office District (L-O)4
SECTION 4: That the City Engineer is hereby directed to alter all use and area maps as well as
the official zoning maps, comprehensive plan and all official maps depicting the boundaries of the City
of Meridian in accordance with this ordinance.
SECTION 5: All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby
repealed, rescinded and annulled.
SECTION 6: This ordinance shall be in full force and effect from and after its passage, approval
and publication, according to law.
SECTION 7: The Clerk of the City of Meridian shall, within ten (10) days following the
effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a
draftsman manner plainly and clearly designating the boundaries of the City of Meridian, including the
lands herein annexed, with the following officials of the County of Ada, State of Idaho, to-wit: the
Recorder, Auditor, Treasurer and Assessor and shall also file simultaneously a certified copy of this

1.1 Comply with the conditions of the Meridian Fire Department as
follows:
1. That a fire-flow of 1,000 gallons per minute shall be available
for duration of2 hours to service the entire project. Fire
hydrants shall be placed an average of 400' apart.
2. Operational fire hydrants and temporary or permanent street signs
are required before combustible construction begins.
3. The roadways shall be built to Ada County Highway Standards
with a 33' wide driving surface. UFC 902.2.1
4. All radii shall be 28' inside and 48' outside radius.

1.2 Comply with the conditions of the N amp a & Meridian Irrigation
District as follows:
1. The District requires that a Land Use Change Application
be filed for its review prior to final platting.
2. All laterals and waste ways must be protected4
3. All municipal surface drainage must be retained on site. If
any surface drainage leaves the site, the District must
review drainage plans4
4. The developer must comply with Idaho Code 31-3805.
5. If the development is planning an urban irrigation system
that will be owned, operated and maintained by the
Irrigation District, applicant shall coordinate with the
District concerning the installation of the pressure system.
6. Fill out and return the questionnaire in order to initiate the
process of contractual agreements between the owner or
developer and the District for the ownership, operation and
maintenance of the pressure urban irrigation system.
1.3 Comply with the conditions of the Central District Health
Department as follows:
The Central District Health Department requires after written
approval from the appropriate entities are submitted, they can
approve this proposal for central sewage and central water; that
plans must be submitted to and approved by the Idaho Department
of Health and Welfare, Division of Enviromnental Quality for
central sewage and central water; that run-off is not to create a
mosquito breeding problem; and it is suggested that stormwater be
pretreated through a grassy swale prior to discharge to the
subsurface to prevent impact to groundwater and surface water
quality; that engineers and architects should obtain current best
management practices for stormwater disposal and design a
stormwater management system that is preventing groundwater and

Lots, and Nine (9) Other Lots on 15.4 Acres in an R-8 (PD) Zone, by
Sundance Limited Company, LLC (File No. FP-03-058).
We have reviewed the above referenced submittals and offer the following comments, as
conditions of approval. These conditions shall be considered in full, unless expressly
modified or deleted by motion of the Meridian City Council:
APPLICATION SUMMARY
The applicant, Sundance Limited Company, LLC, has requested approval of the final plat for
Sundance Subdivision No.4, consisting of forty-eight (48) single-family building lots and nine
(9) other lots on a 15.4 acre parcel of land located on the north side of Ustick Road,
approximately ~ mile eat; of N. Meridian Road.
This subdivision was approved with a Conditional Use Permit for a Planned Development that
allowed for office use as a non-conforming use in an R-8 zone. No other reductions or
variances from the ordinance were approved.
The proposed final plat substantially complies with the approved preliminary plat. A turn-
around was added where E. Santiago Court turns into a private drive leading into the
commercial area of the subdivision. ACHD requires there to be a turn-around at the end ofa
public street that is more than one lot depth or 150 feet in length. Also, the rear lot lines of
Lots 34 & 35, Block 9 were extended approximately 60-feet across the Finch Sub-Drain. The
reason for this change is that this section of the Finch Sub-Drain falls under private
jurisdiction. The remainder of the Finch Sub-Drain is under the jurisdiction of the Nampa and
Meridian Irrigation District and is within an easement on Lot 50, Block 9.
Staff recommends approval of the final plat for the fourth phase of Sundance Subdivision with
the comments and conditions stated in this report.

LOCATION
The property is located on the north side of Ustick Road, approximately ~mi1e east of N.
Meridian Road.
SURROUNDING PROPERTIES
North: Sundance Place Subdivision zoned R-8.
South: Bedford Place Subdivision (R-8) and rural residential properties zoned R-l (Ada County).
East: Rural residential, zoned R-I (Ada County).
West: Cedar Springs Subdivision, zoned R-4 and Meridian Settlers Park, zoned L-O.
SITE SPECIFIC COMMENTS / FINAL PLAT
1.
Applicant is to meet all terms of the approved preliminary plat (pP-Ol-015), conditional
use permit (CUP-Ol-030) and Development Agreement (lnst. No. 102056126).
2.
The pressurized irrigation system within this development is to be owned and maintained
by the Nampa & Meridian Irrigation District when details of a contractual agreement can
be worked out between Settlers Irrigation District and the Nampa & Meridian Irrigation
District. The pressurized irrigation system shall be treated as if it is a private system until
such time that the NMID takes on the ownership and maintenance responsibilities. The
City of Meridian requires that pressurized irrigation systems be supplied by a year-round
source of water. If a creek or well source is not available, a single-point connection to the
culinary water system shall be required. If a single-point connection is utilized, the
developer shall be responsible for the payment of assessments for the common areas prior
to signature on the final plat by the Meridian City Engineer.

For clarification, please graphically depict 10-foot wide public utilities, drainage and
irrigation easements along all rear lot lines that are not adjacent to the subdivision
boundary.
4.
Street signs are to be in place, water system shall be approved and activated, pressurized
irrigation system approved and activated, drainage lots constructed, fencing installed, and
road base approved by the Ada County Highway District prior to applying for building
permits. All development improvements, including perimeter fencing and landscaping
shall be installed and approved prior to obtaining certificates of occupancy. Surety, per
City Ordinance 12-5-3, will be required for all fencing, landscaping, pressurized
irrigation, sanitary sewer, water, etc., prior to signature on the final plat.
Sanitary sewer service and municipal water to this site shall be via extensions from

existing mains installed adjacent to the proposed subdivision. Applicant will be
responsible to construct the sewer and water mains to and through this proposed
development, thereby making them available to adjacent properties. Subdivision designer
to coordinate main sizing and routing with the Public Works Department
6. Applicant shall be required to pay Public Works development plan review, and
construction inspection fees, as determined during the plan review process, prior to
signature on the final plat per Resolution 02-3744
7. All drainage areas (detention/retention basins) must be designed to ensure that water will
percolate or discharge within a period of time not to exceed 24 hours for all storms up to
and including a 100-year storm event. Side slopes within drainage areas shall not exceed
3: 1.
8. Revise the landscape plan to include landscaping within the Ustick Road right-of-way per
MCC 12-13-10-9. A license agreement may be required between the property owner and
ACHD.
9. Add or revise the following note(s) on the face of the plat:

GENERAL REQUIREMENTS
1. All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting,
crossing or lying adjacent and contiguous to the area being subdivided shall be tiled per
City Ordinance 12-4-13. Plans will need to be approved by the appropriate
irrigation/drainage district, or lateral users association, with written confirmation of said
approval submitted to the Public Works Department4
2. Any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells
may be used for non-domestic purposes such as landscape irrigation.
3. Two-hundred-fifty and 1 DO-watt, high-pressure sodium streetlights will be required at
locations designated by the Public Works Department. All streetlights shall be installed at
subdivider's expense. Typical locations are at street intersections and/or fire hydrants.
Final design locations and quantity are determined after power designs are completed by
Idaho Power Company. Street light contractor to obtain design and permit from the
Public Works Department prior to commencing installation.
4. Compaction test results must be submitted to the Meridian Building Department for all
building pads receiving engineered backfill, where footing would sit atop fill material.
5 Applicant's engineer will be required to submit a signed, stamped statement certifying
that all street finish centerline elevations are set a minimum of three feet above the
highest established normal groundwater elevation4
6. Coordinate fire hydrant placement with the City of Meridian's Water Works
Superintendent.
7. Provide five-foot-wide sidewalks in accordance with City Ordinance Section 12-5-2.K.
8. Any tree over 4" in caliper that is removed from the property shall be replaced by
installing additional trees, being the equivalent number of caliper inches of trees that
were removed. Required landscaping trees will not be considered as replacement trees for
those trees that have to be removed4
RECOMMENDATION
Staff recommends approval of the final plat for Sundance Subdivision No.4 with the above
stated comments and conditions.

10. The applicant does not intend to provide fencing on both sides of Lot 50, as it will create a
tunnel behind the lots. The fencing along the rear of the lots is to serve as the boundary

double-fencing of Lot 50.
11. The preliminary plat approved for this subdivision contained the same lots and the same
dimensions on the cul-de-sac lots. The dimensions given on the preliminary plat were arc
lengths, not chord lengths. Sundance Subdivisions Nos. 1 and 2 also have been approved
and recorded with chord lengths less than 40' . We respectfully request that the lots be
approved as shown.
12. Due to the requirement to align our entrance road with the driveway to the south, three lots
fell below the dimensional requirement for R-8 frontage (Lots 2 and 15, Block 11, and Lot

40, Block 7). No lots were added as a result ofthe re-aIignment, but these lots required a
reduced frontage to maintain the number of approved lots. There is area to make the lots
in Block 11, have a 65' width. Lot 40, Block 7, cannot be adjusted, and we respectfully
request that this lot be approved as shown.
