V AC-07-008 Request for Vacation of the City of Meridian Utility Easement for Lots 1, 2, & 3, Block 1, Fallon Greens Subdivision, by Tealey's Land Surveying FROM: 1. SUMMARY DESCRIPTION OF APPLICANT'S REQUEST The Applicant, Tealey's Land Surveying, requests the vacation of the City of Meridian utility easement common to Lots 1,2, & 3, Block 1, Fallon Greens Subdivision. The subject easements were created in 2003 with the recordation of the Fallon Greens Subdivision, Recorders Number Book 86, Page 9780. The Fallon Greens Subdivision is located on the west side of Eagle Road and north of Interstate 84 at 875 South Allen Street in Section 17, Township 3 North, Range 1 East, B.M. Lot 1 of the subject site houses the Hampton Inn and Suites hotel. Lots 2 & 3, Block 1, are currently vacant. With the recordation of Fallon Greens Subdivision, a 20-foot wide (10 feet on either side of a lot line) City of Meridian utility easement was created common to Lots 1 & 2 and Lots 1 & 3, Block 1. Additionally, a lO-foot wide private irrigation easement was depicted on Lots 1 & 2, Block 1. The Applicant believes that the subject vacation will better facilitate development of the subject lot, as the intent is to construct an addition to the existing hotel building on Lots 1 & 2 which will span across the platted easements. New easements are to be dedicated and will run within the parking lot around the proposed hotel addition. The Unified Development Code 11-5A-l, requires the City Council to be the decision making body on vacations applied for in the City of Meridian. Idaho Code 50-1325 requires that all easements created on subdivision plats "shall be vacated in the same manner as streets" and must be approved by the local jurisdictions. Even though some types of easements can be addressed through letters of agreement / relinquishment (i.e. drainage, etc.), the landscape, maintenance, and irrigation easements are not specifically exempt under I.c. 50-1306A, and must be formally vacated through the City's process. 2. However, Public Works and Planning Staff requires the following conditions must be completed before the relinquishment of the current easements: 1) Approval of the construction drawings for the installation of new utilities by the Public Works Department; and 2) Recording of the new easements. Additionally, Public Works Staff will require that the Applicant complete construction of the new water mains including testing and activation prior to the issuance of a building permit. As the utility easement was dedicated solely for the benefit of the City, the Applicant was not required to obtain proof of relinquishment of the easement by Cable One, Qwest Communications, Intermountain Gas Company, and Idaho Power Company. The Nampa & Meridian Irrigation District claims they do not have interest in the private irrigation easement and, therefore, will not be impacted by the vacation. 3. PROPOSED MOTION Continue I move to continue the public hearing for File Number V AC-07-008 to July 3,2007. Approval I move to approve File Number V AC-07 -008, as presented in the staff report for the hearing date of June 19,2007. Denial I move to deny File Number V AC-07-008, as presented during the hearing on June 19,2007, for the following reasons: (You should state specific reasons for denial. They should address how the Applicant might redo the application to gain your recommendation for approval.) 4. RECOMMENDATION Staff recommends application V AC-07-008 to vacate the platted City of Meridian utilities easement and private irrigation easement for Lots 1, 2, & 3, Block 1, Fallon Greens Subdivision, be continued to the regularly scheduled hearing date of July 3,2007. 5.
