The DA requires that any future use be approved through a site-specific CUP application or a PD. Since we have detailed preliminary plat approval outlining building locations, design guidelines, utilities, landscaping, etc.; a CUP is no longer necessary. At the time of the Kissler Annexation a specific development plan was not proposed. The DA covered a total of 36.33 acres with different proposed uses. Since only a "conceptual plan" was submitted with the annexation, the City needed a CUP requirement to have a comfort level regarding development. City Council approval was obtained on July 18, 2006 for a detailed preliminary plat application for the Gateway Marketplace. Weare currently preparing construction documents for our on- and off-site improvements, and our final plat for submittal. During the preliminary plat process we submitted design guidelines for the shopping center. The intent at that time was that the DA requirement of each building and use having to apply for a CUP be eliminated and replaced with the condition of obtaining a Certificate of Zoning Compliance at staff level. Additionally, several of our preliminary plat conditions of approval (such as access onto Eagle Road and the location of a frontage road) are contradictory to the DA. To finalize our approvals and clean up discrepancies, a DA modification is necessary. Specific sections for revision: Section 4.1 ~ Eliminate the last sentence stating, "all uses shall be required to ~o through the Conditional Use Permit process for approval." ." Replace with, "all buildings shall require approval of design review at staff level n submitted prior to or concurrent with the Certificate of Zoning application and prior to submitting for building permit. Section 5 - Clarify that it is the intent that all uses that require a CUP in the CG zone will still have to obtain a CUP for the use. Section 6.A.3 through 6.E.l - Eliminate all. Replace with, "It shall be required that all future uses within the boundaries of the Gateway Marketplace comply with the Findings of Fact, Conclusions of Law and Decision & Order for PP-06-002, V AR-06-002, and the site specific and standard conditions of approval as shown in the attached Staff Report for the hearing date of July 18, 2006 incorporated by reference. Section 15. Add a provision to allow for a bond, letter of credit, CD, etc for a timeframe of 6 months for improvements such as landscaping in lieu of installing and City acceptance. This will allow for occupancy during winter months. Exhibit A Include the legal descriptions for Gateway Marketplace. Exhibit B Attach the City of Meridian Findings of Fact, Conclusions of Law and Decision & Order for PP-06-002 and V AR-06-002. Eliminate all reference to the Conceptual Master Plan since we've replaced with a detailed preliminary plat site plan. The preliminary plat for this project was approved on July 18,2006. We are currently preparing construction documents for our on- and off-site improvements, and our final plat for submittal. In laying out the details of the off-site widening on Eagle Road, it has been determined that the Idaho Transportation Department (ITD) has up to 26' of surplus right-of-way (ROW). ITD has stated that their long-term plans do not call for utilizing the surplus ROW. We respectfully request a variance to landscape this surplus right-of-way and to decrease our on-site landscape setback along Eagle Road from 35' to 20'. This will clean up the gravel and weeds in the ITD ROWand will enhance the roadway and the entrance to our shopping center. The requested variance shall not grant a special right or privilege since the project on the northwest comer of this intersection was granted the exact same landscape variance on June 22,2006. Additionally, the 35' landscape buffer which the City requires, except in some areas of deceleration lanes, will be provided. The variance relieves an undue hardship of having to maintain the surplus ROW in addition to the project on-site landscaping.
