HomeMy WebLinkAboutCreekside Arbour II CUP BEFORE THE PLANNING AND ZONING COMMISSION IN THE MATTER OF THE ) Case No. CUP-02-040 REQUEST FOR CONDITIONAL ) USE PERMIT FOR AN ) RECOMMENDATION TO CITY APARTMENT COMPLEX IN A ) COUNCIL PROPOSED R-40 ZONE ) ) BILL & LUCY LEAVELL, Applicant 1.The property is located at 1425 N.E. 5th, Meridian. th 2.The owner of record of the subject property is Creekside Arbour II, LLC., 1425 N.E. 5, Meridian, Idaho 83642. 3.Applicant is Bill & Lucy Leavell, 2720 S. Ariel Lane. 4.The subject property is currently zoned R-15. The proposed zoning district of R-40 is defined within the City of Meridian Zoning and Development Ordinance, Section 11-7-2. 5.The Applicant requests the Conditional Use Permit for development of a 48-unit apartment complex. The R-40 zoning designation within the City of Meridian Zoning and Development Ordinance requires a Conditional Use Permit be obtained for most uses including those requested by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-8-1). 6.The Meridian Planning and Zoning Commission recognizes that the proposed application is in compliance with the Meridian Comprehensive Plan. 7.The use proposed which is the subject of this will, in fact, constitute a conditional use as determined by City policy. 8.The Planning and Zoning Commission recognized the concerns of Wendell Bigham, Joint School District No. 2, expressed in his letter dated October 29, 2002. RECOMMENDATION TO CITY COUNCIL OF APPROVAL OF CONDITIONAL USE PERMIT FOR AN APARTMENT COMPLEX (CREEKSIDE ARBOUR II) BY BILL & LUCY LEAVELL – CUP-02-040 - Page 1 RECOMMENDATION The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the requested Conditional Use Permit as requested by the Applicant for the property described in the application, subject to the following: A. Adopt the Recommendations of the Planning and Zoning and Engineering staff as follows: Site Specific Requirements 1.Landscaping shall be installed as submitted with the following corrections/changes: a. Replace the rock in the perimeter planter beds with bark or other organic material as required by the Landscape Ordinance. b. Add a minimum 50 square foot planter, with a 2” caliper tree, in between the three trash enclosures and the sidewalks to provide a landscaping break within the linearly arraigned apartment parking. 2.All exterior lighting, whether attached to the building or located within the parking lot, shall be down-shielded or otherwise altered so that the light does not spill over onto adjacent properties or right-of-way. All parking lot lighting shall be in accordance with Ordinance 11-13-4C. 3.All signage shall be in accordance with the standards set forth in Section 11-14 of the City Zoning and Development Ordinance. All signage is subject to design review and shall require separate permits. Temporary or portable signs shall be prohibited, and shall be removed upon 3 days notice to the applicant. 4.All construction and site improvements shall conform to the requirements of the Americans with Disabilities Act. 5.All parking and areas of circulation shall be improved with a hard surface in accordance with MCC 11-13-4.D, and shall be installed and striped in accordance with the submitted site plan, ADA and MCC 11-13-4.F. 6.A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. Storm water treatment and disposal must be designed in accordance with Department of Environmental Quality 1997 publication Catalog of Storm Water Best Management Practices for Idaho Cities and Counties and RECOMMENDATION TO CITY COUNCIL OF APPROVAL OF CONDITIONAL USE PERMIT FOR AN APARTMENT COMPLEX (CREEKSIDE ARBOUR II) BY BILL & LUCY LEAVELL – CUP-02-040 - Page 2 City of Meridian standards and policies. Off-site disposal into a surface water is prohibited unless the jurisdiction which has authority over the receiving stream provides written authorization prior to development plan approval. The applicant is responsible for filing all necessary applications with the Idaho Department of Water Resources regarding Shallow Injection Wells. 7.Trash: The trash enclosure shall be enclosed on at least 3 sides by a solid wall or sight obscuring fence at least four feet in height in accordance with Ordinance 11- 12-1C. Coordinate location and construction requirements with Sanitary Services, Inc. 8.A Certificate of Zoning Compliance and a Building Permit shall be obtained prior to the start of construction 9.Water and sewer service shall be from extensions of existing mains adjacent to the subject property. B. Adopt the Recommendations of the Meridian Fire Department as follows: 1. That a fire-flow consistent with Appendix III-A of the Uniform Fire Code be provided to service the entire project. Fire hydrants shall be placed an average of 400’ apart. 1997 UFC Appendix III-A 2. Operational fire hydrants are required before combustible construction begins. UFC 901.4.2 & 901.3 3. Acceptance of the water supply for fire protection will be by the Meridian Water Department. 4. Final approval of the fire hydrant locations shall be by the Meridian Fire Department submitted thru the Public Works Department. 5. All radii for internal & external roads shall be 28’ inside and 48’ outside radius. 6. The proposed project will have an unknown transient population and will have an unknown impact Meridian Fire Department requests for service. According to a report completed by Fire & Emergency Services Consulting Group in February of 2000 our requests for service are projected to reach 2800 in the year 2005 and 3800 by the year 2010, this is up from 2069 responses in the year 2000. 7. The proposed project lies outside the five-minute response zone goal. Achievement of this goal is subject to budgetary constraints and is intended to enhance the probability of a favorable outcome on a request for Basic Life Support. A fire station is scheduled to become operational in the fall of 2003 in this service area. 8. The fire department requests that any future signalization installed as the result of the development of this project are equipped with Opticom Sensors to ensure a safe and efficient response by fire and emergency medical service vehicles. This cost of this installation is to be borne by the developer 9. All buildings containing 6 or more units will be required to be fire sprinklered. C. Adopt the Recommendations of Central District Health Department as follows: 1. After written approval from appropriate entities are submitted, we can approve this proposal for central sewage & central water. 2. The Applicant’s central sewage and central water plans must be submitted to and approved by the Idaho Department of Health & Welfare, Division of Environmental Quality. 3. Run-off is not to create a mosquito breeding problem. 4. Stormwater shall be pretreated through a grassy swale prior to discharge to the subsurface to prevent impact to groundwater and surface water quality. 5. The Engineers and architects involved with the design of the subject project shall obtain current best management practices for stormwater disposal and design a stormwater management system that prevents groundwater and surface water degradation. D. Adopt the Recommendations of the Nampa & Meridian Irrigation District as follows: 1. Please submit a Land Use Change/Site application to the Nampa & Meridian Irrigation District.
