Applicant
1.The property is located at 706 E. Main, Meridian.
2.The owner of record of the subject property is Dolores Lisby of Meridian.
3.Applicant is Michael McGuinness of Boise.
4.The subject property is currently zoned O-T. The zoning district of O-T is
defined within the City of Meridian Zoning and Development Ordinance, Section
11-7-2.
5.The applicant requests the conditional use permit for development of a Sports Bar
with Pool Tables and Big Screen TVs. The O-T zoning designation within the
City of Meridian Zoning and Development Ordinance requires a conditional use
permit be obtained for most uses including those requested by the Applicant.
(Meridian City Zoning and Development Ordinance, Section 11-8-1).
6.The Meridian Planning and Zoning Commission recognizes that the proposed
application is in compliance with the Meridian Comprehensive Plan.
7.The use proposed which is the subject of this will, in fact, constitute a conditional
use as determined by City policy.
8.The Planning and Zoning Commission recognize the concerns of the Valley
Shepherd Church of the Nazarene who expressed opposition to the request in their
letter of May 16, 2002.
RECOMMENDATION
The Meridian Planning and Zoning Commission hereby recommends to the City
Council of the City of Meridian that they approve the requested conditional use permit as

requested by the applicant for the property described in the application, subject to the
following:
Adopt the Recommendations of the Planning and Zoning and Engineering staff as
follows:
1.Existing landscaping shall be protected and retained.
2.Existing sanitary sewer and water assessments will compared with the anticipated
impact, to determine whether additional assessments are warranted. If additional
assessments are warranted, applicant shall pay for them with the issuance of his
building permit for tenant improvements.
3.“Bikini” dancing and/or other sexually oriented business activities are prohibited
at this location.
4.All parking and areas of circulation shall be improved with a hard surface in
accordance with Meridian City Code 11-13-4.D, and shall be installed and striped
in accordance with the submitted site plan and Ordinance 11-13-4.F.
5.All exterior lighting, whether attached to the building or located within the
parking lot, shall be down-shielded or otherwise altered so that the light does not
spill over onto adjacent properties or right-of-way. All parking lot lighting shall
be in accordance with Ordinance 11-13-4C.
6.All signage shall be in accordance with the standards set forth in Section 11-14 of
the City Zoning and Development Ordinance. All signage is subject to design
review and shall require separate permits. Temporary or portable signs shall be
prohibited, and will be removed upon 3 days notice to the applicant.
7.All construction and site improvements shall conform to the requirements of the
Americans with Disabilities Act.
8.As part of a conditional use permit, the City of Meridian may impose additional
restrictions/conditions.
Adopt the Recommendations of the Meridian Fire Department as follows:
9.Premises Identification. All numbers or addresses shall be 6” high and placed on
the front of the building in such a manner to be clearly visible from the street.
The numbers shall contrast with their background and be placed on the
street side of the building above the front door.
10.Portable Fire Extinguishers shall be installed in occupancies and locations as set
forth in this code and as required by the Chief. Fire Extinguishers shall be of the

2A 10BC size and have the top of the extinguisher hung 3’ to 5’ off the floor.
The travel distance to a fire extinguisher shall not exceed 75’.
11.Provide exit doors complying with the 1997 Uniform Building Code.
12.Post occupancy per the 1997 Uniform Fire Code.
13.This project shall be subject to a fire inspection to determine compliance with the
Uniform Fire Code and Uniform Building Code.
Adopt the Recommendations of Central District Health as follows:
14.Applicant shall provide plans for a plan review for a food and beverage
establishment.
