Dear Owner/Applicant:
On November 29, 2004, Ada County Development Services met with the applicant to
review the Ada County Property Status Report and possible office of the property. At
that time the applicant detailed the proposed use, which included, maintaining the
existing radio equipment and utilization of the office space by ES-O-EN Corporation to
house approximately ten(10)employees.
ANALYSIs/DETERMINATION
We would like to know the past history of this parcel and property as it relates to
Planning&Zoning issues.
Assessor's Tax Parcel #S1236121050, owned by Citicasters Company, contains 21.17
assessed acres,and is located in the Rural Residential (RR)District. The subject property
has approximately 1221 feet of roadway frontage to W. Amity Road, which is classified
as a minor arterial. The subject property presently contains one (1) 6,000 square foot
structure approved for a radio station with offices as evidenced by File #79-27-CU, as
well as four (4) communication towers. The existing office use is presently vacant and
has been sublet.
An office building housing a professional or business use is not an allowed use in the RR
District. However, upon a detailed review of the Property Status, the Planning and
Zoning Administrator determined that Conditional Use (79-27-CU) approved a two-
story radio station/office structure and that booth uses existed on site since
approximately August 9, 1979. The applicant's intent to share the facility with the radio
station by utilizing existing available office space shall be allowed as it was determined
that grandfathered office use exists on the property.

No additional zoning applications are required for the proposed office use other than
this revised Property Status Report. But, some conditions of approval are contained in
this document related to the original approval. In addition to the aforementioned
conditions, the applicant would be required to obtain an occupancy permit from the
Ada County Building Department. Please contact Mr. Ken Sommer at 287-7400 with
and building questions. Mr. Sommer has been apprised of your request and the current
property configuration.
CONDMONS OF APPROVAL
1. If required by the Ada County Building Code as set forth in Title 7,Chapter 2,of
the Ada County Code,the applicant and/or owner shall obtain a building permit
prior to commencing any development or property improvements. Please
contact the County Building Official at 287-7900 for fee and application
information.
2. No exterior structure expansion shall be allowed without first obtaining approval
from the Ada County Development Services Staff.
3. All landscaping shall be maintained in a healthy and attractive manner.
4. All landscaped areas shall contain a sprinkler system of adequate capacity and
sufficient design to adequately serve and maintain all landscaping in a healthy
and attractive*Wanner.
5. Paving,striping and any other necessary road improvements of all areas existing
or new shall be asphaltic surfaces and be in accordance with Ada County
dimensional standards.
6. Any lighting on the site shall comply with the lighting regulations in Title 8,
Chapter 4,Article H,of the Ada County Code.
7. All trash receptacles and roof equipment shall be screened from public view
8. A Certificate of Occupancy will be issued when all of the above conditions have
been met. In the event conditions cannot be met by the desired date of
occupancy, the owner and/or applicant may request a surety agreement in lieu
of completing the improvements. See Title 8, Chapter 4, Article K of the Ada
County Code for the terms and regulations of surety agreements.

On October 13,2004,Ada County Development Services received a property status
report request for Assessor's Tax Parcel#51236121050. Staff has researched the public
records and the Ada County Code in regard to the following questions and/or requests
for additional information as stated in the application:

to Planning&Zoning issues.
SUMMARY
Assessor's Tax Parcel #S1236121050,owned by Citicasters Company,contains 21.17
assessed acres,and is located in the Rural Residential(RR) District. The subject property
has approximately 1221 feet of roadway frontage to W.Amity Road,which is classified
as a minor arterial. The subject property presently contains one (1) 6,000 square foot
structure approved for a radio station as evidenced by File#79-27-CU,as well as four(4)
communication towers. The existing structure is presently vacant.
APPLICABLE LAW
All references are to the Ada County Zoning Ordinance.
1. Article 8-1A. DEFINITIONS:
ACCESSORY USE A use that is incidental and subordinate to the principal or approved conditional use,
and is conducted upon the same property.For the purposes of this Title,temporary
uses specified in Chapter 4,Article L shall be deemed accessory uses.
CONDITIONAL USE A use that,owing to some special characteristics attendant to its operation or
installation(for example,potential danger,hours of operation,or noise),is permitted
in a district subject to approval by the Planning and Zoning Commission and subject

to special requirements as enabled by Idaho Code§67-6512.
DEVELOPMENT Any construction or installation of a structure,or any change in use of a
structure,or any change in the use,character,or appearance of land,that
creates additional demand and/or need for public facilities.
FRONTAGE A property line along either 1)a roadway or 2)a permanent access
easement to a public street that was of record prior to May 20, 1968,and has
been established by a clear chain of title in subsequent recorded deeds.
PARCEL A tract of unplatted land(or contiguous land,if applicable),in single
ownership. considered a unit for purposes of development.
PARCEL OF A parcel of land that was of record in the Ada County Recorder's office prior
RECORD to January 1, 1985.
PRINCIPAL The use of land or a structure allowed in a specific zoning base or overlay district as
PERMITTED USE distinguished from an accessory or conditional use.
2. Article 8-2A. RURAL BASE DISTRICTS: This article sets forth the purpose, -
general requirements, allowed uses, and dimensional standards for property
located within the Rural Residential (RR)District. The minimum property size in #� '
the RR District is 10 acres with a minimum 100 feet of roadway frontage or as
approved for a private road.
Section 8-2A-3: ALLOWED USES:Unless otherwise specified in the specific use
standards of Chapter 5,Table 8-2A-1 lists principal permitted(P),accessory(A),
conditional (C),or prohibited(—)uses within each rural base district,including
rural residences.
A. For the purposes of this Article,the term rural residence shall refer to farm
development right parcels;residential non-farm subdivision lots in a
rural base district,and nonconforming properties in a rural base district.
B. Principal permitted uses shall be reviewed in accord with the specific use
standards in Chapter 5 of this Title and the master site plan standards of
Chapter 4,Article E,unless specifically exempt under Section 8-4E-2B of
this Title.
C. Accessory uses shall be reviewed in accord with the procedures in
Chapter 7,the specific use standards in Chapter 5,and the use regulations
of Chapter 5,Article A of this Title.
D. Conditional uses shall be approved in accord with the procedures in
Chapter 7,the specific use standards in Chapter 5,and the use regulations
of Chapter 5,Article B of this Title. (Ord.426, 10-2-01)

development within the commercial base districts.
8-2C-1. PURPOSE:
The purpose of this article is to provide commercial base districts inside areas of
city impact to implement the applicable comprehensive plans that are adopted as
part of the area of city impact agreements.These base districts are intended to
provide separate and distinct allowed commercial uses based on the availability
of urban services,the surrounding land uses,and the applicable comprehensive
plan designation for the area.The purpose statement of each commercial base
district is as follows:
A. Limited Office (LO)District:The purpose of the LO district is to provide
administrative: professional,and business office uses near residential
base districts.
B. Neighborhood Commercial(Cl) District: The purpose of the C1 district is
to establish commercial areas near residential areas that provide for the
sale of limited merchandise and services required by the population
primarily living within the immediate area.
C. Community Commercial(C2) District: The purpose of the C2 district is to
establish areas for community shopping and clustered commercial
activities along arterial streets that provide for the sale of a full range of
merchandise and services required of persons living within several
neighborhood service areas,as well as a rural trade area.
D. Regional Commercial (0) District:The purpose of the C3 district is to
establish areas for large scale commercial structures located in close
proximity to interstate or principal arterial roadways that serve the
Treasure Valley region. (Ord.389,6-14-2000)

4. Article 8-21). INDUSTRIAL BASE DISTRICTS: This article sets forth the
purpose,general requirements,allowed uses,and dimensional standards for
development within the industrial base districts.
Section 8-2D-1:PURPOSE:
The purpose of this article is to provide industrial base districts inside areas of
city impact to implement the applicable comprehensive plans that are adopted as
part of the area of city impact agreements.These base districts are intended to
provide separate and distinct allowed industrial uses based on the availability of
urban services,the surrounding land uses,and the applicable comprehensive
plan designation for the area.The purpose statement of each industrial base
district is as follows:
A. Technological-Industrial(IT):The purpose of the technological-industrial
district is to provide an environment exclusively for,and conducive to,
the development of technological industrial parks that support
administrative facilities,research institutions and specialized
manufacturing organizations, all of a nonnuisance type.Professional
offices,financial institutions,and other similar uses may be appropriate
when they provide services to the technological industrial park
employees.
B. Limited Industrial (M1):The purpose of the limited industrial district is
to encourage light industrial development by providing and protecting
an environment exclusively for such development,subject to standards
that protect the nearby residential,commercial,agricultural,and public
uses of property from hazards,noise,and other disturbances.
Professional offices,financial institutions,and other similar uses may be
appropriate when they provide services to the neighboring limited
industrial businesses and/or employees.
C. General Industrial (M2):The purpose of the general industrial district is
to encourage heavy industrial development by providing and protecting
an environment for such development,subject to standards that protect
public health, safety and welfare.
D. Airport Industrial (1\43): The purpose of the airport industrial district is to
provide property for industrial uses that are compatible with the safe
operation of the Boise air terminal(Gowen field).The airport industrial
district is intended for nonnoise sensitive manufacturing,industrial,and
commercial uses. (Ord.389,6-14-2000)
5. Chapter 5,Title 8 of the Ada County Code. SPECIFIC USE STANDARDS: This
article sets forth the purpose,applicability,and specific use standards for all uses
set forth in the RR District and applicable overlay district.
Section 8-5-1: PURPOSE:
A. This Chapter provides specific standards for all uses as set forth within
the applicable base district(Chapter 2) or overlay district(Chapter 3).

i I Article A sets forth the procedures and required findings for Accessory
Uses.
C. Article B sets forth the procedures,general standards,and required
findings for Conditional Uses.
Section 8-5-2. APPLICABILITY:These regulations apply to any property in
unincorporated Ada County where the specific use is listed as a permitted,
accessory,or conditional use in the base district or otherwise allowed by an
overlay district.
Section 8-5-3: SPECIFIC USE STANDARDS:These standards are in addition to
the requirements of Chapter 4,Regulations Applying to All Districts.
Article 8-5C. CONDITIONAL USES: This article sets forth the purpose,
applicability, process, conditional use standards, and required findings for uses
that require conditional use approval as noted in the RR District.

has approximately 1221 feet of roadway frontage to W.Amity Road,which is classified
as a minor arterial. The subject property presently contains one (1)6,000 square foot
structure approved for a radio station as evidenced by File#79-27-CU,as well as four(4)
communication towers. The existing structure is presently vacant.
The existing 6,000 square foot structure was approved for a radio station. The radio
station is no longer located in the existing structure. The applicant and/or owner are
proposing to change the previously approved use of the structure,which was a radio
station,for use as office building for a professional or business use. A change in use of a
previously approved use(radio station)requires submittal of the appropriate
application and fees and subsequent approval by the Director of Ada County
Development Services,the Ada County Planning and Zoning Commission,or the Board
of Ada County Commissioners.
An office building housing a professional or business use is not an allowed use in the RR
District. In order to occupy the existing structure for professional or business use, the
subject property would need to be located in a commercial or industrial base district and
within an area of city impact, urban services would have to be available to the subject
property, and the use would have to be compatible with the surrounding uses and the
applicable comprehensive plan. Again, a change in use of a previously approved use
(radio station)requires submittal of the appropriate application and fees and subsequent
approval by the Director of Ada County Development Services, the Ada County Planning
and Zoning Commission,or the Board of Ada County Commissioners. If the applicant
and/or owner wish to pursue the proposed development, staff recommends the applicant
and/or owner schedule a preapplication meeting with Development Services.

ES-O-EN Corporation would like to lease the building located at 455 West Amity

and utilized it as an office.
It is our wish to occupy this building as soon as possible.
Through our investigations, we have noted that the property is zoned RR and
that the existing building was utilized by a radio station up till about 2 years ago.
We are under the assumption that a variance or conditional use was approved
for this use in the RR zone. It is also know, through the County Assessors office
that the parcel which the building is on has been valued under state category 130
commercial tract and that the building has been valued under state category 350-
commercial improvement.
We would like to know what procedures we need to follow and applications we
need to submit to accomplish this.
