Development Code District Regulations. Per UDC 11-1-5E, the Director may determine
that a proposed use not listed, is equivalent to a principal permitted or conditional use.

After reviewing your application for an office/.}Vareqpuse, I am denying your application
for a Certificate of Zoning Compliance. The reasons for denial are as follows: The
proposed use is not within the same three (3) digit category of an allowed use listed in
the 2002 edition of the North American IndustriaJ Classification System (NAICS)
published by the United States Department of Commerce. Brokers are classified under
the category of Wholesale Trade. Wholesale uses are prohibited in the L-O zone.

In accordance with UDC 11-5A-4D and UDC 11",5A-6, you have the option to appeal
this decision to the City Council. All City Council Reviews (appeals) shall be filed in
writing with the Planning Department within fiftee~ (15) days after the date of this
letter. The appeal will be forwarded to the City Council to conduct a public hearing. The
appeal should specify the grounds upon which the appeal is filed.

Main Street Marketing does marketing and sales for approximately 25 national
food companies who need Idaho representation of their products to Idaho
distributors such as Food Services of America (Meridian), Tri City Meats
(Meridian), Capitol Distribution. (Meridian), and Sysco Foodservices of'Idaho
(Boise); and to end users such as the Meridian School District, Saint Lukes
Hospital, Smoky Mountain Pizza, and the Express Cafe, to name a few. Our
orders are truckload quantities shipped directly to the distributor.
Our primary function is electronic order placement, order tracking, and record
keeping to track products ill the event of a food recall.
The few samples we handle are picked up by us at the distributor in 1 tb 3 case
amounts and then sampled out to food service operators at their place of
business. We haVe no public traffic to our offices; only the occasional out of
town company representative or UPS delivery.
We are paid on a commission basis and do not buy or sell products directly.
Therefore we feel that we fall sqUarely into the city's c1assiflcati6n of Personal or
Professional Service, as a stock broker or insurance broker perhaps would.

All but one of our employees and three of our four major customers are located
within 3 miles of the proposed building site.
