Sonya, Thank you for the sta? report. We agree with the report and the recommended conditions, with one exception. We respectfully request modification of Condition IV.A.1.iv to clarify the developer’s obligation and ensure it reflects the cooperative nature of the signal improvements. Specifically, we are requesting the condition be revised to read as follows: Settler’s Park requires a signal at the Venable/Ustick intersection as part of their mitigation for the future Community Center. The developer will continue to pursue a Cooperative Development Agreement (CDA). If the City’s Parks Department, ACHD, and the developer enter into a CDA, the developer will manage the construction of the signal.
