REQUEST FOR RECONSIDERATION
MERIDIAN LUXE (11-2025-0035)

RE : Request for Reconsideration — Meridian Luxe (H-2025 -0035)
Pursuant to Meridian City Code section 1 -7- 10(H), this written decision is provided in response to
the Applicant' s request for reconsideration concerning Meridian Luxe (H-2025 -0035) ("Request for
Reconsideration"), which is incorporated herein by reference .
1 . The City Council of the City of Meridian ("City Council") adopted the Findings of Fact,
Conclusions of Law, Decision, and Order concerning Meridian Luxe (H-2025 - 0035) on January
6, 2026 ("Decision ') , which is incorporated herein by reference .
2 . The Decision includes the following condition of approval ("Condition ') : "The applicant shall
install more mature landscaping in the form of 64nch caliper deciduous trees and 8400t4all
coniferous trees that allows trees to touch within five (5) years of planting in the landscape buffer
adjacent to existing residential. "
3 . The Applicant filed the Request for Reconsideration on January 20 , 2026, asserting that the
Decision is deficient because 64nch caliper trees are not available from local wholesale nurseries
in the Treasure Valley.
4 . The City Council considered the Request for Reconsideration at its regular meeting on February
10, 2026 . After reviewing the Request for Reconsideration and the record as a whole, the City
Council determined that the Decision was not deficient simply because it may be more difficult
to utilize 6-inch caliper trees in the landscape buffer, as required by the Condition. As noted
above, the Applicant asserts that 64nch caliper trees are not available from local wholesale
nurseries in the Treasure Valley ; the Applicant never asserted, however, that 6-inch caliber trees
are not available from other potential vendors or sources .

5 . If the Applicant wishes to amend the Condition, the Applicant may request a modification to the
Meridian Luxe development agreement, as permitted under Unified Development Code section
I I - 5B - 3 (F) (3 ) ("A modification to the development agreement may be initiated prior to signature
of the agreement by all parties . . . if filed prior to the end of the six-month approval period . ") .
6 . Because there are no deficiencies with the Decision, the City Council denied the Request for
Reconsideration .
