"X:\.ct:t BEFORE THE CITY COUNCIL OF THE CITY OF MERIDIAN 03-29-00 IN THE l\1ATTER OF THE REQUEST FOR PRELIMINARY PLAT FOR THE PROPOSED WESLEY SUBDIVISION BY APPLICANT. ) ) ) ) ) ) ) ) Case No. PP-00-002 FINDINGS OF FACT AND CONCLUSIONS OF LAW AND ORDER OF CONDITIONAL APPROVAL OF PRELIMINARY PLAT CENTERS CONSTRUCTION, The above entitled matter coming on regularly for public hearing before the City Council on March 7, 2000, and Brad Hawkins-Clark, Assistant Planner for the Planning and Zoning Department, appeared and testified, and the Applicant, Lee Centers, appeared and testified, and appearing and testifying on behalf of the Applicant were: Joe Canning of B &A Engineers and Mike Spink, attorney for the Applicant, and appearing and testifying with comments were: Tina Mortenson, Julie Powell, Bill Weaver, Jay Jones, Corliss Tron, Kathleen Colter, Don Brian, and an unidentified audience member, and the matter was tabled until March 21,2000, and Steve Siddoway, Assistant Planner for the Planning and Zoning Department, appeared and testified, and Joe Canning of B &A Engineers, appeared and testified on behalf of the Applicant, and no one appeared and testified in opposition, and the City Council having received a report from Bruce Freckleton, Assistant City Engineer, FINDINGS OF FACT AND CONCLUSIONS OF LAW AND ORDER OF CONDITIONAL APPROVAL OF PRELIMINARY PLAT- CENTERS CONSTRUCTION FOR WESLEY SUBDIVISION (PP.OO-002) - 1 and Brad Hawkins-Clark, Assistant Planner, and the City Council having received as part of the record of this matter the recommendation to City Council of the Planning and Zoning Commission and the applicant having submitted the revised "PRELIMINARY PLAT OF WESLEY SUBDIVISION, DATE: November 29, 1999, Revision A: CM 03/15/00, Revised per Staff recommendations, Dra'wn By: CA. Auth, Dwg. No. CAA-961129-A, By: B. &A Engineers, Inc.", CENTERS CONSTRUCTION, Developer, for WESLEY SUBDIVISION, submitted for preliminary plat approval and which preliminary plat for approval application is herein received and adjudged by the City Council pursuant to Meridian City Code S 12-3-3. Therefore the City Council makes the following findings: FINDINGS OF FACT 1. That the proposed development is in conformance with the Comprehensive Plan by reason of the fact that it lies vvithin the existing Urban Area as defined in the Meridian Comprehensive Plan Generalized Land Use Map, Infrastructure Planning Analysis Comprehensive Plan and Map, adopted December 21, 1993, and the property is presently zoned Limited Office (L-O) and Medium Density Residential (R-8), and requires connection to the Municipal Water and Sewer System. [Meridian City Code S 11-7-2 C] 2. The preliminary plat is in conformance 'Yvith the Comprehensive Plan FINDINGS OF FACT AND CONCLUSIONS OF LAW AND ORDER OF CONDITIONAL APPROVAL OF PRELIMINARY PLAT- CENTERS CONSTRUCTION FOR WESLEY SUBDIVISION (PP-OO-002) - 2 City of Ivleridian adopted December 21, 1993, Ordinance No. 629. 3. It is determined that Urban Services can be made available to accommodate the proposed development if the plat complies with the requirements and conditions hereinafter set forth as conditions of preliminary plat approval. 4. The proposed development is a continuity of the proposed development within the City's Capital Improvement Program and if the conditions which are requested by the Planning and Zoning Administrator and the Assistant City Engineer and as proposed by the developer as stated on the preliminary plat there will be public financial capability of supporting services for the proposed development. 5. The development if built in accordance with the conditions and as proposed, will not create health, safety or environmental problems and there have been no specifics of any such concerns brought to the Council's attention. 6. It is found that the Recommendation To City Council of the Planning and Zoning Commission is reasonable and appropriate for the conditions of approval of the preliminary plat as hereinafter set forth. 7. The applicant has submitted for consideration of this approval drawing of the revised preliminary plat herein designated as: "PRELIMINARY PLAT OF WESLEY SUBDIVISION, DATE: November 29, 1999, Revision A: CAA 03/15/00, Revised per Staff recommendations, Drawn By: CA. CENTERS CONSTRUCTION, Developer, for WESLEY SUBDIVISION". DECISION AND ORDER Pursuant JO the City Council's authority as provided in Meridian City Code S 12-3-5 and based upon the above and foregoing Findings of Fact which are herein adopted: IT IS HEREBY ORDERED AND THIS DOES ORDER 1. The revised Preliminary Plat of the applicant as evidenced by the "PRELIMINARY PLAT OF WESLEY SUBDIVISION, DATE: November 29, 1999, Revision A: CAA 03/15/00, Revised per Staff recommendations, Dravvn By: C.A. Auth, Dwg. No. CM-961129-A, By: B. &A Engineers, Inc.", CENTERS CONSTRUCTION, Developer, for WESLEY SUBDIVISION", is hereby conditionally approved; and 2. The conditions of approval are as follows to-wit: Adopt the Recommendations of the Planning and Zoning and Engineering Departments as follows: 2.1 Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance. The ditches to be piped should be shown on the site plans. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. No variances have been requested for tiling of any ditches crossing this project. FINDINGS OF FACT AND CONCLUSIONS OF LAW AND ORDER OF CONDITIONAL APPROVAL OF PRELIMINARY PLAT- CENTERS CONSTRUCTION FOR WESLEY SUBDIVISION (PP.OO-002) - 4 2.2 Any existing domestic wells and/or septic systems within this project vvill have to be removed from their domestic service per City Ordinance. Wells may be used for non-domestic purposes such as landscape irrigation. 2.3 Off~street parldng shall be provided in accordance with the City of Meridian Zoning and Development Ordinance and/or as detailed in site~ specific requirements. 2.4 Paving and striping shall be in accordance vvith the standards set forth in the City of Meridian Zoning and Development Ordinance and in accordance with Americans vvith Disabilities Act (ADA) requirements. 2.5 A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer for all off-street parldng areas. All site drainage shall be contained and disposed of on-site. 2.6 Outside lighting shall be designed and placed so as not to direct illumination on any nearby residential areas or the traveling public and in accordance with City Ordinance. 2.7 All signage shall be in accordance with the standards set forth in the City of Meridian Zoning and Development Ordinance. No temporary signage, flags, banners or flashing signs will be permitted. 2.8 Provide five-foot-wide sidewalks in accordance vvith City Ordinance. 2.9 All construction shall conform to the requirements of the Americans with Disabilities Act. 2.10 Obtain a letter from the Ada County Street Name Committee, approving the subdivision and street names. 2.11 Coordinate fire hydrant placement with the City of Meridian Public Works Department. 2.12 Applicant shall be required to enter into a Re-Assessment Agreement FINDINGS OF FACT AND CONCLUSIONS OF LAW AND ORDER OF CONDITIONAL APPROVAL OF PRELIMINARY PLAT- CENTERS CONSTRUCTION FOR WESLEY SUBDIVISION (PP-OO-002) - 5 with the City of ~eridian to re-evaluate assessments after 12 months of full occupancy. 2.13 Sanitary sewer service to this site will be via extensions from existing mains that were installed adjacent to the proposed development. Applicant will be responsible to construct the sewer mains to and through this proposed development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. Sewer manholes are to be provided to keep the sewer lines on the south and west sides of the centerline. 2.14 Water service to this site 'will be via extensions of existing mains installed adjacent to the proposed development. Applicant will be responsible to construct the water mains to and through this proposed development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. Applicant shall provide the Public works department with information on anticipated fire flow and domestic water requirements for the proposed site. 2.15 Two-hundredMfiftyand 100-watt, high-pressure sodium streetlights 'will be required at locations designated by the Public Works Department. All streetlights shall be installed at subdivider's expense. Typical locations are at street intersections and/or fire hydrants. 2.16 Underground pressurized irrigation must be provided to all landscape areas on site. Due to the landscape area that 'will be required under the planned development guidelines (minimum of 10% of gross land area), primary water supply connection to the City's mains will not be allowed. Applicant shall be required to utilize any existing surface or well water for the primary source. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the entire common open area. 2.17 Provide a minimum 20-foot-wide planting strip beyond required right- of-way along Locust Grove Road. 2.18 A final detailed landscape plan for the common areas, including fencing locations, pathways and types of construction, shall be submitted for FINDINGS OF FACT AND CONCLUSIONS OF LAW AND ORDER OF CONDITIONAL APPROVAL OF PRELIMINARY PLAT- CENTERS CONSTRUCTION FOR WESLEY SUBDIVISION (PP-OO.002). 6 review and appro:ral 'with the submittal of the final plat. The plan must include sizes and species of trees, shrubs, and all proposed ground cover/treatment. A letter of credit or cash surety will be required for the improvements prior to signature on the final plat. The concept landscaping shown on the preliminary plat is acknowledged and approved with the additions and changes noted under Site Specific Comments. 2.19 All required fencing is to be in place prior to applying for building permits. 2.20 Applicant shall be required to dedicate all right-of~way along Locust Grove Road as required by ACHD prior to the issuance of any building permits. 2.21 In addition the Planning and Zoning Commission recommend converting two lots into open space, either Lots 17 and 18 or 34 and 35. Adopt the Meridian Fire Department's Recommendations as follows: 2.22 Applicants shall satisfy all fire code requirements including those pertaining to water flow and fire hydrants. Adopt the Central District Health Department's Recommendations as follows: 2.23 The Applicant's central sewage and central water plans must be submitted to and approved by the Idaho Department of Health & Welfare, Division of Environmental Quality. 2.24 Run-off is not to create a mosquito breeding problem. 2.25 Stormwater shall be pretreated through a grassy swale prior to discharge to the subsurface to prevent impact to groundwater and surface water quality. In order that the Final Plat may be considered by the District for acceptance, the Developer shall cause the following applicable standard conditions to be satisfied prior to District certification and endorsement 1. Drainage plans shall be submitted and subject to review and approval by the District. 2. If public street improvements are required: Prior to any construction within the existing or proposed public right-of-way, the following shall be submitted and subject to review and approval by the District. a. Three complete sets of detailed street construction drawings prepared by an Idaho registered professional Engineer. b. Execute and Inspection Agreement between the Developer and the District together with initial payment deposit for inspection and/or testing services. c. Complete all street improvements to the satisfaction of the District, or execute a Surety Agreement between the Developer and the District to guarantee the completion of the construction of all required street improvements. 3. Furnish a copy of the Final Plat showing street names as approved by the Local Government Agency having such authority together with the payment of fee charged for the manufacturing and installation of all street signs. 2 4. If Public Right-of-Way Trust Fund deposit is required, make the deposit to the DIstrict in the form of cash or cashIer's check for the amount specified by the District. 5. Furnish easements, agreements and all other datum or documents as required by the District. 6. FurnIsh Final Plat drawings together with the plat and plan review fees for District acceptance and endorsement. The final plat must contain the signed endorsement of the Owner and the Land Surveyor's certification. 7. All of the material must be submitted to District staff two-weeks prior to Commission review of the final plat. 8. Approval of the plat is valid for one year. General Infonnation Owner - Lee Centers Applicant - B & A Engineers R T - Existing zoning L-O, R-8 - Requested zoning 5.03 - Acres 1 - Office lot 32 - Townhouse lots 3,900 - Square footage of proposed office building 264 - Traffic Analysis Zone (T AZ) West Ada - Impact Fee Benefit Zone Meridian - Impact Fee Assessment District Locust Grove Road Minor arterial with bike lane designation Traffic count of 6,737 on 9-29-98 220-feet of frontage 50-feet existing right-of-way (25-feet w/o centerline) 96-feet required right-of-way (48-feet from centerline) Locust Grove Road is improved with 3-lanes with no curb, gutter or sidewalk abutting the site. The segment of Locust Grove Road between Fairview Avenue and Ustick Road is listed in the Five Year Work Program for reconstruction in FY 2001. Locust Grove Road north ofFairview Avenue will be constructed with 3-lanes, tapering to 5-lanes at the Locust Grove Road/Fairview Avenue intersection. B. On December 22, 1999, the District Planning and Development staff inspected this site and evaluated the transportation system in the vicinity. On December 30,1999, and January 21, 2000, the staff met as the District's Technical Review Committee and reviewed the impacts of this proposed development on the District's transportation system. The results of that analysis constitute the following Facts and Findings and recommended Site Specific Requirements. C. The applicant should be required to provide a $4,400 deposit to the Public Road Trust Fund for the cost of constructing a 5- foot wide concrete sidewalk on Locust Grove Road abutting the site, approximately 220-feet. D. The applicant is proposing to construct a public street, Willowbrook Drive, located at the south propeliy line. Single family dwelling driveways are within ISO-feet ofthe site's proposed road. District policy requires any proposed streets to align or offset a minimum of 125-feet (measured centerline to centerline) from any proposed/existing streets, and ISO-feet from all existing driveway (as measured from near edge to near edge). The proposed street location meets District policy for the required intersection offset but not the ISO-foot offset from existing single family Wesley.cll1ll1 Page 2 dwelling driveways. Staff recommends a variance of tile ISO-foot offset requirement from existing driveways because the site has insufficient frontage to offset from all the driveways on Locust Grove Road due to the number and frequency of driveways. E. The applicant is proposing to construct Willowbrook Drive from Locust Grove Road to a point 125-feet west of Locust Grove Road as a 36-foot street section with curbs, gutters, and sidewalk on the north side of the road within 50-feet of right-of-way. The right-of-way for this segment of Willowbrook Drive is proposed to abut the south property line. The road is proposed to transition to a 29-foot street section west of Locust Grove Road. The applicant is not proposing to construct the sidewalk on the south side of the road for the segment of Willowbrook Drive that is constructed to a 36-foot street section. The property owner on the south side of the road will be required to construct sidewalk on Willowbrook Drive when they redevelop. The applicant should coordinate the transition of WiIlowbrook Drive to a 29-foot street section west of Locust Grove Road with District staff. F. The applicant is proposing to construct WilIowbrook Drive west of Locust Grove Road as a 29- foot street section, with curb, gutter and 5-foot wide concrete sidewalks on both sides of the road, within 42-feet ofright-of-way. The District accepts local residential public roads with a 29-foot street section with parking prohibited on one side, if the amount of vehicle trips per day on the street does not exceed 1,000VTD. The proposed density of development that will utilize the proposed roadway will generate less than 1,000 vehicle trips per day. Idaho Code requires that the width of all new public roads be at least 50-feet, except for unusual or exceptional circumstances. District policy section 7204.4.1 defines exceptional cases as: 1. The street must be a local street. (See Figure 72-F1.) 2. Zoning of the area where the street is located must be residential. 3. There mllst be no possibility that the street will be extended in the near future. 4. Traffic volumes on the street are not forecast to exceed 200 vehicles per day. The Commission may also, at its discretion, detem1ine that an exceptional case exists and pem1it a street right-of-way width of less than fifty (50) feet based upon the following considerations: 1. Topography A narTOW street is preferable to avoid scan-ing of the natural landscape, when topographical features such as slopes, rivers, streams, canals, boulders, etc., make a 50-foot right-of-way width impractical. 2. In-fill Development A 50-foot right-of-way would jeopardize the ability to develop an hz-fill parcel for single family development. Staff believes that this parcel qualifies as "in-fill development" because all of the abutting parcels are developed, and the site is only 5.03-acres. Therefore, staff recommends that the applicant be allowed to construct and dedicate a public road into the site as a 29-foot street section, with curb, gutter and 5-foot wide concrete sidewalk, within 42-feet of right-of-way. Parking should be restricted on one side of the roadway. A signage plan should be submitted for review and approval by Planning and Development staff. Wesley.cmm Page 3 G. The applicant is proposing to constmct a 30-foot wide driveway off the proposed public street, located approximately 75-feet west of Locust Grove Road, for access to the office. District policy requires driveways on local streets to be offset a minimum of 50-feet from street intersections. The proposed driveway location meets District policy. R Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. Pave the driveway its full required width and at least 3D-feet beyond the edge 0 f pavement of the proposed public street. 1. The applicant is proposing to constmct a turnaround at the westem tenninus of the proposed public street. The turnaround should be constructed to provide a minimum turning radius of 45- feet. The right-of-way of the turnaround should extend to the west property line for a width of 50-feet. 1. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. Contact Construction Services at 387-6280 (with file numbers) for details. K. Based on development patterns in this area and the resulting traffic generation, staff anticipates that the transportation system will be adequate to accommodate additional traffic generated by this proposed development with the requirements outlined within this report. The following Site Specific Requirements and Standard Requirements must be met or provided for prior to ACHD approval of the final plat: Site Specific Requirements: 1. Dedicate 48-feet of right-of-way from the centerline of Locust Grove Road abutting the parcel by means of recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building pennit (or other required penn its), whichever occurs first. Allow up to 30 business days to process the right-of-way dedication after receipt of all requested material. The owner will be compensated for all right-of-way dedicated as an addition to existing right- of-way from available impact fee revenues in this benefit zone, if the owner submits a letter of application to the impact fee administrator prior to breaking ground, in accordance with Section 15 of ACHD Ordinance #193. 2. Provide a $4,400 deposit to the Public Road Trust Fund for the cost of constructing a 5-[00t wide concrete sidewalk on Locust Grove Road abutting the site, approximately 220-feet. 3. Construct Willowbrook Drive from Locust Grove Road to a point 125-feet west of Locust Grove Road as a 36-foot street section with curbs, gutters, and 5-foot sidewalk on the north side of the road within 50-feet of right-of-way. The written request shall be submitted to the District no later than 9:00 a.m. on the dav scheduled for ACHD Commission action. Those items shall be rescheduled for discussion with the Commission on the next available meeting agenda. Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission action do not provide sufficient time for District staff to remove the item from the consent agenda and repoli to the Commission regarding the requested modification, variance or waiver. Those items will be acted on by the Commission unless removed from the agenda by the Commission. 2. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Planning and Development Supervisor within six days of the action and shall include a minimum fee of $11 0.00. The request for reconsideration shall specificallv identify each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of its original decision. The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. 3. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #193, also known as Ada County Highway District Road Impact Fee Ordinance. 4. The property is approximately 5.029 acres in size and is located at the west side of Locust Grove, 1/4 mile north of Fairview Ave, Melidian, Idaho. 2. The owner of record of the subject property is Centers Construction Inc. of Meridian, Idaho. 3. Applicant is owner of record. 4. The subject property is currently zoned Limited Office (L-O) and Medium Density Residential (R~8). The zoning districts are defined within the City of Meridian Zoning and Development Ordinance, Section 11-7-2. 5. The subject property is within the city limits of the City of Meridian. 6. The entire parcel of the property is included within the Meridian Urban service Planning Area as the Urban Service Planning Area is defined in the Meridian Comprehensive Plan. 7. The Applicant proposed to develop the subject property in the following RECOMMENDATION TO CITY COUNCIL - 1 PRELIMINARY PLAT FOR WESLEY SUBDIVISION - CENTERS CONSTRUCTION manner: a residential subdivision and as office space for small businesses. RECOMMENDATION The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meddian that they approve the conditional use pemlit as requested by the applicant, subject to the following: I. Adopt the Recommendations of the Planning and Zoning and Engineering Departments as follows: 1.1 Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance. The ditches to be piped should be shown on the site plans. Plans will need to be approved by the appropriate irrigation/drainage distdct, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. No valiances have been requested for tiling of any ditches crossing this project. 1.2 Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance. Wells may be used for non-domestic purposes such as latldscape irrigation. 1.3 Off-street parking shall be provided in accordance with the City of Meridian Zoning and Development Ordinance and/or as detailed in site- specific requirements. 1.4 Paving and stdping shall be in accordance with tl1e standards set forth in the City of Meridian Zoning and Development Ordinance and in accordance with Amedcans with Disabilities Act (ADA) requirements. 1.5 A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer for all off-street parking areas. All site drainage shall be contained and disposed of on-site. RECOMMENDATION TO CITY COUNCIL - 2 PRELIMINARY PLAT FOR WESLEY SUBDIVISION - CENTERS CONSTRUCTION 1.6 Outside lighting shall be designed and placed so as not to direct illumination on any nearby residential areas or the traveling public and in accordance with City Ordinance. 1.7 All signage shall be in accordance with the standards set forth in the City of Melidian Zoning and Development Ordinance. No temporary signage, flags, banners or flashing signs will be permitted. 1.8 Provide five-foot-wide sidewalks in accordance with City Ordinance. 1.9 All construction shall conform to the requirements of the Americans with Disabilities Act. 1.10 Obtain a letter from the Ada County Street Name Committee, approving the subdivision and street names. 1, II Coordinate fire hydrant placement with the City of Meridian Public Warks Department. 1.12 Applicant shall be required to enter into a Re-Assessment Agreement ,vith the City of Meridian to re-evaluate assessments after 12 months of full occupancy. 1.13 Sanitary sewer service to this site will be via extensions from existing mains that were installed adjacent to the proposed development. Applicant will be responsible to construct the sewer mains to and through this proposed development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. Sewer manholes are to be provided to keep the sewer lines on the south and west sides of the centerline. 1.14 Water service to this site will be via extensions of existing mains installed adjacent to the proposed development. Applicant will be responsible to construct the water mains to and through this proposed development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. Applicant shall provide the Public works department with information on anticipated fire flow and domestic water requirements for the proposed site. RECOMMENDATION TO CITY COUNCIL - 3 PRELIMINARY PLAT FOR WESLEY SUBDIVISION - CENTERS CONSTRUCTION 1.15 Two-hundred-fifty and 1 OO~watt, high-pressure sodium streetlights will be required at locations designated by the Public Works Department. All streetlights shall be installed at subdivider's expense. Typical locations are at street intersections and/or fire hydrants. 1.16 Underground pressurized ilTigation must be provided to all landscape areas on site. Due to the landscape area that will be required under the planned development guidelines (minimum of 10% of gross land area), primary water supply connection to the City's mains will not be allowed. Applicant shall be required to utilize any existing surface or well water for the primary source. If City water is proposed as a secondary source, developer shall be responsible to pay water assessments for the entire common open area. 1.17 Provide a minimum 20~foot-wide planting strip beyond required right~ of-way along Locust Grove Road. 1.18 A final detailed landscape plan for the common areas, including fencing locations, pathways and types of construction, shall be submitted for review and approval with the submittal of the final plat. The plan must include sizes and species of trees, shrubs, and all proposed ground covel1treatment. A letter of credit or cash surety will be required for the improvements prior to signature on the final plat. The concept landscaping $hown on the preliminary plat is acknowledgeq. and approved with the additions and changes noted under Site Specific Comments. 1.19 All required fencing is to be in place prior to applying for building pennits. 1.20 Applicant shall be required to dedicate all right-of-way along Locust Grove Road as required by ACHD prior to the issuance of any building pennits. 1,21 In addition the Planning and Zoning Commission recommend converting two lots into open space, either Lots 17 and 18 or 34 and 35.
