What ordinance can you not comply with? Title 12.4.2 - Public Improvements: No street that ends in a cul-de-sac or a dead-end shall be longer than four hundred fifty feet (450'). 2. What prevents compliance with the ordinance? Ordinance prevents public vehicular access to the proposed development. 3. What are the minimum requirements of this ordinance that need to be reduced to permit the proposed use? Main access road, located on the east property line, and the secondary access road, which are north of Franklin Road need to be extended beyond the maximum cul-de-sac length ot 450' in order to gain public access to the proposed development and the parcel northeast of the Cafarelli Subdivision. 4. What is the difficulty or hardship that would result if requirements of this ordinance were applied to the subject property? Property north of Caferelli Subdivision and main access road to site will be non-accessible from a public thoroughfare. The secondary access would become the primary access to the site, which is not near the recommended quarter-mile point for a future traffic light on Franklin Road. Additionally, the future planting of the undeveloped southwest portion of the site would not be conducive for public access to future commercial developments. 5. Any unusual or peculiar circumstances that indicate regulations of this ordinance that should not be strictly complied with? Unusual circumstances not to have access to commercial developments from a public street. 6. Special conditions and circumstances exist which are peculiar to the land. structure or buildings involved, which are not applicable to other lands, structures, or buildings in the same district. Proposed use of site requires public access to the north portion of the site to allow proper function and circulation of the proposed development as well as providing access to the parcel of land north of the Caferelli Subdivision. The Owner. acting in good faith, intends to design and to construct the two access drives to ACHD Street Standards. Literal interpretation of the provisions of this Ordinance shali deprive the applicant of rights commonly enjoyed by other properties in the same district under terms of this ordinance. Commercial projects proposed and future commercial projects on undeveloped parcels should have public street access to their site in lieu of easement access through private drives. B. Special conditions or circumstances exist that was not a result of the applicant's action. The parcel located north of the Caferelli Subdivision does not have improved public access from a public street. Access is currently gained through private drives off Linder Road. Note: A 60' access easement to benefit the property directly north of the Caferelli Subdivision is identified running due north along Linder Road from the Franklin Road/Linder Road intersection. The easement requires a crossing to be installed over the Eight-Mile Lateral in order to be functional. The installation of the main access road for the proposed Transportation Facility would benefit this landowner. 9. Granting the variance requested shall not confer on the applicant any special privilege that is denied by this Ordinance to other lands, structures or buildings in the same district. The applicant has no prior knowledge of special privileges approved or denied in this District and does not interpret approval of the variance to be a speCial privilege but a matter of proper planning. 10. How wouid the granting of the variance convenience the applicant and how the applicant would profit therefrom, which statement shall also represent whether profit and convenience is the sole reason why the variance is requested? Granting the variance would allow the main access road to be a dedicated right-of-way in the future and justify an installation of a traffic light for the School District and proposed Sanitary Services parcel to access in a safe and efficient manner onto Franklin Road in lieu of a private drive. Additionally, the secondary access drive will not only allow an alternate route for bus traffic but will enhance public access to the undeveloped commercial properties in the future which is good planning. The School District requests granting of the variance for the sole reason of convenience to gain safe and functional access to the site. 11. The relationship of the proposed variance to the Meridian Comprehensive Plan. A. Proposed variance would ailow access roads to be incorporated into regional transportation plan for Ada County as a key transportation route for the School Districts' service to the community. (Chapter VI.A.2.a), B. Variance allows improved safety for fire suppression and emergency medical service to the site as a dedicated R.OW. in lieu of a private drive at the end of a cul-de-sac. (Chapter VI.AA.b) C. Enhancing service of the School District to the surrounding communities which must be expanded in anticipation of future growth rather than response to growth that has already occurred (Chapter VI.CA). D. Safety concerns must continue to be addressed. Hence, safe ingress and egress to the site for school bus traffic. (Chapter VI.6.4.a) E. Enhance existing transportation systems to accommodate growth (Chapter VII.D.Goalll). F. Expand, improve and maintain the City's infrastructure to meet existing and future growth demands in a timely, orderly and logical manner (Chapter VII.D.Goal IV). 02020-01 M03111402 Mrn.
