A Meeting of the Meridian City Council was called to order at 6:00 p.m. Tuesday, February 10, 2026, by Mayor Robert Simison. Simison Simison: Council, we will call this meeting to order. For the record it is February 10th, 2026, at 6:00 p.m. We will begin tonight's regular City Council meeting with roll call attendance. PLEDGE OF ALLEGIANCE Simison: Next item is the Pledge of Allegiance. If you would all, please, rise join us in the pledge. (Pledge of Allegiance recited.) COMMUNITY INVOCATION Simison: I do not see our community invocation. ADOPTION OF AGENDA Simison: So, we will move on to adoption of the agenda. Overton: Mr. Mayor? Simison: Councilman Overton. Overton: There are no changes to tonight's agenda, so I move we approve the agenda as published. Little Roberts: Second. The ayes have it and the agenda is agreed to. MOTION CARRIED: ALLAYES. ANNOUNCEMENTS AND RECOGNITION Simison: Council, we do have a new item for our agenda called Announcements and Recognition. So, my first announcement is announcement of the new agenda item through that. But does any Council Member have any comments that they would like to make on Announcements and Recognition? Overton: Mr. Mayor? Simison: Councilman Overton. Overton: I'm going to lead off. I would like to take a couple minutes to recognize that we lost a very important volunteer recently in Billie Bowles. She was an infectious smile and greeter sitting in our lobby for many many years and what's interesting is I didn't know her that well, but I brought my 86 year old mother into the lobby one day getting her a passport and she immediately struck up a conversation with Billie, because Billie's first life -- she ran the desk at Hewlett Packard for many many years and my mom spent 25 years working there and they have a long-standing friendship and she was this incredible human being who, if you could have given a PhD in friendliness and charm, she would have had it and she's tremendously missed and I can't begin to touch on -- on what she's meant to the other volunteers in the city and what her loss will mean for us as we move forward. Little Roberts: Mr. Mayor? Simison: Council Woman Little Roberts. Little Roberts: I would also like to acknowledge what a wonderful volunteer and person Billie was and it is a tremendous loss for us. I got to know her when she was at Hewlett Packard. I did corporate housing for Hewlett Packard and you did not get upstairs to talk to the people that made the decisions if you couldn't get past Billie and I got in there one day and did not have an appointment -- well, I had an appointment, but somehow it didn't get on her books, so if it wasn't on her books -- and those weren't -- were the days where you couldn't pull up your e-mail on your cell phone and so I got to sit there for a while, because although she was wonderful and friendly, you played by Billie rules, which I absolutely loved and adored, which she was all of foot nothing, but you still didn't mess with Billie and she was just -- I just always looked forward to seeing her when I would walk in and her smiling face and she is tremendously missed. Simison: Any other -- Councilman Cavener. Meridian City Council February 10,2026 Page 3 of 14 Cavener: Thanks. It's a hard one. I didn't get to know Billie in a former life, so I -- have always kind of viewed her as our original volunteer at City Hall and selfishly she was a huge resource, because I would walk in and in 15 minutes get the whole lay of everything that's been happening in City Hall in the past week. She knew everything that was going on in every corner, who was screwing up, who was doing great. She didn't look it, but Billie was eight feet tall and she had a commanding presence certainly for me and I knew when I would come in and see her if I screwed up the week before I was going to hear about it. If there was something she was concerned with the city I was going to hear about it and you have heard me often say up here that, you know, accountability is what we do for somebody, not to someone and Billie is the one that told me that and so I just will continue to take that impact that she has made on me moving forward and I appreciate hearing from my good colleagues about their recollections and memory of her. She is not one who will be forgotten in the Cavener household over time. Thank you, Mr. Mayor. Simison: I will just add my two cents. Yeah. Billie criticized me for your guys' decisions almost every Wednesday for five years, but she was that steady -- you know. And I didn't want to say it this way, but Billie was the GOAT, you know, when it came to volunteerism and, you know, dedication to the city, serving the community and a friend of many of our employees frankly and of the other volunteers and, you know, she -- health issues kept her away for the last year and a half, which I know that she was still in the hearts and minds of many people. We had people in my office that would go over and, you know, help her out after -- after work on things when there was a need, because she meant that much to everybody and it was sad to -- her passing was so quick and -- you know. And I think we all can remember the last time we saw her, but probably should have been one more time than we -- than we actually did through that. So, Billie, you will be missed, so -- on that any other more happy announcements and recognition to this evening? PUBLIC FORUM Simison: Okay. Then we will move on to Public Forum. Mr. Clerk, anyone signed up on this item? Johnson: Mr. Mayor, there were no sign-ups. RESOLUTIONS [Action Item] 1. Resolution No. 26-2567: A Resolution of the City Council of the City of Meridian Appointing Dom Gelsomino to Seat 7 of the Meridian Planning and Zoning Commission; and Providing an Effective Date Simison: Okay. Then we will go on to Item 1. Item 1 is a resolution appointing Dom Gelsomino to the Meridian Planning and Zoning Commission. So, for Council I don't think that anyone up here doesn't know Dom. If you -- if that's the case I apologize. I assume that everyone's had the opportunity. Dom has also been one of those steadfast Meridian City Council February 10,2026 Page 4 of 14 volunteers here at the city. You know, he's been eight years dedicated to our Parks and Recreation Commission, not just at the meetings, but I think -- that's the definition of going above and beyond. We have seen how Dom transforms his body each December -- or at least most Decembers to be part of our Christmas in Meridian festivities and one of the character highlights for the community and that's just Dom. You know, Dom shows up. Dom cares. Dom is committed to the community. He has expressed that in many different ways and activities and so it's with my pleasure that I bring forward Dom to continue that service and dedication. He's going to be in a learning role where he has been in a presidency role. He would be stepping out of the presidency of the Parks and Rec Commission and in a learning role on Planning and Zoning, but I have no doubt that he will be able to pick up that mantle and run with it and be a steady voice on that commission. So, it's my pleasure to bring you Dom for your consideration. I'm happy to stand for any questions. Whitlock: Mr. Mayor? Simison: Councilman Whitlock. Whitlock: No questions. Maybe a comment before I make a motion. There is an old line from the TV show West Wing that I just love. It says decisions are made by those who show up and Dom has shown up for our community time and time again. I was pleased to see him on our Parks Commission and heading things up and decisions were made and good things happened in our city because of Dom and his leadership and that will continue I'm sure as he steps into this new role. So, with that, Mayor, would move that we approve Resolution No. 26-2567, a resolution appointing Dom to Seat 7 of the Meridian Planning and Zoning Commission. Strader: Second for discussion. Simison: Have a motion and a second and recognize Council Woman Strader for discussion. Strader: I just wanted to also echo just my appreciation of you, Dom, how amazing you have been serving our community and I have so much confidence in you stepping into a new role. I think it will be really exciting for you and I think our city will benefit from having a fresh perspective. I think it's going to be fantastic for us. Thank you. Cavener: Mr. Mayor? Simison: Councilman Cavener. Cavener: Not much more to be said, except for I do think that Dom is emblematic of a true community servant and look forward to seeing his impact. I think our Planning and Zoning Commission has really evolved over the past 18 months. I think Dom is going to bring -- I think to Council Member Strader's comments -- a new perspective, but also a lot of institutional knowledge about our city and I think our Planning and Zoning Meridian City Council February 10,2026 Page 5 of 14 Commission is going to benefit from that. We, as Council, are going to benefit from his expertise and so very enthusiastic be in support of this motion. Simison: Any further comments? If not, all in favor signify by saying aye. Opposed nay? The ayes have it and the motion is agreed to. MOTION CARRIED: ALLAYES. Simison: So, Dom, welcome. Would you like to come up make any comments? And as he is coming up, the one thing I didn't share with you -- I thought I would save this until the vote is remember how every community used to require a tot lot. I think now every community may require a dog park, but anyways -- welcome. Gelsomino: Mr. Mayor, Council, thank you so much. First of all, I would like to thank you all for your trust and your confidence in me over the last eight years on the Parks Commission and now as I walk into -- as you have all rightly said -- a learning experience and that was the driving force of why I applied and why I was interested in the Planning and Zoning Commission. It wasn't, you know, going on to the next thing and wasn't because I was bored with Parks and Rec. I love Parks and Rec. I love the opportunities that I have had to make partnerships with local businesses to secure amenities for our Discovery Park dog park and get, you know, hand sanitizer -- hand sanitizers over at Storey Bark Park and having that conversation with our community, working with Juli -- Juli Bokenkamp at the community garden and getting a second community garden over at Discovery Park as well. But broadening knowledge and expanding my knowledge has always been something that I have -- I have pursued. So, I'm very very humbled by the opportunity to do so and to -- to, you know, bring my voice to the Planning and Zoning Commission. I do also want to, you know, thank my -- my father and my stepmom for being here tonight and I also have my mom who is here virtually all the way from Tampa watching. So, it's -- it's a proud family moment. Thank you all for, again, your trust and your confidence and look forward to -- to work with you and to upholding that trust and confidence in my years on Planning and Zoning Commission ahead. Thank you. Simison: Thank you, Dom. DEPARTMENT REPORTS [Action Item] 2. Request for Reconsideration of Conditions of Approval in the Findings of Fact, Conclusions of Law for Meridian LUXE (H-2025- 0015) by Mary Wall, Professional Engineering Services Simison: Okay. With that we will move on to Item 2, Department Report, and I will turn this item over to Mr. Nary. Nary: Thank you, Mr. Mayor, Members of the Council. Before you tonight is a request for reconsideration -- request for reconsideration from Item H-2025-0015. This is on the Meridian City Council February 10,2026 Page 6 of 14 Meridian LUXE. It is a request from Mary Wall, Professional Engineering Services, for -- a decision that was made previously by this Council. Under our city code they have met the standards as required by the code to request reconsideration. Under that they -- this is not an opportunity for public testimony or public input, you basically have to make the decision based upon the request that's in front of you and whether you wish to reconsider that and, if so, the Council has a couple of different options. You can deny the request if you wish. You can also grant the request. And, if so, then, you would set it for a new hearing to hear the -- a full public hearing for both their request of what they would like to see changed, as well as the opportunity for the public to weigh in on that change. So, it's either up or down on the request and if it's an affirmative to allow the request to move forward, then, we would move for a new hearing and we would set it for a future date. Simison: Thank you. Council, any questions for Mr. Nary? Strader: Mr. Mayor? Simison: Council Woman Strader. Strader: Can the scope of the new hearing be limited to this one issue or would it have to be a complete reconsideration of the entire approval? Nary: So, Mr. Mayor, Members of the Council, Council Member Strader, that is -- that's within your discretion as well. I mean you can narrow it to simply the one issue that's before you. The concern, obviously, is that things of that may evolve beyond that, but if that's the purpose of it, yes, that's how we would notice it is it's only to rehear this particular one issue question. Simison: Any additional questions or comments? Taylor: Mr. Mayor? Simison: Councilman Taylor. Taylor: Bill, can you tell me -- I understand that what's before us is a decision on to deny or grant the request for reconsideration. Are we allowed to discuss, you know, the reasons why there is a request in our decision tonight or does that need to be limited towards if we decide to grant them the reconsideration and -- and have those facts made available then? Nary: So, it's a great question, Mr. Mayor, Members of the Council, Council Member Taylor. Certainly there is no testimony, so -- but if you need to articulate your reason either to affirmatively grant the request or why you are firmly denying the request, you certainly have that ability to explain that as part of your record. Cavener: Mr. Mayor? Meridian City Council February 10,2026 Page 7 of 14 Simison: Councilman Cavener. Cavener: Bill, can you just maybe walk the Council through what their options I guess in terms as a basis for decision making. If -- if I understand the -- the request that is before us is did the Council error in our decision making process, because we weren't maybe considering of a certain size of tree that was or was not available. I think that's how I view is the request before us, which means ultimately the Council needs to determine if they errored in that decision as a result of the tree size or if the Council decision is upheld that wouldn't prevent the applicant from at a later time coming for a development agreement modification to modify that request that was a condition of approval. Is that -- is that fairly accurate? Nary: So, Mr. Mayor, Members of the Council, yes, but -- Cavener: Okay. Nary: It depends. So, yes, you are correct. They -- if you were to be denied here it does not foreclose the applicant from any other options that may be available to them, which could include a modification to the agreement. The only thing I would modify from your -- or your question was our code says deficient, not error. So, the state code does use the word error and -- but our code uses the word deficient. So, here is what they have -- what they asked is that it's deficient because of the condition that had been placed on it. That's what they are saying. So, they are not necessarily alleging an error on the city's part or the Council's part, but merely a deficiency that can't be met. Simison: Further questions? Direction, Council? Cavener: Mr. Mayor? Simison: Councilman Cavener. Cavener: I'm happy to restart from where I'm sitting on this. I appreciate the request. Little uncommon, little unconventional. I don't believe that Council was deficient in our -- our decision making process on this. Just really sympathetic of the perspective that the applicant or the applicant's representative has, but doesn't change the decision that the -- that I think the Council made and I don't believe that we errored or were deficient in our decision making process. So I'm not in a position tonight where I will be supportive of this request for reconsideration. Again, I appreciate Mr. Nary outlining that if the applicant needs to make a change, the better approach is to come in and ask for a development agreement modification, as opposed to even a request to limit a rehearing of this item and a very very small subject matter. So, that's where I'm sitting tonight and I won't be in favor of granting a reconsideration. Mr. Mayor, I'm not seeing any -- oh, sorry. Taylor: Mr. Mayor? Meridian City Council February 10,2026 Page 8 of 14 Simison: Councilman Taylor. Taylor: As the Member of Council who made the motion with very specific conditions, I have been thinking a little bit about this and I worry a little bit about kind of opening it all back up and having this take on a whole new life of itself. I remember, I don't know, nine months ago, maybe a year ago we had a very limited in scope decision and the hearing ended up being multiple evenings about topics that weren't even relevant to our decision making and it -- it didn't seem like it was overall a very good experience for the community, who maybe felt a little bit misled and for us as Council to kind of go through that. So, I think I'm sympathetic to constraints that they find themselves under. appreciate Mr. Nary's discussion and saying there is other remedies to fix this and maybe cleaner, better remedies, because I -- I think we may really struggle to restrict the testimony that's shared and we might be giving a sense of false hope to neighbors who are concerned about the project, about what we are going to do. So, I think I -- I would advocate that the applicant probably pursue the other remedies that seem a little bit more straightforward and I would probably support what Councilman Cavener's position is tonight as well. Cavener: Mr. Mayor? Simison: Councilman Cavener. Cavener: Move that we deny the request for reconsideration of conditions of approval, the Finding of Facts and Conclusion of Law from Meridian LUXE, application H-2025- 0015. Taylor: Second. Napoli: Mr. Mayor, Members of the Council, so Item No. 3 on the agenda actually does require a continuance due to this site not being posted correctly. So, the applicant and staff has -- have discussed and they are requesting that you guys continue it until -- yes. Thank you. March 3rd. And I will stand for questions at this time. So, we will take their word that they are in concurrence with that date. Request: Vacation to vacate a 16.1 portion of an existing 26.1-foot- wide public utility, drainage and irrigation easement on the southern boundary of Lot 1, Block 2 of Meridian Place Subdivision No. 1 (Parcel R5672670090) in the R-8 zoning district. Simison: So, next item up is Item 4, which is H-2025-0055. We will open this public hearing with staff comments. Meridian City Council February 10,2026 Page 10 of 14 Napoli: Mayor, Members of the Council, next item on the agenda is the vacation for Well 10-B. So, the site consists of .31 acres of land. It is zoned R-8 and is located at 523 West Cedarburg Drive. The Comprehensive plan is medium density residential and the applicant's request tonight is for approval to vacate a 16.6 foot portion of a 26.6 foot easement for public utilities, irrigation and drainage encumbering the subject property. So, the subject property is a part of the Meridian Place Subdivision No. 1. With the subdivision our property established a 26.6 foot easement on the southern boundary. There is currently a -- this is -- this is currently a well property that is owned and maintained by the City of Meridian and the city is currently constructing a second building on the property as a part of -- and as a part of the conditions of approval they were required to vacate the proposed easement prior to certificate of occupancy of that building. So, relinquishment letters were received. Staff is recommending approval and has not received any written testimony and I will stand for any questions. Simison: Thank you. STAFF ANALYSIS The applicant requests approval to vacate a 16.6 foot portion of the 26.6 foot easement for public utilities,irrigation and drainage encumbering the subject property. The subject property is part of Meridian Place Subdivision No. 1. This lot is zoned R-8 (Medium Density Residential)and consists of 0.31 acres of land.With the subdivision,the subject property established a 26.6 foot easement on the southern boundary. There is currently a well on the property that is owned and maintained by the City of Meridian. The City is currently constructing a second building on the property and as a part of the conditions of approval,the applicant is required to vacate the proposed easement prior to certificate of occupancy. A legal description and exhibit map is include below in Section IV to show the portion of the easement proposed to be vacated. Relinquishment letters were received from Intermountain Gas, Lumen,Nampa Meridian Irrigation District, and Idaho Power. III. ACTION A. General Overview The short plat proposes to subdivide the 0.20-acre property into two(2)building lots in the R-15 zoning district. Existing Structures/Site Improvements (UDC 11-1): There is an existing single-family home that will remain on Lot 1,Block 1 and will be accessed via an existing driveway coming off W. Pine Avenue. The access off of Pine Avenue will require a City Council waiver to remain in place. In addition,there is an existing carport and shed that will need to be removed from the property prior to the city engineer's signature on the plat. 2. Dimensional Standards (UDC 11-2): Existing and future development of the proposed lots shall comply with the dimensional standards set forth in UDC Table 11-2A-7 for the R-15 zoning district. The existing residence will meet the required R-15 setbacks provided the carport on the south side of the site is removed. Additionally,the applicant has shown a 10-foot public utility, drainage,and irrigation easement along the east side of the site that appears to encroach into the footprint of the existing residence. This easement must be revised to lie outside of the existing building footprint. The future residence on Lot 2 shall also be required to comply with the applicable dimensional standards. C. Design Standards Analysis 1. Existing structure and Site Design Standards (Comp Plan, UDC 11-3A-19): There is an existing home that is proposed to stay on Lot 1 complies with the setback requirements listed in UDC 11-2A-7. However,there is an existing carport and shed that is on the southern portion of the property that will need to be removed in order to conform to these setbacks. The applicant agrees to remove the accessory structures. Both structures will need to be removed before the City Engineer's Signature. 2. Landscaping (UDC 11-3B): i. Landscape buffers along streets A 25-foot wide street buffer is required adjacent to W. Pine Avenue, an arterial street. This buffer should be landscaped per the standards listed in UDC 11-3B-7C. The landscape plan shall be revised to include dimensions of the 25 foot landscape buffer and include vegetation coverage calculations to ensure compliance with the standards. Tree preservation A Tree Mitigation Plan should be submitted with the final plat signature application detailing all existing trees and methods of mitigation outlined by the City Arborist before any trees are to be removed as set forth in UDC 11-3B-1OC.5. 3. Residential parking analysis Off-street parking is required to be provided in accord with the standards listed in UDC Table 11-3C-6 for single-family dwellings based on the number of bedrooms per unit. The applicant is proposing a new dwelling with a garage that will meet the required parking standards. Access (Comp Plan, UDC 11-3A-3, UDC 11-3H-4): Access to this property is provided via NW 8'Street, an existing collector street. There is a cross access easement along the west portion of Lot 2 to allow Lot 1 access to the drive serving the site. E. Services Analysis 1. Pressurized Irrigation(UDC 11-3A-15): Underground pressurized irrigation water is required to be provided to each lot within the subdivision as set forth in UDC 11-3A-15. 2. Storm Drainage (UDC 11-3A-18): An adequate storm drainage system is required in all developments in accord with the City's adopted standards, specifications and ordinances. Design and construction shall follow best management practice as adopted by the City as set forth in UDC 11-3A-18. 3. Utilities (Comp Plan, UDC 11-3A-21): Connection to City water and sewer services is required and are available to be extended by the developer with development in accord with UDC 11-3A-21 and Goals 3.03.03G& 3.03.03F.Urban sewer and water infrastructure and curb, gutter, and sidewalks are required to be provided with development of the subdivision. If the City Engineer's signature has not been obtained within two(2)years of the City Council's approval of the short plat,the short plat shall become null and void unless a time extension is obtained,per UDC 11-6B-7. 2.
