Members of the Council
On behalf of our client, Howell-Murdoch Development Corporation, please accept this variance
applicatiorr seeking relief from Section 12-4-5 of the Meridian CitySubdivision Ordinance. The
project, Cedar Springs North Subdivision (Meridian City File Numbers AZ02-028 and PP-02-
027),;includesa request for approval of annexation. and a preliminary plat. The project site is
generally located on the south side of McMillian Road approximately 1;300 feet west of
Meridian Road Section 36; Township 4 North, Range 1 West. The following constitutes tle
written statements required by the City's variance application.
What ordinance can you not comply with?
Section 12-4-5 of the Meridian City Subdivision Ordinance which prohibits block lengths greater
than 1,000'in length.
What prevents compliance with the ordinancel
The site is relatively long and narrow (approximately?h mile long by''/a mile wide). Overall the
,layout provides seven stub streets (three to the west, two to the south and two to the east),.
providing excellent connectivity to surrounding properties. Internal connectivity is also.'
excellent, bub because of the shape of parcel three different blocks exceed the maximum
allowed by code.
What are the minimum requirements of this ordinance that need to be reduced to permit
the proposed use?
The maximum block length needs to be increased from 1,000' to 1,530' on Block 7, 1,350' on.
Block 9; and 1080' on Block 13.
What is-the difficulty or hardship. that would result if requirements of this ordinance
.were applied to the subject property?
The applicant would be required. to build additional roads that will provide no practical
benefit to the project.

Any unusual or peculiar circumstances that indicate reguldtions of th9s ordinance-that
should not be strictly complied with?
The proposed layout provides excellent internal and external connectivity as designed. In
addition, where blocks exceed the maximum length, pedestrian paths have been provided to
enhance pedestrian movements within the project.
Special conditions and circumstances exist whichare peculiar to the land, structure or
buildings involved which are not applicable- to other lands, structures or buildings in the
same district?
The parcel is long and narrow and surrounding properties to the south and west have already
been approved, locking in the location of stub streets in those areas.
A literal interpretation of the provisions of this ordinance shall deprive the applicant of
rights commonly enjoyed by other properties in the same district under terms of this
ordinance:
An applicant has a right to expect that any and all required improvements associated with a
development request will benefit-the public health, safety, or welfare. That right will be
compromised by a literal interpretation of the ordinance, which will cause the propety owner
to install stub streets that provide little or no public benefit.
Special conditions or circumstances exist that was not a result of-the applicant's action.
The properties to the south and west have already been approved, locking in the locationof
the stubs in those areas.
Granting the variance requested shat! not confer on the applicant shy special privilege
that is denied by this ordinance to other lands, structures or buildings in the same
district:
The variance from the maximum blockdength of 1,000 feet due#o the unique circumstances,on
site will' not confer any special privileges denied other lands in this district. Granting the variahce
will sirriplyallow the applicant to develop in the same manner as the surrounding properties. The
applicant wilC still connect to the-stub streets that are provided-in theother developments and
has provided pedestrian paths to enhance internal connectivity.,
How the grantingof the variance would convenience the applicant and how the applicant
would profit therefrom, which statement shall also represent whether profit and
convenience is the sole reason why the variance is requested.
The applicant will benefit by not being required to build redundant roads. He will profit in the.
sense that he wilLnot have to spend money on public improvements that confer no real
benefit to-the public.
Relationship of the proposed variance to the Meridian Comprehensive Plon.
The request does. not conflict with any provision. of the comprehensive plan.

Conclusion '
Thank,gou in advance for your careful consideration of this matter. This request is the result.
of factors largely out of the`applicant's control and-the granting of the request will simply
allow this property to develop in a similar fashion as the surroLinding properties. Finally, it is
important to note that even though the blocks in question do exceed the maximum to varying.
degrees, the layout meets the intent of the ordinance by providing,excellent external and
internal connectivity.
