Statement of Carolee Fusselman
I , Carolee Fusselman , submit this statement based on my personal experience .
During the early stages of this development , Jon Brecken , acting on behalf of the developer,
presented a development plan that relied on a shared easement option . Multiple neighboring
property owners , including myself and others whose driveways were involved , declined to grant
any easement for use of their private driveways .
After that plan failed , Doug Jayo came to my home in person to demand an easement across
my property.
I did not want to give an easement or give up any portion of my property, and I had already said
so .
During this conversation , Doug Jayo was demanding and threatening . He stated that the area
he was asking for—my driveway—was his property. I also believed he intended to take part of
my yard , not just my driveway. This left me confused about what I owned , what rights I had , and
what he already claimed to control . I did not have a lawyer and did not understand the legal
status or value of what he was demanding .
I told Doug Jayo that if he owned the property he was claiming , then I should not be the only
one paying taxes on it and that he owed me money. Doug Jayo responded , " I ' m not giving you a
dime . "
During this same conversation , Doug Jayo told me thatif I did not agree , he would take me to
court. I told him to get off my property.
After I told Doug Jayo to get off my pro perty, a lawyer who had been waiting in his car came
onto my property. He told me that Doug Jayo would take my driveway if I did not agree , He also
told me that he was Doug Jayo's third lawyer and said Doug Jayo was a "dick. "
I cannot afford a lawyer. I understood that even defending myself in court would cost more than I
could manage , regardless of whether I was right . I also believed that Doug Jayo could take even
more from me , including part of my yard .
Because of this , I felt I had no practical ability to refuse .
I ultimately agreed to accept $5 , 000 for the easement . At the time , I did not understand the
value of what I was giving up and believed I was being forced to resolve a situation I could not
afford to fight .

When I signed, I knew that Doug Jayo planned to build behind my property, but I did not know
how many houses he intended to build. I also believed that it did not matter what I agreed to,
because he had far more money and power than I did and would take what he wanted anyway.
I know there was paperwork involved. I recall being shown a form that referenced a court date,
but I cannot locate that document now.
More recently, Doug Jayo came back and asked me to sign an updated easement, stating that
the easement I had signed was not legal. I refused. I refused because I never wanted to give an
easement in the first place.
That pressure has continued. Doug Jayo is now attempting to take additional property through a
sewer and water easement, which my nephew, Bobby, has refused to give him.
I do not believe it is fair to be put in a position where one side has lawyers, money, and power,
and the other side has no realistic ability to defend themselves.
I did not want to sign this easement. I signed because I was threatened with litigation, confused
about ownership, and unable to afford legal representation.
This state me true and correct to the best of my knowledge.
