Our client, Mr. Doug Jayo, had his attorney prepare this straightforward access agreement as a good faith offer. It would be interesting to understand what specific terms your clients wish to negotiate; however, Mr. Jayo is not interested in expanding this beyond the simple access easement agreement originally intended. If the agreement is not acceptable as written, we will proceed to the hearing and report that the parties were unable to reach a resolution. If there is a change of heart, we are happy to proceed with the agreement as written. The Williams have asked that I respond to your email below and the proposed preliminary cross access agreement. The Williams are willing to engage in negotiations regarding a cross-access agreement. However, the terms and specifics of that agreement would need to be revised from what was proposed in your draft agreement. I have recently been brought in to review this project and the access issues related to the same. With that said, the th tight turnaround time from receiving this agreement on Tuesday to having a substantive discussion before the 27 1 is not feasible. There will likely need to be updates. We are asking you to review the document for content. Please let us know of any inaccuracies or concerns you may have. If we can get to a document that all parties agree to, then we will have a surveyor come out and create legal descriptions of the proposed new driveway as well as the portion of your existing driveway that will be ‘shared’ per this agreement (roughly 11’ south of Williams/Hanson north property lines).
