THIS WARRANTY SURFTY AGRF1-A4FNT is made and entered into this _13_day of

hereinafter referred to as CITY. and L.C. DFVFLOPMF:NT, INC.. hereinafter referred to as
DEVELOPER.

construction plans ("Construction Prins"L far the dc�elopmcnt known as Brundage Estates
Subdi-ision No. l ("Subdi%isiun Plat-) located in the City ofllTeridian, vtliiclt Construction Plans
include improvements for public life. safety and health ("Rcquirc(i Public Improvements") and
improvements for non-life, non-safety and non-health improvements ("Required Development
lmprovcmcnts-) (The Required Public Inqumcnlcnts and Required Dcvc1opnlcnt Improvements
may he collectively rcicrrcd herein as "Impro\cments"): and
WHEREAS, DEVELOPLR has completed the installation ofthe Improvements: and
WHEREAS. the t_Inificd I-KCIt pnlent Cuk of the (`ity ot'Meridian Section 1 1-5C-3 requires that
the DEVLLOPLR cXecuto and file"dh the CITY an agNmucnt prov iding for,among other things,
a warranty surety in the amount of twenty percent of the cost of intprorements for a period of two
years; and
WHEREAS. the CITY is agreeable to acceptance of the inTnwerncnts upon the elocution of this
Warranty Surety Agreement and compliance by the DF:VF LOPER with the provisions of the
Unified Development Ut)dc of the City of\ieridian.
NOW. THEREFORE. in considcratiom of f0re1-10iW-1 111utual promises, covenants and agreements
of the parties, it is herehv agreed as tol lows:
L The DEVEL.011I R agrees to correct, repair and maintain all such Required Public
lmprovcmcnts from any defect,, omissions ur irrcgularitioS in the construction. materials
or wort: thercol'I'm a period of m o (2) calendar_years from the date of written acceptance
of such lmprovcmcnts.
2. Upon execution of this Agrecincnt, the Dl-A+.I.(_)PFR shall notify the Cl fY of the
readiness fi,r final inspection. Upon ccrtilic.ition by the(My I ngincer that Al requirements

tollowing shill occur:
A. The DEVEfOPER ,hall submit to the CITY a Warranty Surety in a form approved
by the (ITY in the estimated sum of S 146,975.00 to provide for correction of any
defective materials or \%orkruan,hill in such Required PUhlic Improkcnaent, for a
period of two (2) year, after final acceptance. as defined in the City Public Works
Construction Code. Ile amount of'such surety a,surancc, is haled upon 2W% of
the contractor's itemized bid, as set forth on, Fxhibit "A" attached hereto and
incorporated herein, for the completion of the Reduircd Public Improvements. At
the ezpiratiou of the im o-ycar period. DEVELOPER shall submit a written request
to the CITY to release the Warranty Surety, alone with a statement from the
DEVELOPER that the Required Public Inaprovemcnts continue to meet C'ity's
Requirenacnis at the end of the two-near warranty period. After receiving such
request, the.C'ffY shall conduct an inspection ofthc Required Public Inaprovenienis
to determine if any dctccts are present. If there arc no defects. CITY shall
rclease%rclurn the %y,U-ranty Surely to DLVI`LOPI,.R.

City t ng4cer that all RegUked Public Improvements have been constructed in
accordance with the City', Rcquirenaenis. tiuch certification is not intended to relieve
DEVELOPER or nny contractor or material supplier of'their rc,ponsibility for any
dciccts in materials or ��mknruaship of such Inaprovenacnts.

person and if' the context ,o requires, the singular pronoun shall be taken to mean and
include the plural, the nia;rulinc, and nculer, and that generally all grammatical changes
shall be made_ assumed and implied to mike the provisions hereof apply equally to a single
or several individuals,
