Commission Recommendation: approval at their April 19, 2007 public hearing. Summary of Commission Public Hearing: i. In favor and requesting specific changes: Kevin McCarthy, Jim Jewett, Jim Mashburn, David Turnbull and Steve Bainbridge. 11. In opposition: None 111. Commenting: John Peterson IV. Written testimony: Steve Bainbridge, Ada County Highway District Key Issues of Discussion by Commission: i. Specific changes to the land use map designations by the owners testifying at the two meetings (SEE SLIDE). 11. Recommended right-in, right-out access at the planned intersection ofTen Mile Road and a future collector south of Franklin Road. Key Commission Changes to Staff Recommendation: (SEE SLIDE) 1. Changed the land use designation from Medium High Density Residential to Mixed Use Commercial on the south side of Franklin Road west of Linder Road at the request of Steve Bainbridge and David Connelly. 11. Change the land use designation from Medium High Density Residential to High Density Residential on the north side of Franklin Road between Ten Mile Road and Black Cat Road per Jim Mashburn's testimony. 111. Change the land use designation from Mixed Use Residential to Mixed Use Commercial on the south east comer ofTen Mile Road and Franklin Road at the request of David Turnbull. IV. Change the land use designation from Medium High Density Residential to Mixed Use Commercial south ofI-84 and east ofTen Mile Road for Jim Jewett's property. Testimony since Commission Recommendation: i. Ada County Highway District (ACHD) letter dated May 11,2007. Identical to letter submitted into the record at the Commission hearing. 11. E-mail from Peter Oliver to Pete Friedman dated May 22, 2007 4:29 p.m. 111. Staffhas also met with Dave Roberts and Brad Janicek. Outstanding Issue(s) for City Council: i. The removal of the area south ofI-84 and west ofTen Mile Road from the plan as recommended by staff and the Commission. The area is an overlap with the South Meridian Plan which is stilltmder consideration by the Commission. The South Meridian Plan CPA has been continued until the November 1, 2007, Commission hearing. 11. Consideration of the written comments from ACHD; 1.) requesting that the first intersection north of the interchange be moved farther north; 2.) discussion of funding, impact fee structure and implementation for the planned collector road network; 3.) the District's opinion that portraying a realignment for Overland Road is premature. 111. Confirmation that future development occurring in the areas designated as Mixed Use Commercial on the east side ofTen Mile Road, extending north from the Lifestyle Center to the planned transit station, be designed and constructed in a "Main Street" context (as currently proposed in the plan). This design form emphasizes buildings constructed to the edge of the sidewalk, thereby framing the streets; pedestrian scaled building frontages; vertically integrated mixed use; and on~street parking. A portion of the area is owned by Brighton Corporation whose representative, David Turnbull, committed to this design concept in his testimony requesting a change in the land use designation. Notes: Project: Ten We Area Comprehensive Plan Amendment (CPA-07-007 & CPA-07-008) Location, size of property and existing zoning: The subject area is generally bordered by Linder Road to the east, McDermott Road to the west, the Union Pacific Railroad Line to the north, and %2 mile south of Overland Road to the south. Description of Character of Subject Area: Mostly rural residential properties and agricultural land, with a few urban residential subdivisions on the outskirts of the project boundary. Applications: CPA to amend the Comprehensive Plan Future Land Use Map for the future Ten Mile Interchange Area, and to create several new future land use designations. CPA to amend the Text of the Comprehensive Plan to add the Ten Mile Interchange Specific Area Plan as an addendum. History of Previous Actions: Some of the properties within the study area have received prior approvals (i.e. zoning, platting etc.) for various types of projects. These prior approvals were considered during the drafting of the Ten Mile Area Plan. Outstanding Issue(s) for Commission: There is an overlap with the Ten Mile Area and the South Meridian Area Maps that are proposed. Staff is recommending that the Ten Mile Area Map be amended to remove the overlap areas; the South Meridian Area Map will be used for designating properties west of Ten Mile Road and south of the I-84 Staff Recommendation: Staff is recommending approval of CPA-07-007 & CPA-07-008 per the Analysis -in Sections 8 and 9 and the Findings listed in Exhibit D of the staff report. However, Staff is recommending that the subject CPA's be continued until April 19, 2007, to allow the Commission and the public adequate time to review the proposed CPA's, including staffs recommended changes, in detail before making a recommendation to the Council.
